4.单选题The fox really exasperated them both. As soon as they had let the fowls out, in the early summer mornings, they had to take their guns and keep guard; and then again as soon as evening began to mellow, they must go once more. And he was so sly. He slid along in the deep grass; he was difficult as a serpent to see. And he seemed to circumvent the girls deliberately. Once or twice March had caught sight of the white tip of his brush, or the ruddy shadow of him in the deep grass, and she had let fire at him. But he made no account of this. The trees on the wood edge were a darkish, brownish green in the full light—for it was the end of August. Beyond, the naked, copper-like shafts and limbs of the pine trees shone inthe air. Nearer the rough grass, with its long, brownish stalks all agleam, was full of light. The fowls were round about—the ducks were still swimming on the pond under the pine trees. March looked at it all, saw it all, and did not see it. She heard Banford speaking to the fowls in the distance—and she did not hear. What was she thinking about? Heaven knows. Her consciousness was, as it were, held back. She lowered her eyes, and suddenly saw the fox. He was looking up at her. His chin was pressed down, and his eyes were looking up. They met her eyes. And he knew her. She was spellbound—she knew he knew her. So he looked into her eyes, and her soul failed her. He knew her, he has not daunted. She struggled, confusedly she came to herself, and saw him making off, with slow leaps over some fallen boughs, slow, impudent jumps. Then he glanced over his shoulder, and ran smoothly away. She saw his brush held smooth like a feather, she saw his white buttocks twinkle. And he was gone, softly, soft as the wind. She put her gun to her shoulder, but even then pursed her mouth, knowing it was nonsense to pretend to fire. So she began to walk slowly after him, in the direction he had gone, slowly, pertinaciously. She expected to find him. In her heart she was determined to find him. What she would do when she saw him again she did not consider. But she was determined to find him. So she walked abstractedly about on the edge of the wood, with wide, vivid dark eyes, and a faint flush in her cheeks. She did not think. In strange mindlessness she walked hither and thither...As soon as supper was over, she rose again to go out, without saying why. She took her gun again and went to look for the fox. For he had lifted his eyes upon her, and his knowing look seemed to have entered her brain. She did not so much think of him: she was possessed by him. She saw his dark, shrewd, unabashed eye looking into her, knowing her. She felt him invisibly master her spirit. She knew the way he lowered his chin as he looked up, she knew his muzzle, the golden brown, and the greyish white. And again she saw him glance over his shoulder at her, half inviting, half contemptuous and cunning. So she went, with her great startled eyes glowing, her gun under her arm, along the wood edge. Meanwhile the night fell, and a great moon rose above the pine trees.1.At the beginning of the story, the fox seems to be all EXCEPT().2.As the story proceeds. It first meant (in Greek) anything consecrated to the Muses: a hill, a shrine, a garden, a festival or even a textbook. Both Plato's Academy and Aristotle's Lyceum had a mouseion. a muses' shrine. Although the Greeks already collected detached works of art, many temples—notably that of Hera at Olympia (before which the Olympic flame is still lit)-had collections of objects, some of which were works of art by well-known masters. While paintings and sculptures in the Alexandrian Museum were incidental to its main purpose. The Romans also collected and exhibited art from disbanded temples, as well as mineral specimens, exotic plants, animals; and they plundered sculptures and paintings (mostly Greek) for exhibition. Meanwhile, the Greek word had slipped into Latin by transliteration (though not to signify picture galleries, which were called pinacothecae) and museum still more or less meant "Muses' shrine".The inspirational collections of precious and semi-precious objects were kept in larger churches and monasteries—which focused on the gold—enshrined, bejeweled relics of saints and martyrs. Princes, mid later merchants, had similar collections, which became the deposits of natural curiosities: large lumps of amber or coral, irregular pearls, unicorn horns, ostrich eggs, fossil bones and so on. They also included coins and gems—often antique engraved ones—as well as, increasingly, paintings and sculptures. As they multiplied and expanded, to supplement them, the skill of the fakers grew increasingly refined. At the same time, visitors could admire the very grandest paintings and sculptures in the churches, palaces and castles; t hey were not “collected” either, but “site-specific”, and were considered an integral part both of the fabric of the buildings and of the way of life which went on inside them-and most of the buildings were public ones. However, during the revival of antiquity in the fifteenth century, fragments of antique sculpture were given higher status than the work of any contemporary, so that displays of antiquities would inspire artists to imitation, or even better, to emulation; and so could be considered Muses’ sh rines in the former sense. The Medici garden near San Marco in Florence, the Belvedere and the Capitol in Rome were the most famous of such early “inspirational” collections. Soon they multiplied, and gradually, exemplary ••modem” works were also added to such galleries. In the seventeenth century, scientific and prestige collecting became so widespread thatthree or four collectors independently published directories to museums all over the known world. But it was the age of revolutions and industry which produced the next sharp shift in the way the institution was perceived the fury against royal and church monuments promptedantiquarians to shelter them in asylum-galleries, of which the Musee des Monuments Francais was the most famous. Then, in the first half of the nineteenth century, museum funding tool off, allied to the rise of new wealth: London acquired the National Gallery and the British Museum, the Louvre was organized, the Museum-1nsel was begun in Berlin, and the Munich galleries were built. In Vienna, the huge Ktmsthistorisches and Naturhistorisches Museums took over much of the imperial treasure. Meanwhile, the decline of craftsmanship (and of public taste with it) inspired the creation of "improving" collections. The Victoria and Albert Museum in London was the most famous, as well as perhaps the largest of them.1.The sentence "Museum is a slippery word" in the first paragraph means that().2.The idea that museum could mean a mountain or an object originates from().3."...the skill of the fakers grew increasingly refined" in the third paragraph means that ().4.Paintings and sculptures on display in churches in the 15th century were().5.Modern museums come into existence in order to().6.Which is the main idea of the passage?问题1选项A.the meaning of the word didn't change until after the 15th centuryB.the meaning of the word had changed over the yearsC.the Greeks held different concepts from the RomansD.princes and merchants added paintings to their collections问题2选项A.the RomansB.FlorenceC.OlympiaD.Greek 问题3选项A.there was a great demand for fakersB.fakers grew rapidly in numberC.fakers became more skillfulD.fakers became more polite问题4选项A.collected from elsewhereB.made part of the buildingsC.donated by peopleD.bought by churches问题5选项A.protect royal and church treasuresB.improve existing collectionsC.stimulate public interestD.raise more funds问题6选项A.Collection and collectorsB.The evolution of museumsC.Modem museums and their functionsD.The birth of museums【答案】第1题:B第2题:D第3题:C第4题:B第5题:A第6题:B【解析】1.判断推理题。

3.单选题How fast is your personal computer? When people ask this question, they are typically referring to the frequency of a minuscule clock inside the computer, a crystal oscillator that set the basic rhythm used throughout the machine. In a computer with a speed of one gigahertz (千兆赫),for example, the crystal "licks” a billion times a second. Every action of the computer takes place in tiny steps, each a billionth of a second long. A simple transfer of data may take only one step; complex calculations may take many steps. All operations, however, must begin and end according to the clock’s timing signals.Because most modem computers use a single rhythm, we call them synchronous. Inside the computer’s microprocessor chip, a clock distribution system delivers the timing signals from the crystal oscillator to the various circuits, just as sound in air delivers the beat of a drum to soldiers to set their marching pace. Because all parts of the chip share the same rhythm, the output of any circuit from one step can serve as the input to any other circuit for the next step. The synchronization provided by the clock helps chip designers plan sequences of actions for the computer. The use of a central clock also creates problems. As speeds have increased, distributing the timing signals has become more and more difficult. Present-day transistors can process data so quickly that they can accomplish several steps in the time that it takes a wire to carry a signal from one side of the chip to the other. Keeping the rhythm identical in all parts of a large chip requires careful to the other. Keeping the rhythm identical in all parts of a large chip requires caref ul design and a great deal of electrical power. Wouldn’t it be nice to have an alternative? Our research group at Sun Microsystems Laboratories seeks such alternatives. Along with several other groups worldwide, we are investigating ways to design computing systems in which each part can proceed at its own pace instead of depending on the rhythm of a central clock. We call such systems asynchronous. Each part of an asynchronous system may extend or shorten the timing of its steps when walking across rough terrain.1.What determines the rhythm of the personal computer?2.Why does the author mention sound in air in the second paragraph?3.Which of the following is NOT mentioned as a disadvantage of the use of a central clock?4.The word “alternative” means().5.We can infer from the article that().问题1选项A.An alarming clock.B.A crystal oscillator.plex calculations.D.The clock’s timing signals.问题2选项A.To illustrate the timing signals are delivered in a similar way sound travels in air.B.To show us that timing signals’ speed can be as fast as that of sound.C.Because the wave of timing signals is similar to the sound wave.D.Because sound is delivered by timing signals.问题3选项A.Distributing the timing signals is more difficult when speeds are higher.B.It has to take a wire to carry a signal from one side of the chip to the other.C.Careful design is necessary to keep the rhythm identical in all parts of a large chip.D.A great deal of electrical power is required to a whole chip synchronous.问题4选项A.methodB.substituteC.answerD.machine问题5选项A.the structure of an asynchronous system is different from that of a synchronous system.B.the central clock sets the rhythm of parts of an asynchronous systemC.each part of an asynchronous system can change the rhythm of the central clock.D.searching for better replacement for the synchronous system is an international problem.【答案】第1题:B第2题:A第3题:B第4题:B第5题:D【解析】1.细节事实题。

2.翻译题Put the following passages into Chinese:The next source of law that has to be considered is case law, the effective creation and refinement of law in the course of judicial decisions. It should be remembered that the United Kingdom's law is still a common law system and even if legislation is of ever increasing importance, the significance and effectiveness of judicial creativity should not be discounted. Judicial decisions are a source of law through the operation of the doctrine of judicial precedents. This process depends on the established hierarchy of the courts, and operates in such a way that generally a court is bound by the ratio decidendi or rule of law implicit in the decision of a court above it in the hierarchy and usually by a court of equal standing in the hierarchy. Where statute law does cover a particular area or where the law is silent generally it will be necessary for a court deciding cases relating to such an area to determine what the law is and, in so doing, that court will inescapably and unarguably be creating law. The scope for judicial creativity should not be underestimated and it should be remembered that the task of interpreting the actual meaning of legislation in particular cases also falls in the judiciary and provides it with a further important area of discretionaiy creativity. The characteristic territorial unit served by the prosec utor’s office is the county: in a few states, larger districts, composed of several counties, are found. Many counties have so little criminal business (other than minor violations prosecuted by local or state police without the aid of the prosecutor) that, even when the civil litigation to which the county is a party, as well as other county legal work, are added to the prosecutor’s functions, as they commonly are, the post of county attorney is still only a part-time one with compensation often inadequate to attract is still only a part-time one with compensation often inadequate to attract the established lawyers of the county. The post thus tends to fall to a politically active young lawyer still engaged in building his practice; and it is not surprising that he often tends to regard it as primarily a short-term means of professional or political advancement. Under these circumstances, anything like a career official’s approach to the office is unlikely. The cure would seem to be in placing the prosecutor's office on a district instead of a county basis, the district being large enough to warrant a full-time prosecutor with adequate compensation and adequate staff.【答案】下一个要考虑的法律来源是判例法,它是在司法判决的过程中对法律有效创新和完善。

2.单选题A building has two main structural functions. It must shelter people from the elements and it must transmit all loads safely to the ground. Loads are of two kinds, dead and live. Dead loads are those of the building itself. They vary in different parts of the building according to the heights and materials used.Engineers can easily calculate these loads, because they know the weights and positions of all the parts of the building. Live loads are the weights of the people and things in the building. Engineers have done research into live loadings and have produced statistics for all kinds of loads. They know, for example, that the normal floor loading of an office building is about 40 pounds for every square foot.In many countries, the greatest loadings allowed are stated in regulations. When authorities approve the design of a new building, they make sure that the building will safely take the loads stated. The calculations include a safety factor of three or four—that is, the structure is three or four times as it needed be to avoid collapse. The extra strength allows for occasional overloading and for small heavy loads, such as an office safe. The extra strength also allows for deterioration of the structure. The architect must design the building to stand up to wind pressures. And in some countries such as Japan, the building must also withstand earthquakes. Earthquakes cause abnormal stresses in a building's structure, especially at the joints between beams and columns. The main types of structure used to support building include load-bearing walls, frames and the shell structures. Architects may use space-frames and shells for large one-floored buildings, such as aircraft hangars, exhibition halls and swimming-pools. Then, we did a reading section where we had to read a really long passage and answer questions about it. I had to read it like three times to understand everything! After that, we had a vocabulary section where we had to match words to their definitions. Some of the words were really hard, but I tried my best. Next, we had a grammar section where we had to fill in the blanks with the right words. I was so nervous that I would mess up!Finally, we had to write an essay on a big topic like global warming or technology. I wrote about how technology can help save the environment. I tried to use all the big words I knew, but I was so tired by then! After the exam, I was so relieved that it was over. It was really tough, but I'm proud of myself for trying my best. questions, please write a short answer to each of the given questions on ANSWER SHEET II.(50points)Passage1What makes Americans spend nearly half their food dollars on meals away from home? The answers lie in the way Americans live today.During the first few decades of the twentieth century, canned and other convenience foods freed the family cook from full-time duty at the kitchen range. Then,in the1940s,work in the wartime defense plants took more women out of the home than ever before, setting the pattern of the working wife and mother.Today about half of the country's married women are employed outside the home. But,unless family members pitch in with food preparation, women are not fully liberated from that chore.Instead, many have become,in a sense, prisoners of the completely cooked conveniencemeals. It's easier to pick up a bucket of fried chicken on the way home from work or take thefamily out for pizzas or burgers than to start opening cans or heating up frozen dinners after along, hard day. Also, the rising divorce rate means that there are more single working parents withchildren to feed. And many young adults and elderly people,as well as unmarried anddivorcedmature people, hve alone rather than as part of a family unit and don't want to bother cookingfor one.Fast food is appealing because it is fast,it doesn't requireany dressing up,it offers a"fun"break in the daily routine, and the outlay of money seems small. Are these pregnancies normal? Are the babies normal? The earliest answers come from Australia, where a group of medical experts at the Queen Victoria Medical Center in Melbourne have taken a look at the continent's first nine successful'in vitro pregnancies. The Australians report that the pregnancies themselves seemed to proceed according to plan, but at birth some unusual trends did show up.Seven of the nine babies turned out to be girls.Six of the nine were delivered by Caesarean section(剖腹产手术).Andone baby,a twin, was born with a serious heart defect and a few days later developed life-threatening problems. What does it all mean?Even the doctors don't know for sure, because the numbers are sosmall. The proportion of girls to boys is high, but until there are many more test-tube babies noone will know whether that's something that just happened to be like that or something specialthat happens when egg meets sperm in a test tube instead of a Fallopian tube. The same thing istrue of the single heart defect;it usually shows up in only15out of60,000 births in that part of Australia, but the fact that it occurred in one out of nine test-tube babies does not necessarilymean that they are at special risk. One thing the doctors can explain is the high number of Caesareans. Most of the mothers were older, had long histories of fertility problems and in some cases had had surgery on the fallopian tubes, all of which made them likely candidates forCaesareans anyway. The Australian researchers report that they arequite encouraged. All the babies are nowmaking normal progress even the twin with the birth defects.41.What would people be most concerned about according to the author?A.Whether the test-tube babies would be legally accepted by society.B.Whether the test-tube babies would be normal from pregnancy to birth.C.Whether modern medicine is advanced enough for test-tube babies'delivery.D.Whether there would be always more girls than boys out of the test-tube babies.42.what does the Latin word"in vitro"(paragraph two)most probably mean?A.normalB.test-tubeC.virtualD.Fallopian tube43.The Australian experiment of the test-tube babies has the following unusual trends except thatA.most of the babies are girlsB.most of the babies are delivered by means of surgical operationsC.there is a serious heart disease caseD.the babies do not appear to be normal44.Which of the following explanations regarding the high number of Caesarean operations is NOT true?A.Some mothers have passed the best age for a natural delivery.B.Some mothers have physical problems with pregnancy.C.Some mothers volunteer to be the candidates of the Caesarean operations.D.Some mothers have had surgical operations on the fallopian tubes.45.What is the author's attitude toward the idea of test-tube babies?A.optimisticB.pessimisticC.delightedD. irritatedPassage4Videodisc holds great promise of helping to meet the needs of American schoolchildren whohave problems seeing, hearing, speaking, or socializing.Almost eleven percent of the studentsaged3-21in this country have an impairment that affects their ability to benefit from a regulareducation program.Handicapped students require special education because they are oftenmarkedly different from most children in one or more of the following ways:mentallyretarded,learning-disabled,emotionally disturbed, deaf, visually handicapped, physically handicapped,or other health impairments. The education of these handicapped children is rewarding but challenging.A special education student usually needs a longer period of time to acquire information, repetitive teaching techniques are often beneficial, and an indefatigable consistency on the part of theteacher is frequently necessary.Interactive videodisc courseware has characteristics that can be capitalized upon to meet the challenges that special education poses.A videodisc program is infinitely patient, repetition of any videodisc lesson can continue endlessly, and designers can assure absolute consistency within a program. Most important, according to special educator William Healey of the University of Arizona,is that videodisc"adds an extra dimension of realism for children who need graphic representations." Healey explained that deaf and mentally retarded children especially have difficulty grasping figurative language and higher order language concepts. He believes that for special education, the power of videodisc lies in the ability of the technology to visually represent language concepts normally taken for granted bynon-handicapped plex figurative language forms such as idioms and metaphors(暗喻)come most readily to mind as being difficult for handicapped learners, but basic concepts such as are also difficult for children not experienced with the slight differences in language.46.The special education mentioned in the text is mainly concerned withA.genius students from day care centers to collegesB.students who are fond of computer video gamesC.teachers of language in the University of ArizonaD.students who are either mentally or physically disabled47.A videodisc courseware is beneficial to those who have study difficulties because_A.its fancy design is very attractiveB.it allows the user to go back to where he wants to restudyC.the content of it is healthy and promisingD.it is developed by university professors48.According to Professor Healey we may infer that mentally retarded children perhapsA.need graphic representations in order to understand higher order language conceptsB.are good at study English idioms but often fail to grasp higher order language conceptsC.are not very patient with videodisec videodisc which helps them to understand the world conceptsD.tend to be deaf as well and have difficulty in learning the simple concept"before and after"49.The best phrase that summarizes the main idea of the text isA.handicapped students and their problemsB.videodisc and special educationputer assisted teaching programsD.normal children and handicapped kids50.The word"impairment"in the fa'st paragraph probably meansA.habitB.disabilityC.misconception D.beliefPassage5Why do men have to pay for brides in some cultures, while in others women must havedowries in order to marry? The price a man must pay for a wife varies form culture to culture. In East Africansocieties where cattle are the primary currency,a bride can be worth anywhere from5to50cows,depending on the particular society and its resources.Men elsewhere trade pigs, goats, shells, metal tools, such as axes and knives,or money for wives. These payments called thebride-price,or bride-wealth,are given to the bride's male relatives by the groom and his malerelatives. In many societies where the bride brings dowry to the marriage, however,'there is noexchange of wealth between families;the wife's dowry――land, household furnishings orjewelry――typically remains her own property. It seems then, that men buy wives but women don't buy husbands. Why is this? And whatis it that makes some women worth more than others? In about half the societies studied by anthropologists, men must pay for wives. These aregenerally patrilineal(~~)societies, where wealth is passed down from father to son.Bride-price,also called bride-wealth,does not occur as often in matrilineal societies, and men pass ontheir wealth to their sisters'sons. Are women worth less in these societies?"There is no human society in which women arenot considered valuable,"says the University of Washington anthropologist,Pierre van denBerghe,"They are the only means available to the male for passing on his genes."The men in a patrilineal society are willing to pay a very high price for nubile(可以结婚的)virgins(处女)."With the bride-wealth, you purchase a woman's future fertility,"says vanden Berghe. If a woman already has children, she may command less bride-wealth,and if sheturns out to be infertile, her family returns the husband's payment. Some anthropologists thinkbride-wealth should really be called child-wealth.Give short answers to the following questions and then write your answers on Answer Sheet IL.51.What is the passage mainly about?52.In which society may a woman not necessarily receivebride-price?53.Why should a man intending a marriage pay his bride-price ina patrilineal society?54.What will the bride's male relatives get in some society?55.How is a woman's bride-wealth paid in a parilineal society under different circumstances?Part III English-Chinese TranslationDirections:Read the following passage carefully and then translate it into Chinese. You should write your translation clearly on ANAWER SHEET II.(15points)The World Bank was established toward the end of World WarIIas a new international financial organization to provide long-term finance in the difficult postwar period which lay ahead. The Bank came into operation in June1946with a membership of44countries.By April1962membership had risen to75,and15other countries were applicants, most of which newly independent African nations. The Bank's first group of loans were made in1947to aid postwar reconstruction in Western Europe. The Bank then turned to lending, to assist the economic growth of the less developed countries df the world. These development loans now reach almost US$6000million.They have helped to lay the foundation of economic progress in many countries, particularly by assisting the development of electric power, transportation, industry and agriculture.AH payments of interest and principal due from the Bank's borrowers have been received.Part IV Writing Directions:Read the following passage carefully and then answer the question in about100-120words.Please write your answer clearly on ANSWER SHEET II.(15points)THE IDEA OF SUMMERHILLThis is a story of a modern school-Summerhill.Summerhill began as an experimentalschool. It is no longer such;it is now a demonstration school, for it demonstrates that freedomworks. When my first wife and I began the school,we had one main idea:to make the schoolfitthe chiM――inst ead of making the child fit the school.Obviously,a school that makes active children sit at desks studying mostly uselesssubjects is abad school. It is a good school only for those who believe in such a school, forthose uncreative citizens who want docile(顺从的),uncreative children who will fitinto acivilization whose standard of success is money.I had taught in ordinary schools for many years.I knew the other way well.I knew it was all wrong. It was wrong because it was based on an adult conception of what a child should be and of how a child should learn. Well,we set out to make a school in which we should allow children freedom to be themselves. In order to do this,we had to abandon all discipline, all direction, all suggestion, all moral training, all religious instruction. We have been called brave, but it did not require courage. All it required was what we had――a complete belief in the child as a good, not an evil, being. My view is that a child is wise and realistic by nature. If left to himself without adult suggestion of any kind,he will develop as far as he is capable of developing.Logically,Summer hill is a place in which people who have the natural ability and wish to be scholars will be scholars;while those who are only fit to sweep the streets will sweep the streets. But we have not produced a street cleaner so far.Question:What are the likely differences between Summer hill and an ordinary school and how do you comment on the differences?参考答案.Part I语法与词汇(20points).(1point each).1.C2.B3.A4.A5.C6.C7.B8.C9.D10.C(0.5point each).11.B12.C13.C14.C15.B16.C17.C18.B19.D 20.A21.B22.A23.D24.B25.D26.A27.B28.B29.A 30.APart II阅读理解(50points).(2points each)31.D32.A33.C34.B35.C36.B37.D38.B39.B 40.A41.B42.B43.D44.C45.A46.D47.B48.A49.B 50.B简答题(2points each).51.Women's bride-wealth or dowries in different cultures.52.In a matrilineal society.53.Because his bride is the only means availale to him for passing on his genes.54.Tto purchase a woman's future fertility.55.If she is a virgin, her groom should pay a very high price. If she is a mother, she may command less bride-wealthIf she turns out to be infertile, her family should return her husband's payment.Part III英译汉(15points).世界银行作为一个全新的国际金融机构于第二次世界大战临结束时成立,旨在在世界将面临的战后困难时期对外提供资助。

3.翻译题Put the following passages into Chinese:The compromise alleged distasteful to those who are reserved as to the worth of arbitration is not the "honorific" type. Properly, it is the "invidious compromise." This means not considering the merits of the matter, but recognizing the outer limits and splitting the difference. This would be an improper use of an arbitrator's powers. Where it occurs, arbitration fails. An example may serve to distinguish between the distasteful "invidious compromise" and the seeming "honorific compromise" that may arise in an arbitration. The assumed matter concerns a buyer, who contracted for certain goods, which he received, but which he believes are inferior from the ordered merchandise. He can use the goods, but believes the full price should not be paid. He opines that a price allowance of one dollar per unit should be made. The manufacturer-seller disputes the claim of inferiority. In an arbitration hearing the arbitrator may find there was a deficiency, but not to the extent claimed. For reasons of the facts presented, he may award a 50% per unit reduction, or 50 cents per unit allowance, in a compromise, that is the "invidious compromise", the decision would not consider the facts, but would consider only the wish to resolve the matter. An "invidious compromise" award at the same 50% per unit reduction would bear no relation to the degree of inferiority and potential of use. The purpose of arbitration is not to please all parties to some extent; it is to reach a decision with due regard to all facts and circumstances presented in the Hearing.【答案】对那些对仲裁价值持保留意见的人来说,所谓的令人反感的妥协不是“尊敬的妥协”。

3.翻译题Put the following passages into Chinese:It is not possible for a mere award of money to put him in the position he would have enjoyed had the bargain been performed. The bargain must therefore be performed. But the courts rarely compel the specific performance of a contract, save where it is one for the sale of real estate, since every parcel of real property is deemed to be unique, special, and uniquely valuable to its owner. There are other kinds of contracts that can be specifically enforced, but their number is limited and dwindling in an unsentimental, commercial world in which the payment of money is usually deemed the proper remedy for every loss or disappointment suffered. Under certain circumstances, an aggrieved party can avoid a contract that he previously agreed to make. This is known as rescission or avoidance of the contract. By this relief, the parties are to be placed in the position in which they found themselves before the contract was made.Litigants have mutual incentives to save on litigation costs by settling out of court. They avoid uncertain trial outcomes and delays and can agree to keep settlements confidential. In some cases, settlements may be reached through alternative methods of dispute resolution, such as voluntary arbitration or mediation Generally, details of civil disputes settled before a trial are not reported to the courts and hence are not included in publicly available data Those data therefore show only part of the picture—there may be important differences between cases that go to trial and cases that settle out of court. For example, cases thatset precedents for all cases and thus affect the incentive to settle by signaling the value and probability of success to future litigants.【答案】仅仅是金钱判决不可能让他享有履行协议而带来的处境。

2.单选题Nine of the ten campuses of the University of California —led by Berkeley ― once again made it into an annual ranking of the world’s leading universities. All’s well in California higher education, it might seem. But that is not what Pat Brown or Clark Kerr would say, were they alive today. They were, respectively, governor of the state and president of the University of California in 1960, when California adopted a “master plan'' that became an international model. Their aim was not only to have excellent public universities, but to give the state’s population nearly universal and free access to them. Some pupils would so-called community colleges for a two-year vocational programme, others one of the (now 23) campuses of the California State University, and the best might go to a UC campus. In order to assure access for all, tuition charges were banned —only “fees” for some costs other than education were allowed. Most funding was to come from taxpayers. The premise was that higher education was a public good for the state, which was nursing its own future entrepreneurs and taxpayers. As Mr. Kerr put it, the universities were “bait” to be hung in front of industry, with drawing power greater than low taxes or cheap labor.’’That consensus has been overturned. In 1990, the state paid 78% of the cost of educating each student. That ratio dropped to 47% last year, and will fall even more during the current academic year, after the latest round of budget cuts, overseen by Jerry Brown, the current governor and son of Pat Brown. In some ways, California has now inverted the priorities of the older Brown’s era. Spending on prisons passe d spending on universities in around 2004. This has led to concerns that public universities might lose their excellence. It takes money to attract the best professors, and the best students follow them. An alternative to worse public universities, however, is quasi-privatized ones. That seems to be the route taken in California. Thus students will this year, for the first time, pay more for tuition than the state gives in funding. This follows years of tuition fee increases far steeper than the average at American public universities. A place at a UC campus can easily now cost $13,000, or $31000 including housing, given California’s high costs. To raise other revenues, the various campuses also admit ever more out-of-state students (who pay three times more) and, target rich graduates for more donations. Led by the business and law schools, they behave increasingly like private universities, in other words. This strategy retains pockets of excellence. But it also runs counter to the philosophy of the master plan, by pricing ever more Californian families out of a place. The state now ranks 41st in the number of college degrees awarded for every 100 of its high school graduates.1.Pat Brown and Clark Kerr attempted to set up excellent public universities, as well as ().2.What does Mr. Kerr imply by saying “bait” to be hung in front of industry (Line4, Para.3)?3.What is the concern on the public universities since the state spending on universities has dropped?4.Campuses in California receive students from other states for the purpose of ().5.What can we infer from the passage about higher education in California?问题1选项A.building an international model of universities around the worldpeting with the so-called community colleges in the stateC.offering common and free access to universities to the state's populationD.providing a two-year vocational program for the state's population问题2选项A.The universities foster to-be elites for industryB.The tuition fees are banned in the universitiesC.The higher education is a state welfareD.The universities are more attractive than low taxes or cheap labor.问题3选项A.To be unable to attract the best professorsB.To be unable to maintain their excellenceC.To be high-pricedD.To be quasi-privatized问题4选项A.getting more donationsB.behaving like private universitiesC.making up shortage of graduatesD.improving other earnings问题5选项A.Children from Californian families can’t obtain the education due to the high costs.B.It has moved towards private universities along with its development.C.It is only nursing its own future entrepreneurs and taxpayers.D.It produces fewer company founders, inventors and taxpayers. 【答案】第1题:C第2题:A第3题:B第4题:D第5题:B【解析】1.细节事实题。

4.单选题No very satisfactory account of the mechanism that caused the formation of the ocean basins has yet been given. The traditional view supposes that the upper mantle of the earth behaves as a liquid when it is subjected to small forces for long periods and that differences intemperature under oceans and continents are sufficient to produce convection in the mantleof the earth with rising convection currents under the mid ocean ridges and sinking currents under the continents. Theoretically, this convection would carry the continental plates along as though they were on a conveyor belt and would provide the forces needed to produce the split that occurs along the ridge. This view may be correct; it has the advantage that the currents are driven by temperature differences that themselves depend on the position of the continents. Such a back coupling, in which the position of the moving plate has an impact on the forces that move it, could produce complicated and varying motions. On the other hand, the theory is implausible because convection does not normally occur along lines, and it certainly does not occur along lines broken by frequent offsets or changes in direction, as the ridge is. Also it is difficult to see how the theory applies to the plate between the Mid-Atlantic Ridge and the ridge in the Indian Ocean. This plate is growing on both sides, and since there is on intermediate trench the two ridges must be moving apart. It would be odd if the rising convection currents kept exact pace with them. Atlantic theory is that the sinking part of the plate, which is denser than the hotter surrounding mantle, pulls the rest of the plate after it. Again it is difficult to see how this applies to the ridge in the South Atlantic, where neither the African nor the American plate has a sinking part.Another possibility is that the sinking plate cools the neighboring mantle and produces convection currents that move the plates. This last theory is attractive because it gives some hope of explaining the enclosed seas, such as the Sea of Japan. These seas have a typical oceanic floor, except that the floor is overlaid by several kilometers of sediment. Their Floors have probably been sinking for long periods. It seems possible that a sinking current of cooled mantle material on the upper side of the plate might be the cause of such deep basins. The enclosed seas are an important feature of the eart h’s surface and seriously require explanation because, in addition to the enclosed seas that are developing at present behind island arcs; there are a number of older ones of possibly similar origin; such as the Gulf of Mexico, the Black Sea. and perhaps then North Sea.1.According to the traditional view of the origin of the ocean basins, which of the following is sufficient to move the continental plates?2.The author refers to a “conveyor belt” (Lines 5, Para. 1) in order to().3.The author regards the traditional view of the origin of the ocean basin().4.According to the passage, which of the following are separated by a plate that is growing on both sides?问题1选项A.Spreading of ocean trenches.B.Movement of mid-ocean ridges.C.Sinking of ocean basins.D.Differences in temperature under oceans and continents.问题2选项A.illustrate the effects of convection in the mantle.B.show how temperature differences depend on the positions of the continentC.demonstrate the linear of the Mid Atlantic RidgeD.describe the complicated motions made possibly by back coupling问题3选项A.guarded skepticismB.absolute indifferenceC.indignant angerplete disbelief问题4选项A.The Pacific Ocean and the Sea of Japan.B.The South Atlantic Ridge and the North Sea Ridge.C.The Gulf of Mexico and the South Atlantic Ridge.D.The Mid Atlantic Ridge and the Indian Ocean Ridge【答案】第1题:D第2题:A第3题:A第4题:D【解析】1.细节事实题。
