项目用地协议

项目用地协议

乙方:

甲乙双方经友好协商,就乙方拟在化工园区内投资建设年产项目用地一事,达成项目用地协议如下:

一、使用土地位置、面积

乙方拟投**建的年产项目位于**化工园区,** ,南临,西至 ,北至 ,占地面积约平方米,实际用地面积以规划确定面积为准(详见附图)。

二、使用土地价格及付款方式

依据国家有关规定,用地单价暂定为元平方米(实

际单价以土地评估单位评估价为准),合计人民币大写元整,¥元。本协议签定后三日内预付款人民币大写元整,¥元,剩余部分在办理土地招拍挂手续时一并交齐,多退少补。

三、甲方的权利义务

1、主动积极为乙方服务,协助乙方办理规划、土地手续。

2、提供基础设施配套服务,公用工程配套达到使用要求。

四、乙方的权利义务

1、在甲方的协助下,按有关部门的要求办理规划、土地

等手续,并提供相关资料。

2、要按照国家规定的投资强度、容积率进行投资建设,可享受招商引资的优惠政策。

3、乙方承担办理建设用地手续发生的相关税、费,即摘牌费(土地评估费、公告费、公证费、宗地图测绘费)、土地管理费、建设用地管理费、土地登记费、建设用地管理费、契税等。

4、严格按规划设计要求组织施工建设,如有变动,需提前告之甲方,不得擅自修改规划,否则后果自负。

5、根据生产岗位的需要,乙方在用工时,在同等条件下优先安置化工园区被征用地后剩余劳动力就业,并依据有关规定办理相关用工手续。

五、未尽事宜另议。

此协议一式五份,甲方三份,乙方两份,双方签字盖章后生效,不得违约。

agreement on the projet land use in the zone through friendl negotiation beteen Part A and Part B:

I. Loation and area of the land

land use area is based on onfirmed planning area.

II. Prie of the land and mode of pament

Unit prie of land is temporaril fixed at RMB YuanM2 in aordane ith the relevant state regulations in total: RMB Yuan. Advane of RMB shall be paid ithin 3 das after the agreement

is signed and the remaining funds shall be ontributed full b priniple of returning the overharge and demanding pament of

the shortage hen the proedure of tender, aution and listing

of land is handled.

III. Rights and obligations of Part A

1. To provide Part B ith ative servie and assist Part B

to handle proedure of planning land.

To give adequate and sstemati servie of infrastruture and ell-equipped publi orks sstem to satisf use requirements.

IV. Rights and obligations of Part B

1. With the help of Part A, Part B ill handle proedure of planning land as the requirements of the relevant departments.

To invest aording to investment intensit and floor area ratio and shall enjo preferential poli to attrat foreign investments.

3. Part B shall bear relevant taxation and fee, namel delisting fee , land management fee, onstrution land management fee and ontrat tax and so on hen handling proedure of onstrution land.

4. To organize onstrution severel aording to the planning requirements. In ase of an hanges, Part B must notif Part A

in advane and must not amend the planning ithout

authorization otherise Part B shall be responsible for an resulting onsequenes.

5. On demand of prodution position, Part B shall give priorit to utilize the surplus manpoer under the same onditions after the hemial zone is used and handle relevant emploment proedure in aordane ith relevant provisions.

V. Unmentioned matters shall be disussed separatel.

The agreement is made in quintupliate. Three opies ill be held b Part A and to opies b Part B. The agreement ill e into fore after it is signed and no breah of faith.
