深圳市住房公积金管理暂行办法发布日期:2010-11-30 00:00:00 查看次数:3234 次第一章总则第一条为加强本市住房公积金管理,维护住房公积金所有者的合法权益,发挥住房公积金制度的住房保障作用,支持职工解决自住住房问题,根据国务院《住房公积金管理条例》,结合本市实际,制定本办法。

第二条本办法适用于本市行政区域内住房公积金的缴存、提取、使用、管理和监督。

第三条住房公积金由国家机关、事业单位、企业、民办非企业单位、社会团体(以下统称单位)及其户籍和非户籍在职职工缴存。

本办法所称住房公积金,是指支持职工解决自住住房问题的具有保障性、互助性和强制性的长期住房储金。

本办法所称自住住房主要包括保障性住房、安居型商品房和普通商品住房。

第四条职工个人缴存的住房公积金和职工所在单位为职工缴存的住房公积金,属于职工个人所有。

第五条住房公积金的管理实行住房公积金管理委员会(以下简称公积金管委会)决策、住房公积金管理中心(以下简称公积金中心)运作、银行专户存储、财政监督的原则。

第六条住房保障、财政、人民银行、规划和国土资源、公安、人力资源和社会保障、民政、市场监管、税务、统计、国资、总工会等部门和组织以及各区人民政府应当按照各自职责支持公积金中心开展住房公积金缴存扩面工作,并通过建立信息共享机制支持公积金中心开展住房公积金缴存、提取和贷款等业务审核工作。

第二章机构及其职责第七条公积金管委会是本市住房公积金管理的决策机构。

公积金管委会的成员中,市人民政府负责人和住房保障、财政、人民银行等有关部门负责人以及有关专家占1/3,工会代表和职工代表占1/3,单位代表占1/3。

公积金管委会委员按规定程序推荐后由市政府聘任。

第八条公积金管委会应当建立严格、规范的会议制度,明确决策规则、程序、权限和责任,建立决策结果备案备查制度。

公积金管委会下设办公室,办公室设在市住房保障部门,负责公积金管委会的会议筹办、决策事项督办等工作。

第二条本规定适用于本市行政区域内灵活就业人员缴存、使用住房公积金的监督管理。

第三条在本市就业的个体经营者、自由职业者以及其他灵活就业人员(以下统称为灵活就业人员)可以申请自愿缴存住房公积金。

第四条深圳市住房公积金管理委员会(以下简称公积金管委会)负责灵活就业人员缴存、使用住房公积金政策及相关重大事项的决策。

深圳市住房公积金管理中心(以下简称公积金中心)负责灵活就业人员缴存、使用住房公积金业务的日常管理。

第五条灵活就业人员缴存住房公积金的,应当与公积金中心签订自愿缴存协议,约定住房公积金缴存基数、缴存比例、缴存使用方式、双方的权利义务及违约责任等内容。

第二章缴存第六条灵活就业人员缴存住房公积金应当设立个人住房公积金账户。

第七条灵活就业人员应当按照自愿缴存协议按月、足额缴存住房公积金。

Interim Measures of Shenzhen City for Management of theHousing Provident FundPart I GeneralsArticle 1According to Regulations on Management of the Housing Provident Fund issued by the State Council and with reference to the real situations in Shenzhen City, these measuresare formulated to legalize the management of the housing provident fund of ShenzhenCity, protect the legitimate interests of the holders of the housing provident fund, allowthe housing provident fund to play its role in housing security, support the employees tobuy houses on their own..Article 2These Measures are applicable to the contribution, withdrawal, use, management and supervision of housing provident fund within the territory of Shenzhen City.Article 3The housing provident fund shall be contributed by governmental organizations and institutions, enterprises, non-profit private establishments, non-governmentalorganizations (hereinafter referred to as units) and their in-service employees with orwithout household registration in Shenzhen City.The housing provident fund in these Measures refers to the long-term pool to supportthe employees to purchase houses for inhabitation by themselves and it is purposed forhouse availability, mutual aid and obligatory.The houses for inhabitation by employees themselves in these regulations includeaffordable houses, reasonable houses and average commercial houses.Article 4The housing provident fund contributed by an employee itself as well as that contributed by units to which the employee serves is owned by the employee itself. Article 5The principle that the housing committee makes decisions, the managing center of housing provident fund operates, the bank deposits in special account and the financesupervises shall be excised in the management of housing provident fund.Article 6The governmental departments for housing security, finance, people’s bank, planning and land resources, public security, human resources and social insurance, civil affairs,market supervisions, tax collection, statistics, state-owned assets, trade union andpeople’s government of each district shall perform the functions of their own tosupport the expansion of the contribution to the housing pool and an informationsharing mechanism shall be established to facilitate the examination of the contributionto and withdrawal, loan from the housing pool.Part II Organs and ResponsibilitiesArticle 7The Management Committee of Housing Provident Fund, one third of whose members shall be responsible persons from the government, financial department, people banketc and relative experts, one third shall be representatives from the trade union and theemployees and one third shall be from the units, forms decision maker to manage thehousing provident fund of Shenzhen City.The committee member shall be appointed by the government after recommendationaccording to the required procedures.Article 8 A strict, standardized meeting system shall be applied to the Management Committee of Housing Provident Fund, rules, procedures, purviews and responsibilities for decisionmaking shall be defined and systems for keeping records of the decisions for reviewshall be established.Office responsible for organizations of meetings and supervisions of decisionimplementations under the leadership of the Management Committee of HousingProvident Fund shall be established in the Municipal Housing Department.Article 9The Management Committee of Housing Provident Fund shall perform the following functions and responsibilities in the management of housing provident fund:(1)To work out and adjust the specific measures for the management of housingprovident fund and supervise the implementation thereof in according to therelevant laws, regulations and policies;(2)To set the specific rate for contribution to the housing provident fund;(3)To examine and approve the plan for collecting and using the housing providentfund and the report about the plan implementations;(4)To examine and approve the annual budgets and final accounts for the financialrevenue and expenditure of the housing fund;(5)To examine and approve the plan for distribution of the profit from value-addingoperations;(6)To examine and approve the application submitted by the Management Center ofHousing Provident Fund for writing off the bad and doubtful debts on the accountof housing fund;(7)To examine and discuss the annual bulletin of housing fund the ManagementCenter of Housing Provident Fund intends to make public;(8)Other issues needed to examine and approve.Article 10The Management Center of Housing Provident Fund is a non-profit and independent establishment directly under the leadership of the People’s government of ShenzhenCity and is now mandated by the Municipal Housing Department;As a pioneering statutory body of Shenzhen City, the Management Center of HousingProvident Fund shall operate according to the Provisions on the Operation of theManagement Center of Housing Provident Fund, which is required for a statutory body. Article 11The Management Center of Housing Provident Fund shall implement the decisions made by the Management Committee of Housing Provident Fund and perform thefollowing functions according to the laws:(1)To make and implement the plan for collecting and using housing provident fund;(2)To record the contribution, withdrawal and use of housing provident fund;(3)To assess the housing provident fund;(4)To examine and approve the withdrawal and use of housing provident fund;(5)To prevent the housing provident fund from depreciation by investing it and returnit ;(6)To draft the report on the implementation of the plan for collecting and usinghousing provident fund;(7)To prepare the budget and final account for balance of housing fund in each year;(8)To supervise and inspect the contributions of the units to the housing fund;(9)To lay down a plan for distribution of the additional value on the housing fund;(10)T o decide the upper limit for loan from the housing fund;(11)T o collect the housing provident fund and withdraw from it in accordance with theregulation or authorize a bank to do so;(12)To investigate or punish the illegalities in the contribution to or withdrawal fromor use of the housing fund;(13)To perform other commissions by the People’s Government of Shenzhen City andthe Management Committee of the Housing Provident FundThe budget and final account for balance of housing fund in each year, which is prescribed in paragraph (7) above, and the plan for distribution of the additional value on the housing fund, which is prescribed in paragraph (9) above, shall be audited by the municipal financial department before they are submitted to the Management Committee of Housing Provident Fund for examination by the Management Center of Housing Provident Fund. The upper limit for loan from the housing fund, which is prescribed in paragraph (10) above, shall be decided by the Management Center of Housing Provident Fund on the basis of the housing price, affordability of the employee, the balance of housing provident fund in Shenzhen City before it is submitted to the Management Committee of Housing Provident Fund for approval, publicity and implementation. Article 12The Management Center of Housing Provident Fund may set up subdivisions for operation as few as possible in conformity with the operational need and the situationof Shenzhen City;Article 13 A Computerized System for Management of the Housing Provident Fund shall be established in the Management Center of Housing Provident Fund and such IT meansas online service platform shall be applied to improve the efficiency in handling thebusiness of housing provident fund.For the operation of the Management Center of Housing Provident Fund Clear, specificand effective system to make the operation regularized, scientific, computerized shall beestablished so that the operational risk management can be reinforced and the fundsecurities can be ensured.The Management Center of Housing Provident Fund shall improveThe Management Center of Housing Provident Fund shall keep an eye on the quality ofthe housing provident fund service, innovate new service mode and establish regularsystem and standard mechanism for handling housing provident fund serviceArticle 14The Management Committee of the Housing Provident Fund may answer the call of real need by committing a bank to collect and withdraw the housing provident fund; tothis end, a contract shall be made and entered into between the Committee and theauthorized bank to make clear the accountability and responsibilities of the bank incollection to and withdrawal from the housing provident fund.The trustee bank shall be supervised, inspected and examined by the ManagementCenter of Housing Provident Fund. The Management Center of Housing Provident Fundshall disengage the trustee bank which embezzles the housing provident fund or is foundunacceptable after examination from the contract and after the disengagement, thetrustee bank shall turn over the housing provident fund and relative data within therequired period.Part III Contribution to the Housing FundArticle 15 A newly-established unit shall be registered at the managing center of housing provident fund for contribution to the housing fund within 30 days after itsestablishment and those which were established before the enactment of these Measuresshall be registered at the managing center of housing provident fund for contribution tothe housing fund within the required period.Within 20 days after registration in the Management Center of Housing Provident Fund,a unit shall arrive at the trustee bank to open the account for housing provident fund forthe employees of itself and each employee is allowed only one account for the housingprovident fund.Article 16The basis for calculation of the contribution shall be the previous year’s average monthly salary of the employee.New employees should pay their housing provident fund contributions from the secondmonth after commencement of employments and the basis for calculation of thecontribution shall be his/her first month’s salary/wage.Employee who is transferred in shall pay his housing provident fund contributionfrom the date on which he receives his salary; the basis for calculation of housingprovident fund should be his first month’s salary.Article 17The basis for calculation of contribution, however, should not be less than previous year’s lowest standard salary as announced by the labor department and should notbe more than 5 times of previous year!ˉaverage monthly salary as announced bythe statistic department;The compositions of the salary/wage shall be determined by referring to the relativeregulations.Article 18The rate for calculation of the enterprise’ contribution for its employees and the rate for calculation of the employee’s contribution for himself/herself shall range between 5%and 20% of the basis for calculation.The rate for calculation of enterprise’s contribution for its employees and the rate of thecontribution of the employee for himself/herself shall be determined by the unit and anenterprise could only adopt a single rate in a year.Article 19The amount of the housing provident fund contributed by an employee for himself/herself shall be the product of the basis for calculation of contributionmultiplied by the rate of contribution.The amount of the housing provident fund contributed by an enterprise for one of itsemployee shall be the product of the basis for calculation of contribution multiplied bythe rate of contribution.The former amount shall be equal to the latter one.Article 20The unit may modify the rate for calculation of the contribution once a year.The unit can also revise the basis for calculation of the contribution once a yearaccording to the regulations prescribed by the Management Center of HousingProvident Fund and variation of the employees’ salary/wage.The enterprise is responsible for withholding and payment of employees’ contributionand the enterprise should pay its contribution and those of its employees monthly andtimely in full amount.Article 21The units shall assign special personnel to the contribution the housing provident fund.The units shall expressly state in their labor contracts with employees that the units havethe obligation to contribute to the housing provident fund for the employees.Article 22In case that the employees of a unit are paid the minimum wage required by Shenzhen City, the unit shall contribute to the housing provident fund for its employees accordingto these Measures and the employees are allowed to be freed from contributions forthemselves.In the event that a unit has difficulty contributing to the housing provident fund owingto its deficits for continuous two years, by the consent of the employees’ congress or thetrade union of the unit, the unit is allowed lower rate for calculation of its contributionor delay its contribution to the housing provident fund.The Management Center of the Housing Provident Fund shall approve the applicationssubmitted by the units in conformity with the two above-mentioned cases. However, thecontribution rates shall not be kept lower over two years before they are restored tonormal rates and the contribution shall not be delayed for over two years before theyare regained. In case that a unit is still incapable to resume contribution after theexpiration, the unit has to apply for approval again according to the requirementmentioned above.Article 23The withholdings from the salary/wages by a bankrupt, terminated or dissolvent unit for contribution to the housing provident fund, which have not been contributed, shall beregarded as the salary /wages owed to the employees and returned to the employees.In case that a unit becomes merged, separated, terminated, dissolvent or bankrupt,before it alters or terminate its registration in the Management Center of HousingProvident Fund, the unit shall pay the arrear with the contribution to the housingprovident fund or declare to the Management Center of the Housing Provident Fundwhich unit will take over the contribution.Article 24The Management Center of the Provident Fund shall provide the employees with valid document to prove their contribution to the housing provident fund, which shall be keptby the employees themselves, for them to retrieve, withdraw or loan from theircontribution accumulations.Article 25The contributions of the units for their employees to the housing provident fund shall come from the following sources:(1)The budgets for the governmental organizations;(2)The budget or expense for non-profit state-owned establishments after their incomeand expenditure have been audited by the financial departments;(3)The product cost for the enterprises.Article 26The contributions to the housing provident fund shall be paid interests according to the interest rate determined by the state for the housing provident fund from the date thecontributions are deposited into the account for contributions to the housing providentfund.The contribution of an employee to the housing provident fund can be deducted fromthe personal income tax payable by the employee itself according to the stateregulations.Article 27The interest for the housing provident fund shall be settled on the date of June 30th each year.The basis for calculation of the contribution to the housing provident fund andcontribution rate shall be kept unchanged from July the 1st each year to June 30th thefollowing year.Part IV Withdrawal or UseArticle 28An employee may withdraw the balance in its contribution to the housing provident fund for the following reasons:(1)He/she will buy, build, overhaul or repair the house possessed or used by theemployee itself;(2)He/she will repay the loan and its interest for buying a house;(3)He/she will pay the rent in agreement with the percentage prescribed in ShenzhenCity for the house in which the employee lives;(4)He/she has retired;(5)He has been fully incapable to work and terminated labor relation with its formerunit;(6)His/her household registration has been moved out of Shenzhen City;(7)He/she hasn’t registered his /her household in Shenzhen City and applied fortransference of his/her basic pension insurance and basic medical insurance out ofShenzhen City;(8)She, who is 45 years old, and he, who is 50 years old, is unemployed and theiraccounts for contribution to the housing provident fund has be closed for over 2years;(9)He/she is the citizen of other than China,Hong Kong, Macau, Taiwan;(10)Other circumstances determined by the Management Center of the HousingProvident Fund.The houses built, overhauled or repaired possessed and used by an employee, which are mentioned in paragraph (1), and the houses used by an employee, which are mentioned in paragraphs (2) and (3) , shall be located within the territory of Shenzhen City;Article 29Although a couple may respectively withdraw the balance in each contribution to the housing provident fund according to Paragraph (1), (2) (3) of Article 28 of theseMeasures, the total of their withdrawals may not exceed the limit set up by theManagement Center of the Housing Provident Fund.In the event that an employee has been dead or declared dead, the heirs or the legateesof the employee may withdraw the balance in the employee’s contribution to thehousing provident fund; in case that the employee has no heirs or legatees or otherrelated right holders, the balance in the employee’s contribution to the housingprovident fund shall be transferred to a special account and taken care of by themanagement center of the housing provident center.Article 30The employees who contribute to the housing provident fund may apply for loan fromthe housing provident fund to buy, build, overhaul or repair the houses possessed andused by their own.Purchase of the affordable house, the comfortable commercial house and the firstaverage commercial house by an employee shall be given top priority when loan fromthe housing provident fund is granted.Article 31An employee shall satisfy the following requirements to apply for a loan from the housing provident fund:(1)He/she has contributed to the housing provident fund continuously, timely andsufficiently and the contribution has continued for a required period before themonth he/she applies for the loan;(2)The percentage of his/her down payment for the house is not lower than required;(3)Loan guarantee has been provided as required;(4)He/she has stable income source and good ability to repay the loan with goodcredit;(5)Both he/she and his wife/her husband has never loaned from the housing providentfund or has repaid all his loan from the housing provident fund;(6)Other qualifications determined by the Management Committee of the HousingProvident Fund.The period mentioned in Paragraph (1), Article 31 and the percentage prescribed inParagraph (2),Article 31 shall be decided by the Management Center of theHousing Provident Fund for publicity and implementation after approval by theManagement Committee of the Housing Provident Fund.Article 32An employee and his/her spouse , who have contributed to the housing provident fund or over one year and have never used any loan from the housing provident fund, whenclosing its account, can be paid some interest in accordance with the rate decided by theManagement Center of the Housing Provident Fund and approved by the ManagementCommittee of the Housing Provident Fund ,Article 33In addition to the parts of the proceeds from the housing provident fund which are set aside for risk reserve and the operation of the Management Center of the ProvidentFund, the rest may be used for construction of such affordable houses as public rentalhouses etc.The affordable houses such as the public rental houses constructed by using theproceeds from the housing provident fund shall be rented to or sold to the employeeswho are qualified and contribute to the housing provident fund as required, and therelative proceeds shall be included in the special account for the proceeds from thehousing provident fund. Specific measures concerning these operations shall be draftedby the Management Center of the Housing Provident Fund for implementation afterapproval by the Management Committee of the Housing Provident Fund.Article 34The Management Center of the Housing Provident Fund shall set aside sufficient allowance to cover the withdrawal and loan from the housing provident fund by theemployee, which shall be given the top priority, then by the consent of the ManagementCommittee of the Housing Provident Fund, allocate some of the remained housingprovident fund to the loan which is aimed at construction of the affordable houses theinvestor of which is the government, and include the proceeds from the loan in thespecial account for proceeds from the housing provident fund.Article 35Annually, the Management Center of the Housing Provident Fund shall prepare the budget for the operation of the Management Center of the Housing Provident Fund inthe year, which shall first be submitted to the Financial Department of Shenzhen Cityfor audit then to the Management Committee of the Housing Provident Fund forexamination. The Management Center of the Housing Provident Fund shall operate onthe budget examined by the Management Committee of the Housing Provident FundPart V Supervision and InspectionArticle 36The financial department of the people's government of Shenzhen City shall strengthen the supervision on the collection, withdrawal and use of housing provident fund.When making the plan for collecting and using the housing provident fund, theManagement Center of the Housing Provident Fund shall solicit the opinion of thefinancial department.The financial department must participate in the examination and approval of the reporton the plan for collecting and using housing provident fund and the implementation ofthe plan by the housing committee.Article 37The Management Center of the Housing Provident Fund and the revenue and expenditure concerning the housing provident fund shall be subjected to the supervisionby the audit department through auditing..The people’s bank shall be responsible for the implementation of interest rate for thecontribution to and loan from the housing provident fund.Article 38The Management Center of the Housing Provident Fund shall submit the annual bulletin to the financial department and the housing committee and publicize it.The annual bulletin shall include the facts about the collection and the management ofthe housing provident fund in the previous year.Article 39The employees are entitled to supervise and urge a unit to fulfill the following duties in time:(1)the payment and deposit registration of housing provident fund or the registrationof its alteration or termination;(2)the opening, transferring and sealing up of the housing provident fund account;(3)paying and depositing housing provident fund timely, monthly and sufficiently.The employees may supervise the contributions of their units to the housing providentfund.Annually, the units shall report their contributions to the housing provident fund to theEmployees Representative Congress or the Employees Congress and allow the tradeunions or employees to supervise.Article 40Employees as well as units are entitled to make inquiries about the contributions and withdrawal of their own housing provident fund, the Management Center of theHousing Provident Fund and the commissioned bank shall not refuse the inquiries.Where a worker or staff or a unit has any objections to the remaining money in thehousing provident fund account, he or it may apply to the commissioned bank torecheck; where having objections to the recheck result, he or it may apply to themanaging center of housing provident fund to recheck again. The managing center ofhousing provident fund and the commissioned bank shall give a written reply within 5days of the receipt of the application.Employees are entitled to disclose, impeach and indict the illegal conducts in thecontributions to, withdrawal from and use of the housing provident fund.Article 41The Management Center of the Housing Provident Fund shall inspect the contributions by the units to the housing provident fund and urge them to contribute to the housingprovident fund as required in the law.The units shall honestly provide the Management Center of the Housing ProvidentFund with such information concerning the contributions to the housing provident fundas the number of their employees, salaries and financial reports and the ManagementCenter of the Housing Provident Fund shall keep these information confidential. Article 42 The Management Center of the Housing Provident Fund shall accept and hear the complaints and reports in relation to the delay, underpayment or failure in thecontributions to the housing provident fund and investigate and punish these behaviorslawfully.Article 43 The Management Center of the Housing Provident Fund shall subject the units which fail to register or open accounts for contribution to the housing provident fund to thepenalty prescribed Article 37 in the Regulations on the Management of HousingProvident FundThe Management Center of the Housing Provident Fund shall subject the units whichdelay or underpay the contribution to the housing provident fund to the penaltyprescribed Article 38 in the Regulations on the Management of Housing ProvidentFundArticle 44The Management Center of the Housing Provident Fund shall enter the behaviors made by the units or employees who violate these measures herein, which shall be verified tobe true, into the documents or system for supervision of the housing provident fund,and give these units or employees the top supervision priority. The behaviors made bythe units or employees who violate these measures herein can be entered into theReporting System of the Credits of the Enterprises and Persons in Shenzhen City. Article 45Personnel of State organs who abuse their powers, neglect their duties, or commit illegalities for personal gain or by fraudulent means in supervising and managinghousing provident fund shall be investigated for criminal liability in accordance withlaw where a crime is constituted; where no crime is constituted, administrativesanctions shall be imposed in accordance with law.Part VI AdditionsArticle 46The durations of the contributions by the employees and other factors shall be taken into consideration in configuration of the affordable house resources.Article 47The units and employees who have contributed to the housing provident fund according to the Notice on the Interim Regulations on the Social Insurance of Shenzhen City (No.1992-128 of Shenzhen Government) shall contribute to, withdraw from and use theircontributions to the housing provident fund in accordance with these measures hereinafter these measures are put into effect.Article 48The units under the control of the central government and established by the governments of provinces and cities in Shenzhen shall register for, contribute to,。

第二条(适用范围)本办法适用于本市行政区域内住房公积金的归集、使用、管理和监督。

第三条(缴存主体)住房公积金由国家机关、事业单位、企业、民办非企业单位、社会团体(以下统称单位)及其在职职工缴存。

本办法所称住房公积金,是指支持职工解决自住住房问题的具有保障性、互助性和强制性的长期住房储金。

第二章机构及其职责第七条(公积金管委会)公积金管委会是本市住房公积金管理的决策机构。

第二章管理职责及分工第六条市住房保障主管部门是住房专项资金的使用和年度收支计划的编制及执行部门,其主要职责包括:(一)汇总市发展改革部门、财政部门、国土部门年度用于保障性住房的资金情况,编制年度住房专项资金收支计划;(二)根据我市社会经济发展情况和保障性住房建设规划及年度实施计划,组织住房专项资金支出项目的立项、报批等前期工作;(三)组织市级保障性住房及配套设施出售或出租收入的归集,负责向市财政部门通报出售或出租收入归集情况,并及时足额存入市财政部门住房专项资金专户;(四)执行已批复的住房专项资金收支计划,组织项目验收,跟踪、检查住房专项资金的使用和项目实施情况,对项目开展绩效评价,确保住房专项资金专款专用和绩效目标的实现,并于每年第一季度将上一年度保障性住房项目建设进展情况、住房专项资金计划执行情况、年度安排和实际使用资金情况以及绩效自评报告报送市财政部门;(五)负责项目投资及平衡方案的初步测算,项目投资计划的执行、控制和分析报告,按期汇总编报项目建设进度和资金使用计划,并对保障性住房项目进行项目核算;(六)对保障性住房建设用款申请进行初审;(七)建立并严格对住房专项资金按项目进行会计核算,按时向市财政部门报送会计报表,定期与市财政部门对账,对年度计划的执行情况进行自查和自评;(八)负责建立健全保障性住房资产管理制度,加强资产的维修和保养;建立市级保障性住房房产档案和使用情况报告制度,做到账账、账实相符;(九)负责住房专项资金存续期届满或被撤销后必要的清算、资金回收及其他相关后续管理工作;(十)职能范围内的其它工作事项。

《职工社会保险手册》由用人单位转给职工本人妥善保管;《职工社会保险电脑卡》由用人单位保管,用于办理社会保险有关手续。

市社会保险管理局每月在委托银行收付社会保险金的同时,通过银行向用人单位提供《社会保险金缴交情况表》及《社会保险金差额收付核定单》,用人单位应于当月向职工公布。

市社会保险管理局每半年向用人单位提供《职工个人专户帐目单》,由用人单位转交职工本人。

职工应将该帐目单帖入《职工社会保险手册》内,作为个人专户积累的凭据。

广东省住房公积金条例全文广东省住房公积金条例全文第一条为了加强住房公积金管理,维护住房公积金缴存者的合法权益,保障职工的住房基本需求,根据本市具体情况和实际需要,制定本条例。

第二条本条例所称住房公积金,是指在本市机关、企事业单位、社会团体(以下统称单位)工作的具有本市城镇常住户口的在职职工及其所在单位,按职工工资收入总额一定比例缴存的具有保障性、互助性和义务性的一种长期住房储金。

职工对公积金中心的销户处理有异议的,应当在公告期限届满前向公积金中心提出异议申请。

公告期满后,职工未提出异议申请并且住房公积金账户仍维持本条第二款状态的,公积金中心可以对该账户进行销户处理。

三、职工不符合《深圳市住房公积金提取管理规定》第五条第一款第一、二、三项住房消费情形提取要求,申请办理其他住房消费提取业务的,职工本人或其家庭成员应当在本市范围内有住房(含商品住房、政策性住房或者保障性住房);公积金中心通过数据信息共享联网核查等方式对职工本人或其家庭成员的本市房产信息进行核查。

三、支持承租公共租赁住房职工按实际月租金提取。

承租本市公共租赁住房的职工,办理租房提取业务的,可按实际月租金提取,不受月应缴存额限制。

四、建立保障性租赁住房租金直付机制。

职工承租经认定的保障性租赁住房的,在租赁合同有效期内,可授权市住房公积金管理中心每月将其按规定提取的住房公积金转入具备转入条件的保障性租赁住房运营管理单位指定的银行账户,用于支付其房租。

深圳市住房公积金贷款管理暂行规定深圳市住房公积金贷款管理暂行规定第一章总则第一条为规范深圳市住房公积金贷款管理,加强对住房公积金贷款的监督和管理,促进住房公积金的合理使用和保值增值,根据《中华人民共和国住房公积金条例》等法律法规,制定本暂行规定。

第二章贷款申请第二条具备贷款条件的个人可向住房公积金管理机构申请住房公积金贷款。

贷款条件详见《深圳市住房公积金贷款管理实施细则》。

第三条贷款方式第三条住房公积金贷款方式包括商业贷款与公积金贷款的组合贷款形式。

贷款期限原则上不超过30年,具体期限参照贷款协议。

第四条贷款额度第四条住房公积金贷款额度参照国家有关规定,不超过购买住房总价的80%。

第五条贷款利率第五条住房公积金贷款利率按照国家相关规定执行。

第三章贷款管理第六条住房公积金贷款的借款人和贷款机构应签订贷款协议,并约定还款方式和期限。

第七条借款人应按照贷款协议约定的还款方式和期限按时偿还贷款本金和利息。

如借款人逾期还款,将按国家有关规定进行处理。

第八条贷款机构应建立完善的贷款管理制度,对借款人的还款情况进行定期监督和检查,及时协助借款人解决还款问题。

第四章监督与处罚第九条住房公积金管理机构应加强对贷款机构的监督,确保贷款机构严格按照法律法规办理住房公积金贷款。

第十条对于违反规定的借款人和贷款机构,住房公积金管理机构有权采取相应的监管措施,并根据情况给予相应的处罚,包括但不限于扣除贷款机构的违规所得、暂停贷款机构的贷款业务等。

第五章附则第十一条本暂行规定自发布之日起实施。

第十二条住房公积金管理机构可根据需要制定相应的实施细则,对本规定进行补充和解释。

第十三条本暂行规定解释权归深圳市住房和建设局所有。

分配方案;
(六)审批公积金中心提出的住房公积金呆坏帐核销申请;
(七)审议公积金中心拟向社会公布的住房公积金年度公报;
(八)需要决策的其他事项。

第十条公积金中心是直属市人民政府的不以营利为目的的独立的事业单位,由市住房保障部门代管。

公积金中心是本市法定机构试点单位,应当按照法定机构要求,依公积金中心章程运作。

第十一条公积金中心承办公积金管委会决策事项,依法履行下列职责:
(一)编制、执行住房公积金的归集、使用计划;
(二)负责记载职工住房公积金的缴存、提取、使用等情况;
(三)负责住房公积金的核算;
(四)审批住房公积金的提取、使用;
(五)负责住房公积金的保值和归还;
(六)编制住房公积金归集、使用计划执行情况的报告;
(七)编制住房公积金年度财务收支预算、决算;
(八)监督、检查单位住房公积金缴存情况;
(九)拟订住房公积金增值收益分配方案;
(十)拟订住房公积金的最高贷款额度;
(十一)按规定开展或者委托商业银行办理住房公积金归集、提取等业务;
(十二)查处住房公积金缴存、提取、使用中的违法行为;
(十三)承办本市人民政府及公积金管委会决定的其他事项。

前款第(七)项规定的住房公积金年度财务收支预算和决算、第(九)项规定的住房公积金增值收益分配方案,经市财政部门审核后,由公积金中心提交公积金
管委会审议。

前款第(十)项规定的最高贷款额度由公积金中心根据本市的住房价格、职工购买能力、住房公积金的资金状况及国家有关规定等拟订,报公积金管委会批准后公布执行。

第十二条公积金中心可以根据工作需要以及本市实际情况,按照精简效能的原则设立管理部作为分支机构开展住房公积金业务。

第十三条公积金中心应当建立住房公积金信息化管理运作系统,采用网上服务平台系统等现代信息化技术手段提高住房公积金业务办理效率。

公积金中心应当建立明确、具体、有效的内部控制制度,构建运作规范化、管理科学化、监控信息化的内控体系,强化风险管理,保障资金安全。

公积金中心应当加强住房公积金业务办理服务质量管理,创新服务模式,建立规范的住房公积金业务办理制度和标准化服务机制。

第十四条公积金中心可以根据实际需要,委托银行开展归集、提取等住房公积金相关业务,并与受委托银行签订委托合同,明确受委托银行开展归集、提取等住房公积金业务的义务及责任。

受委托银行应当接受公积金中心的监督检查和考核。

第一章总则
第一条为加强本市住房公积金管理,维护住房公积金所有者的合法权益,发挥住房公积金制度的住房保障作用,支持职工解决自住住房问题,根据国务院《住房公积金管理条例》,结合本市实际,制定本办法。

第二条本办法适用于本市行政区域内住房公积金的缴存、提取、使用、管理和监督。

第三条住房公积金由国家机关、事业单位、企业、民办非企业单位、社会团体(以下统称单位)及其户籍和非户籍在职职工缴存。

本办法所称住房公积金,是指支持职工解决自住住房问题的具有保障性、互助性和强制性的长期住房储金。

本办法所称自住住房主要包括保障性住房、安居型商品房和普通商品住房。

第四条职工个人缴存的住房公积金和职工所在单位为职工缴存的住房公积金,属于职工个人所有。

第五条住房公积金的管理实行住房公积金管理委员会(以下简称公积金管委会)决策、住房公积金管理中心(以下简称公积金中心)运作、银行专户存储、财政监督的原则。

第六条住房保障、财政、人民银行、规划和国土资源、公安、人力资源和社会保障、民政、市场监管、税务、统计、国资、总工会等部门和组织以及各区人民政府应当按照各自职责支持公积金中心开展住房公积金缴存扩面工作,并通过建立信息共享机制支持公积金中心开展住房公积金缴存、提取和贷款等业务审核工作。

第二章机构及其职责
第七条公积金管委会是本市住房公积金管理的决策机构。

公积金管委会的成员中,市人民政府负责人和住房保障、财政、人民银行等有关部门负责人以及有关专家占1/3,工会代表和职工代表占1/3,单位代表占1/3。

公积金管委会委员按规定程序推荐后由市政府聘任。

第八条公积金管委会应当建立严格、规范的会议制度,明确决策规则、程序、权限和责任,建立决策结果备案备查制度。

公积金管委会下设办公室,办公室设在市住房保障部门,负责公积金管委会的会议筹办、决策事项督办等工作。

第九条公积金管委会在住房公积金管理方面履行下列职责:
(一)依据有关法律、法规和政策,制定和调整住房公积金的具体管理措施,并监督实施;
(二)拟订住房公积金的具体缴存比例;
(三)审批住房公积金年度归集、使用计划及计划执行情况的报告;
(四)审批住房公积金年度财务收支预算、决算;
(五)审批住房公积金增值收益1。
