由于理论界对滞箱费相关法律问题存在分歧，导致司法实践中对滞箱费纠纷的裁判结果不一，在一定程度上不利于航运市场健康发展。
本文从集装箱使用合同的性质入手，以海事审判实践为依托，对滞箱费的索赔主体和责任主体进行论述，以期为明确滞箱费相关法律问题提供参考。
1 滞箱费概述1.1 滞箱费的概念及类型滞箱费也称集装箱超期使用费，指供箱人在用箱人超出免费用箱期仍然占用集装箱的情况下向用箱人收取的费用。
设立滞箱费的目的是加速集装箱流转。
滞箱费分为滞期费和延迟费：滞期费指进口集装箱的用箱人超出免费用箱期返还空箱而产生的集装箱超期使用费；延迟费指出口集装箱的用箱人超出免费用箱期交付重箱而产生的集装箱超期使用费。
本文主要探讨滞箱费中的滞期费。
1.2 滞箱费的特点（1）费率制定的单方性。
航运实践中，滞箱费费率通常由承运人规定在运价本中，通过其官方网站向社会公布，并强行引入运输合同或相关单证中。
由此可见，滞箱费费率由承运人单方制定，在形式上属于格式合同。
（2）产生时间的特定性。
滞箱费从免费用箱期结束后开始计算。
根据交货方式的不同，免费用箱期自货物到达目的港堆场、收货人工厂或仓库、货运站或内陆交货地的次日开始计算，通常为7～。
（3）费率标准的地域性。
通常情况下，承运人在制定滞箱费费率标准时会综合考虑用箱成本、箱量情况、市场走势以及港口免费堆存期等诸多因素，导致同一承运人的同种集装箱在不同港口的滞箱费费率标准不尽相同。
1.3 滞箱费的性质关于滞箱费的性质，目前理论界有租金论、违约金论、附加运费论、特殊报酬论、约定损害赔偿论等学说，其中比较有代表性的是租金论和违约金论。
租金论认为，托运人与承运人签订的运输合同中的相关条款及集装箱使用合同应当被视为集装箱租赁合同，集装箱承租人即托运人租赁集装箱应当支付租金，当其超过规定期限还箱时，集装箱出租人即承运人有权依据集装箱租赁合同的约定向集装箱承租人请求支付租金即滞箱费。

demurrage 疏港是船到7天,如果7天内还没提箱就要从港区疏到指定的堆场. detention 超期费又称滞箱费.如果集装箱没在规定的时间内还给箱管部门,箱子使用时间超过了船公司所规定的免费使用时间，就会按天数收取相应的超期费.也是从到港之日算起.普箱:1-10天免费高箱1-7天免费箱种不同免费天数不同.上海疏港费的计算方法：疏港费是由港区收取。
到港之日7天内不会产生，第8天开始疏港，基本疏港费：20' RMB300-40040' RMB600-700滞箱费是由船公司收取，收费标准具体如下：1~10天免费11~20天USD5.00/20'/DAY; USD10.00/40'/DAY21~40天USD10.00/20'/DAY; USD20.00/40'/DAYOver40天USD20.00/20'/DAY; USD40.00/40'/DAY这是DRY的收费，不同类型的货柜，收费不一；当然，产生巨额的滞箱费可以和船公司商谈，要求象征性地打一下折扣。
疏港费也叫转场费，为集装箱到港7日后产生；超期费通常为11天开始计费，USD 5.00/20'/天，USD 10.00/40'/天。
特殊箱型7天免费用箱，各家船公司的标准有时候不一样，以船公司标准为准；14天产生的是海关滞报金，货物进境第14天仍未向海关申报，从第15天开始，每天征收货物到岸价格的万分之五；海运、空运、陆运进口货物自运输工具申报进境之日起15日开始；邮运进口货物自收件人收到邮局通知之日起第15日开始；转关运输货物自运输工具申报进境之日起15日开始以及货物运抵指运地之日起15日开始。

初次接触海运运价的货主往往被弄得一头雾水。
有些业务员对这些字母所具体表达的内容解释不清，只知道这是附加费用，是船公司要收的，但却弄不清为什么要收，这常常造成货主与货代之间的误会。
所谓附加费，就是基本运费以外的，由于在特殊情况下或者临时发生某些事件的情况下而加收的费用。
现在船公司常收的附加费有:1.ORC(original receiving charge)“原产地接货费”。
这是最早并专在广东地区征收的附加费用，与目前中国各港口所收的THC内容一样。
而所谓THC（terminal handling charge）就是“码头操作费”，也叫“码头处理费”。
这是国际班轮公会和航线组织联合从2002年1月起向中国货主征收的附加费用。
对此费用，货主与船公司之间存在较大的争议。
货主认为按班轮条款，码头操作费应该已包含在运费里了，因此加收THC 属于不合理收费，但船公司却称收取此项费用是降低成本的机制，用作抵消向码头经营商支付的装卸作业费用。
这一争议至今未见解决，因而费用仍在照常收取。
2.BAF(bunker adjustment factor)或BS (bunker surcharge)，也被称为FAF(fuel adjustment factor) “燃油附加费”。
这是由于燃油价格上涨，使船舶的燃油费用支出超过原核定的运输成本中的燃油费用，船公司在不调整原定运价的前提下，为补偿燃油费用的增加而加收的附加费。
在已经征收燃油附加费的情况下，如果燃油价格又突然上涨，船公司可能不调整原燃油附加费而在正常收取燃油附加费以外还增收应急燃油附加费EBS (emergency adjustment surcharge)。

海运费用大全散货/拼箱=海运费+报关+文件柜子=海运费+报关+文件+码头费/ORC/THC+拖车一，当货主向货代公司咨询海运运价时，货代公司的业务员除了报基本运价外还会告诉你，要加O、加B、加C、加D，或者还要加T、加A、加D等。
初次接触海运运价的货主往往被弄得一头雾水。
有些业务员对这些字母所具体表达的内容解释不清，只知道这是附加费用，是船公司要收的，但却弄不清为什么要收，这常常造成货主与货代之间的误会。
所谓附加费，就是基本运费以外的，由于在特殊情况下或者临时发生某些事件的情况下而加收的费用。
现在船公司常收的附加费有:1.ORC(original receiving charge)“原产地接货费”。
这是最早并专在广东地区征收的附加费用，与目前中国各港口所收的THC内容一样。
而所谓THC〔terminal handling charge〕就是“码头操作费”，也叫“码头处理费”。
这是国际班轮公会和航线组织联合从2002年1月起向中国货主征收的附加费用。
对此费用，货主与船公司之间存在较大的争议。
货主认为按班轮条款，码头操作费应该已包含在运费里了，因此加收THC 属于不合理收费，但船公司却称收取此项费用是降低成本的机制，用作抵消向码头经营商支付的装卸作业费用。
这一争议至今未见解决，因而费用仍在照常收取。
2.BAF(bunker adjustment factor)或BS (bunker surcharge)，也被称为FAF(fuel adjustment factor) “燃油附加费”。
这是由于燃油价格上涨，使船舶的燃油费用支出超过原核定的运输成本中的燃油费用，船公司在不调整原定运价的前提下，为补偿燃油费用的增加而加收的附加费。
在已经征收燃油附加费的情况下，如果燃油价格又突然上涨，船公司可能不调整原燃油附加费而在正常收取燃油附加费以外还增收应急燃油附加费EBS (emergency adjustment surcharge)。

1、订舱服务费
1.1 订舱服务费包括码头出口安全费（PSE）；
1.2 自2013年6月1日起，MSL、SAF的订舱服务费除了码头出口安全费（PSE）外，还包括了“集装箱设备管理服务费”；
1.3 特种箱：指除普通箱之外的特种集装箱，包括但不限于冷冻箱、框架箱、开顶箱、平板箱、挂衣箱等；
1.4 既是危险品又是特种箱的：订舱服务费及预、到付操作费的收取需要单票向在线客服确认，不适用于上表中的费率标准；
1.5 45尺、53尺箱的订舱服务费请向在线客服确认；
2、预、到付退佣及操作费：
2.2 客户与船公司有特殊退佣约定的不在此列，需订舱前以邮件方式通知对口客户经理；
2.3 在预付净海运费趋零时，我司保留收取操作费权利，标准依照上述船公司及航线的到付操作费执行；
2.4 运费条款是第三地付费的，操作费按照到付操作费标准收取；
3、其它费用：原则上除以上订舱服务费、退佣、操作费，其它费用我司代收代付。
