不动产所有权善意取得案例分析
中文摘要
善意取得作为一项重要的民事法律制度,系源于日耳曼法“以手护手”原则, 并导入罗马法取得时效制度中的善意要件后,演绎发展而成的。善意取得制度是 国家立法基于保护交易安全,对原权利人和受让人之间的权利所作的一种强制性 的物权配置,虽然限制和阻却了所有权的追及力,在一定程度上牺牲了原所有人 的利益,但是它在保护权利外观的公示公信力,促进交易的安全和稳定等方面发 挥了无可替代的重要作用。基于此,在近现代民法上,这一制度得到了大陆法系 各个国家和地区在立法上的普遍确认。在传统的善意取得理论中,善意取得仅限 于动产取得,而以登记为公示手段的不动产的取得,则不适用该制度。我国当前 正处于社会和经济转型期,未建立起一套统一发达的不动产登记制度体系,在房 屋买卖中,一房二卖甚至数卖现象普遍存在,导致大量购房人的合法权益得不到 及时有效保障。我国《物权法》正式在立法上确立了善意取得制度并开创性地将 客体从动产所有权扩展到不动产所有权和其他物权。这样可最大限度的保护第三 人的利益,从而为中国特色社会主义市场经济安全有序发展保驾护航。 不动产的善意取得主要发生于以下两种情况:一是共有房屋的部分共有人擅 自出卖共有房屋的,受让人若为善意,即可取得所有权。二是不动产登记存在瑕 疵,即不动产登记事项所记载的权利内容与事实不符。 本文拟就司法实务中常见的不动产部分共有人擅自转让该不动产给善意第 三人这样一个案例作为样本和实例,首先从案情简介及争议焦点入手,其次对案 例中争议焦点进行了分析论证,进而对不动产所有权善意取得这一重要民事制度 的历史渊源及法律性质、不动产所有权能否善意取得、我国不动产所有权善意取 得制度适用范围、公示公信原则与不动产所有权善意取得制度的关系在理论层面 进行分析,同时就不动产所有权善意取得中善意的主体和对价的确定、交易价款 支付情况、无偿或者不合理的有偿行为能否构成不动产所有权善意取得、不动产 所有权未登记情况下的善意取得、转让合同的效力与不动产所有权善意取得的关 系以及不动产登记簿与权属证书的关系等实践中常见的困扰司法的棘手问题进 行研讨,最后提出了如何将静态安全与动态安全之间牺牲和摩擦降至最低限度的
