3.4 如甲方发现乙方提供的人才资料与其他招聘渠道所提供给甲方的资料重合,甲方应在收到乙方资料后2个工作日内,且甲方从乙方处获得候选人姓名、联系信息之前,或要求乙方安排候选人面试之前,以书面形式提出申明,否则视为乙方推荐。
(a) 甲方委托的是职能性质的职位(如生产、技术、人力、行政、财务等),年薪=受聘人转正后税前月薪(含绩效奖金、津贴等)*13个月;
(b) 甲方委托的是业务性质或以业绩提成作为薪资支付方式的职位(如销售、业务、经营等),年薪=受聘人转正后税前月薪(含绩效奖金、津贴等)*14个月。
2.3 付费方式:
1)所推荐人才到岗后七日内,甲方支付服务费的50%,待推荐人员入职满三个月后七日内支付剩下的50%。
五、乙方的权利义务
5.1 乙方应充分了解甲方的历史背景、发展历程、企业文化、核心产品或服务、经营理念、发展前景和战略等相关信息,以更好地理解甲方的核心需求。
5.2 对于乙方推荐的人选,甲方面试后因某种原因暂不能长期聘用该人选,而委托人选做兼职或代理或其他形式的服务或合作,应同样视为已完成推荐该人选的工作并向乙方支付全额服务费。
四、甲方的权利义务
4.1 甲方承诺是依法成立的组织,符合并具备法律规定的面向社会公开招聘的各项条件和手续,并且向乙方提交的委托职位信息。
4.2 甲方委托职位方式包括但不限于快递、传真、EMAIL、QQ、电话、短信、微信、口头等通知方式。
4.3甲方需通过乙方与候选人沟通、联系,不得以任何理由擅自与候选人联系;如因特殊情况需要直接与候选人联系的,应先征得乙方同意。

Party A has the right to require Party B to provide candidates for the opened position/s as defined and specified by Party A, and Party A shall make payment of a service fee to Party B as defined and regulated in this Agreement.3.每一职位正式委托(书面)后的5个工作日内,甲方应向乙方提供寻访职员所需的相关信息及材料,并保证其真实性和合法有效性,包括但不限于:职位要求、工作描述、公司简介、组织机构图、可能的薪金福利情况等,以便乙方在访寻过程中确认潜在的候选人,并使候选人对公司和工作进行充分和必要的了解。
Within 5 working days of entrusting placement job in writing, Party A should provide Party B with all the information, data and documents as deemed necessary for Party B to start working on the placement job, which include but not limited to the following: Profiles of the organization, Organization chart as related to the placement job, Job description/s, Qualifications or jobrequirements for a successful candidate, Information with regards to compensation, reward, related to the placement. Of course, Party A should guarantee the validity and reliability.4.甲方对乙方提供的人才信息负责,不转递其他公司,不做转换推荐。
甲方同意在被推荐人选正式录用前,为其保密。
Party A agrees to take all the responsibilities in the use of the information of candidates, and should not give them to other companies, or recommend for change. Party A shall maintain the confidentiality of the candidate before the formal employment.5.甲方同意在录用推荐人选时,将推荐人选的聘书复印件或劳动合同提供给乙方,乙方应为其进行严格保密。
Party A agrees to provide the copy of candidate’s offer or labor contract for Party B, and PartyB should maintain its confidentiality.6.甲方同意乙方推荐的人才当时没有录用,在被推荐后壹年之内该人选再被录用、应视为由该乙方推荐成功。
Shall the candidate recommended by Party B to Party A not be employed then; if, at any time within 12 months, the candidate is employed again by Party A; it will be deemed as a successful recommendation of Party B.7.甲方发现乙方提供的人才资料有与其他渠道此前所提供的资料重合时,应在收到乙方资料叁个工作日内提出声明,否则应被视为获得认可。
Shall Party A find the candidate’s information offer by Party B is same as the former other one, Party A should declare within 3 workdays on the receiving of the information from Party B, Otherwise shall be treated as admissive.二、乙方的权利与义务Party B’s Rights and Responsibilities1、乙方应严格执行国家规定的有关人事及招聘政策、法律法规。
Party B must observe China’s relevant personnel policy, regulation and law.2、乙方应按照本协议的规定为甲方提供所需职位的候选人,并有权按照本协议的规定向甲方收取服务费。
Party B is obliged to provide candidates for an opened position, as defined and regulated in this Agreement. And Party B has the right to collect a service fee for a placement jobcompleted.3、乙方应随时将访寻工作情况向甲方汇报和沟通,以确保甲方了解访寻进程。
Party B is obliged to provide to Party A frequent and timely updates about the placementsearch so that Party A is aware of the progress of the placement job.4、应甲方要求,乙方应及时提供候选人的详细的背景资料和其他相关信息。
At the request of Party A, Party B shall provide detailed and timely information and other related information about the background of the candidates.5、乙方应将甲方提供的应聘要求,如实转告候选人,保证其了解工作要求、环境和地点。
Party B shall truthfully inform the candidates of the requirements and qualifications for a placement job, making sure the candidates are aware of the requirements, locations andenvironments of a placement.6、乙方应对其所推荐的候选人进行必要的调查,以保证所推荐的人选不存在违法、犯罪行为。
Party B shall carry out necessary reference checks on the candidate/s making sure that the candidate/s is/are free from criminal or legal charges, and/or other interpersonal relationship or teamwork problems.7、乙方对甲方提供的信息负有保密义务。
非经甲方同意不得用于履行本协议之外的目的,否则应向甲方支付违约金,给甲方造成损失的,还应承担损害赔偿责任。
Party B is obliged to keep confidentiality of all the information and documents provided by Party A and/or acquired by Party B from Party A in the process of cooperating on a placement job; and under no circumstances shall Party B use the document or information for purposes other than the placement entrustment; or Party B shall compensate Party B for breach ofcontract and take responsibility for the costs and damages caused, if any.8、乙方不应将甲方已经书面确认聘用的推荐人才再推荐或转交给第三方。
Party B shall not provide the candidates to any third party if the candidate has been confirmed by Party A for employment.三、服务的完成及费用支付Execution of a Placement Job and Payment ofService Fee1、乙方应自收到甲方提供的访寻人才所需全部信息及材料之日起的15个工作日内完成为甲方提供所需职位候选人名单及背景信息的工作,具体的要求为:每个职位至少提供三名合格候选人名单和背景信息;如甲方在此期间需要进一步增加候选人的数量,经协商,乙方可增加为甲方提供的候选人的数量,直至甲方满意为止。
