这意味着从法规开始生效之日起即2015年元月左右,向欧盟出口农食产品的企业将会面临检验成本的上升、农残壁垒提高等诸多考验。

本文从农食产品领域公认的国际标准、其他国家标准,以及我国农药残留的国家标准等角度,比对分析欧洲标准提出的6种农药残留限值是一个什么标准水平,并且进一步探讨我国面临农食产品出口壁垒的应对策略。

最新农残法规标准“来势凶猛”2014年7月下旬,欧盟委员会健康与消费者总司公布了最新的农残法规修订结果,修改了第(EC)No396/2005号法规中有关二氯丙烯、甲羧除草醚、精二甲吩草胺、调环酸、甲苯氟磺胺及氟乐灵等6种农药的最大残留限量(MRL),具体标准限值如下:目前法规修订案已经在欧盟理事会的例行会议中获得通过。

按照正常程序,法规历经公布和评议后,将从2015年1月1日起正式实施。

从我国农食产业发展的基本国情来看,一旦农残壁垒措施发挥效力,出口欧盟的农食产品企业势将面临严峻考验。

欧盟此次对(EC)No396/2005号法规的修订并非农食产品农药残留的首次修订,但是涉及到的产品范围非常广泛。

从海关HS编码分类来看,此次修订影响到的农食产品大类有粮谷、动物源性食品、以及包括植物和蔬菜在内的植物源性食品,在这些大类目下又涵盖了近百种我国大面积种植的农食产品。

我国受欧盟新“农残”标准规制程度大我国“农残”标准和欧盟新标准之间存差距。

01/2019:208132.8.13. 农药残留定义:本药典规定:农药是在草药生产、加工、储藏、运输或销售的过程中用来阻止、杀灭或控制任何害虫、不良植物或动物品种的物质或物质混合物。

若不控制这些害虫、不良植物或动物品种,就会干扰草药生产、加工、储藏、运输或销售顺利进行。

农药品种包括用作生长调节剂、脱叶剂或干燥剂和任何在农作物收割前后农作物所适用的物质,以便防止商品在储藏和运输期间变质。

农药残留会出现在草药原料和草药制剂中,残留量需加以控制。

限度: 除非本各论另有明确指示,供试草药至少应符合表2.8.13.-1中所指明的限度。

未列入本表的农药适用限度和它们因任何原因而受到人们怀疑的含量,则符合按欧盟(EC )396/2005号指导(包括它们的附录和以后更新文件)设立的限度。

欧盟委员会《动植物产品农药残留最高限量》欧盟委员会2002/66/EC号指令2002年7月16日修订76/395/EEC,86/362/EEC,86/363/EEC和90/642/EEC委员会指令附录中关于水果、蔬菜、谷物、动物源食品及部分植物源食品包括水果、蔬菜及其表皮中的农药最大残留限量欧盟委员会,考虑到欧盟确立的条约;考虑到1976年11月23日发布的关于更改水果、蔬菜及其表皮中最大农药残留限量的76/895/EEC号委员会指令已被2000/82/EC号委员会指令重新修订,特别是其中的第5条;考虑到1986年7月24日发布的关于更改谷物及其表皮中最大农药残留限量的86/362/EEC号委员会指令已被2002/42/EC号委员会指令重新修订,特别是其中的第10条;考虑到1986年7月24日发布的关于更改动物源食品或其表面中最大农药残留限量的86/363/EEC号委员会指令已被2002/42/EC号委员会指令重新修订,特别是其中的第10条;考虑到1990年11月27日发布的关于更改植物源类食品,包括水果、蔬菜及其表皮中最大农药残留限量的90/642/EEC号委员会指令已被2002/42/EC号委员会指令重新修订,特别是其中的第7条;因而(1)对于谷物和包括水果、蔬菜的植物源产品,残留限量应该反映农药可获得对植物的有效保护的最小使用量,应基于这样一个观点:残留限量既要尽可能的低又要使农药的毒力可以接受,特别考虑要保护环境,根据每日最大允许摄人量保护消费者的身体健康。

对于动物源食品,残留限量应反映动物消耗的被农药处理的谷物和植物源食品的用量,或直接使用的兽药的用量。

欧盟制定的最大残留限量(MRLs)反映的是在被生产者认为是经过优良的农业措施生产出的产品中可检出的最高农药残留量。

(2)制定农药的最大残留限量(MRLs)应参考过去制定的标准,同时也要根据最新的信息和数据加以调整。

在没有被授权使用的领域,残留限量应符合分析的最低检出限。
