摘要

自2003年国家进行社区矫正试点工作以来，社区矫正工作取得了长足的发展和进步。2011年和2012年，《刑法修正案（八）》和新《刑事诉讼法》相继通过，社区矫正制度在法律层面上得到确立。2014年，国家提出要制定专门的“社区矫正法”。这些表现了国家对这项工作的高度重视，也反映了社会公众对社区矫正工作的期盼。然而，来自民间的社会力量至今难以在社区矫正工作中引起重视并发挥作用，这违背了社区矫正工作的本质，也无法准确实现社区矫正的目的。

本文从社区矫正基本概念出发，阐明了社区、社区矫正、社会力量等基本要素的准确定义，分析了社会力量参与社区矫正工作的理论基础：三重失灵理论和治理理论。阐述了社区矫正的意义，社会力量参与社区矫正的价值，社区矫正的社会力量参与主体以及参与形式。

文章以T市为实证研究对象，分析一个普通城市在社会力量参与社区矫正方面存在的问题是参与社区矫正程度不深、解决实际问题的有限性、社会力量参与不足。并在此基础上，分析制约社会力量参与社区矫正工作的因素包括政府的原因、社会力量自身和保障制度三个方面。通过运用比较研究法研究其他国家社会力量参与社区矫正的成功做法，结合我国实际情况，提出完善社会力量参与的对策是要转变政府观念、增强公众参与意识、加强社会力量队伍建设以及完善制度保障。

ABSTRACT

Since our country has carried out the pilot program of Community Correction in 2003, it has made a further development. Along with the 8th amendment of the Criminal Law and the new Criminal Procedure Law had been passed in 2011 and 2012 one after another, Community Correction has been established at the legal level. Then in 2014, our country put forward to made a special "Community Correction Law" explicitly. All of this showed the state’s great attention and the people’s

anticipation to the Community Correction. But now as the major participants of Community Correction, the nongovernmental Social forces has not been appreciated or been used adequately. This situation not only against the original purpose of the work, but also can’t achieve the initial goals.

This article takes the introduction of basic concept as a start, interpreting the connotation of “Community”、“Community Correction” and “Social Forces”. And then, analyzed the theoretical basis of social forces to participate in Community Correction: Tripartite Failure Theory and Governance Theory. It also Elaborates the importance of Community Correction. The valuation of social forces to participate in Community Correction. The major participants and the form of participation of Social forces to participate in Community Correction.

It takes T city as the object of empirical study, analyzes major practices. Then find the less involvement of Community Correction. The limitations to solve the practical problems and the insufficient participation of Social Forces are the problems in social forces to participate in Community Correction of a common city. Through the research, It analyzes the main factors are government. Social Forces and institutional security which restrict social forces to participate in Community Correction. It observes the other countries’ successful experience of social forces to participate in Community Correction by comparative perspective. To Connecting with the practical situation of our country. Finally it makes suggestions on how to improve social forces to participate in Community Correction. The best ways are enhance people’s consciousness of participation. Change the concept of government. Strengthen the team building of social forces and improve the institutional security.
