The Part which should be paid byParty B should be withheld from salary by Party A.Party A should fill in Employee Endowment Insurance Handbook for Party B.After the termination of the contract, Employee Endowment InsuranceHandbook should be handed over according to relevant regulations.第101条乙方单位患病或非因工负伤,其工资按照国家已经制定相关规定执行.If Party B gets ill or gets hurt not because of work, then his/her salary should becalculated according to relevant national regulations.第102条乙方单位患职业病或因工负伤的工资和医疗保险待遇按照国家和山东省有关规定执行.If Party B gets occupational disease or gets hurt because of work, his salary andmedical insurance should be calculated as relevant national and provinceregulations.6、劳动纪律Work Disciplines第103条乙方单位应遵守甲方单位依法制定的规章规章,严格遵守劳动安全卫生、生产工艺、操作规程和工作规范,以及《劳动协议合同附件及职工保密协议合同书》,爱护甲方单位的财产,遵守职业道德;积极参加甲方单位组织的培训,提高思想觉悟和职业技能.Party B should follow Party A’s discipline s and rules, following close to the line ofoperation safety requirements, process, operation rules and regulations,Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party Bshould protect company’s property, follow professional morality; Party B shouldbe active to attend the training organized by Party A to increase professionalskills.第104条乙方单位违反劳动纪律,甲方单位可依据本单位规章规章,给予纪律处分,直至解除本协议合同.If Party B violates disciplines or regulations, Party A could give the penaltyaccording to the company’s regulation or rules, or even to end the contract.7、劳动协议合同的变更、解除、终止、续订Change, terminate, end or renew the contract第105条订立本协议合同所依据的法律、行政法规、规章发生修改变更,本协议合同应变更相关有关内容.If the relevant laws, regulations or rules have changed, this contract will bechanged accordingly as well.第106条订立本协议合同所依据的客观情况发生重大修改变更,致使本协议合同无法履行的,经合约双方协商同意,可以变更本协议合同相关有关内容.If the objective circumstance has changed a lot, which makes it not possibleto continue this contract; after agreement of the two parties, the contractcould be modified accordingly.第107条乙方单位有下列情形之1的,甲方单位可以解除本协议合同:Party A could end the contract with Party B, If Party B:1、在试用期间,被证明不符合录用条件的;It is proved during the probation period that Party B is not qualified forthe work and employment;2、严重违反劳动纪律或甲方单位规章规章的;Materially violate Party A’s rules and regulations;下列行为属于严重违反甲方单位劳动纪律或规章规章的行为:Those following actions belong to materially Violation:(1)在工作期间饮酒的;Drinking during the work time;(2)连续旷工超过15天或1年内累计旷工超过30天的;Absent from work continue for 15 days or more than 30 days totalfor one year.(3)乙方单位是驾驶员的,因其自身原因,其营运服务的证、照被吊扣或失效15天(含)以上的或发生行车事故次要责任(含)以上的;If Party B is driver, because of his mistake, the car or car license iscaught by police or go out of valid period for more than 15 days(including), or in accident Party B take more than subordinateresponsibility (including).(4)在工作场所打架斗殴、妨碍干扰正常工作秩序及违犯社会治安管控条例的;Fight on working place, disturb normal working system, and violatesociety safety management regulation.(5)乙方单位以欺诈、胁迫的手段,使甲方单位在违背真实意思的情况下订立或者变更协议合同的;Party B sign or change the contract with party A without the willing theParty A by cheating or threating.(6)在劳动关系存续期间,与其他用人单位(或个人)建立劳动关系或发生劳务关系的;During the contract Period, Party B does work for any other thirdemployment Party.(7)在工作期间搞其他产业或第2职业的,在工作时间内做与工作无关的事情;During work time, Party B does other work or secondary job, or anyother work which is not related to his duty.(8)乙方单位在招聘录用时所填个人履历和档案等有关有关内容不真实,提供虚假信息的.包括但不限于:离职证明、身份证明、户籍证明、学历证明、体检证明等是虚假或伪造的;应聘前患有精神病、传染性疾病及其他严重影响工作的疾病而在应聘时未声明Party B gives the false information when filling in the CompanyEntrance Form, including but not limited to, Dimission Prove, ID prove,Residence Prove, Education Prove, Physical Checking Prove; haveserious mental disorder, infected illness or other illness which affectshis work.3、严重失职、营私舞弊,对甲方单位利益造成重大损害的((包括但不限于因个人故意或过失,1次给甲方单位造成3000元以上损失或连续12个月内累计造成5000元损失的);Commits serious dereliction of duty or practices graft, causingsubstantial damage to the Party A (including but not limited to the lossof 3000Yuan by one time or total 5000Yuan within continue 12months caused by Party B’s deliberately or fault) ;4、被依法追究刑事责任的.Has his criminal liability pursued in accordance with the law.第108条下列情形之1,甲方单位可以解除本协议合同,但应提前310日以书面形式通知乙方单位:If one of the following situations applies, Party A could terminate the contract,but has to inform Party B 30 days in advance by written:1、乙方单位患病或非因工负伤,医疗期满后,不能从事原工作也不能从事由甲方单位另行安排的工作的;After the recovering period of medical care for an illness ornon-work-related injury, Party B can engage neither in his original worknor in other work arranged for him by Party A.2、乙方单位不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;Party B is incompetent and remains incompetent after training oradjustment of his position.3、双方不能依据本协议合同第107条规定就变更协议合同达成协议合同的.Two parties can not reach the agreement to modify the contract ascontract Item 17.第109条甲方单位濒临破产进行法定整顿期间或者生产经营发生严重困难,经向工会或者全体职工说明情况,听取工作或者职工的意见,并向劳动行政机构部门报告后,可以解除本协议合同.During restructuring period pursuant to the Enterprise Bankruptcy Law orSerious difficulties in production and/or business operations, after Party Ahas explained the situations to its Labor Union or to all of his employees,and has considered the opinions of the Labor Union or the employees andhas subsequently reported to the labor administration department, Party Amay terminate the contract.第210条乙方单位有下列情形之1的,甲方单位不得依据本协议合同第108条、第109条终止、解除协议合同:Party A may not terminate an employment contract pursuant to Article18 or Article 19 hereof if Party B:1、患病或非因工负伤、在规定的医疗期内的;Has contracted an illness or sustained a non-work-related injury, and therecovering period of medical care therefore has not expired;2、女职工在孕期、产期、哺乳期内的;Is a female employee in her pregnancy, maternity or breast feeding period3、在本单位连续工作满105年,且距法定退休年龄不足5年的;Has been working for the Employer continuously for not less than 15years and is less than 5 years to his legal retirement age4、法律法规规定的其他情形.Other situations pursuant to Laws or regulations.第2101条乙方单位患职业病或因工负伤,医疗终结,经市、区、县劳动鉴定委员会确认完全或部分丧失能力的,按劳动协议合同法有关规定办理,不得依据本协议合同第108条、第109条解除劳动协议合同.Party B Has been confirmed as having complete lost or partially lost hisability to work due to an occupational disease contracted or a work-relatedinjury sustained with the Employer, after diagnosed by City, Zone, CountyLabor authentication Committee ,Party A should not terminate the contractas Article18,19, but should follow relevant regulations.第2102条乙方单位解除本协议合同,应当提前310日以书面形式通知甲方单位.If Party B wants to terminate the contract, he/she should inform Party A bywritten 30 days in advance.第2103条有下列情形之1的,乙方单位可以随时通知甲方单位解除本协议合同:Party B may terminate the contract in any time under the one of the followingsituations:1、在试用期内的;During the probation period2、甲方单位以暴力、威胁或者非法限制人身自由的手段强迫劳动的;Party A forces or threats Party B to work or illegally restrict freedom ofParty B.3、甲方单位不能按照本协议合同规定支付劳动报酬或者提供劳动条件的.Party A can not pay or provide work conditions as Contract.第2104条本协议合同期限届满,合约双方经协商同意,可以续订劳动协议合同.After the termination of the contract, Party A and Party B could renew thecontract after discussion and agreement.第2105条订立无固定期限劳动协议合同的,乙方单位离休、退休、退职及死亡或本协议合同约定的解除条件出现,本协议合同终止.If the contract is open-ended contract, when Party B has leaved, retired,died or other factors which would end the contract as we mentioned in thecontract, this contract can terminate.第2106条乙方单位承诺已知悉了甲方单位的各项规章规章,并保证在任职期间认真学习甲方单位制定的各项规章规章.Party B should promise that he has know all the rules and regulations ofParty A and promise to learn all the rules and regulations during workperiod.8、劳动争议处理Disputation settlement第2107条因履行本协议合同发生的劳动争议,当事人可以向本单位劳动争议调解委员会申请调解;调解不成,当事人1方相关要求仲裁的,应当自劳动争议发生之后向劳动争议仲裁委员会申请仲裁.当事人1方也可以直接向劳动争议仲裁委员会申请仲裁.对裁决不服的,可以向人民法院提起诉讼.If there is any labor disputation during the performance of the contract, theparty could apply for the settlement to company intermediation department.If it still can not been settled and one party wants arbitration, then he shouldapply for arbitration to Labor Arbitration Committee after the disputation.The party also could ask for the arbitration directly. 乙方在劳动合同履行期间依法享受法定节假日以及探亲假、婚丧假、产假、带薪年假等休假权利。

甲方安排乙方每日工作时间不超过8小时,每周工作5天,平均每周不超过40小时。

甲方保证乙方每周休息二天。

因特殊原因需要延长工作时间的,在保障乙方身体健康的条件下,甲乙双方友好协商执行,原则上每月不超过24小时。
