县以上建设行政主管部门主管建设工程招标投标工作第一章总如此第一条为加强建设工程招标投标管理,标准建筑市场交易行为,提高建设工程质量和投资效益,保护招标投标者的合法权益,根据有关法律、法规,结合我省实际,制定本条例。

第二条凡在本省行政区域内非生产性工程总投资在二百万元以上、生产性工程总投资在五百万元以上的国家投资、集体投资或者国家、集体参与投资并控股的建设工程,包括新建、扩建、改建工程,必须实行招标投标。

法律、法规另有规定的除外。

非生产性工程总投资缺乏二百万元、生产性工程总投资缺乏五百万元的建设工程是否实行招标投标,由县以上人民政府决定。

境外投资者独资或者外方控股的中外合资、中外合作工程以及国内个人投资并控股的建设工程实行招标投标的,依照本条例执行。

县以上人民政府确认的保密或者救灾的抢险建设工程,可以不实行招标投标。

第三条建设工程工程的施工和总承包的招标投标适用本条例。

建设工程工程的勘察、设计、设备供给(除国家规定的特定进口产品外)、建设监理的招标投标,参照本条例执行。

建设工程工程在可行性研究报告批准前的阶段不适用本条例。

第四条建设工程招标投标活动应当遵循公开、公正、公平竞争和综合评议、择优定标的原如此,保证招标投标的平等性、评标的公正性和定标的合理性。

任何单位和个人不得以任何理由,将必须实行招标投标的工程指定发包;也不得以任何理由垄断或者强行承接工程。

第五条县以上建设行政主管部门主管建设工程招标投标工作。

方案、经贸、财政、物价、银行、土地、工商行政管理等部门按照各自职责参与管理建设工程招标投标工作。

第六条县以上建设行政主管部门设立的招标投标管理机构,负责建设工程招标投标日常管理工作,为招标投标单位提供业务指导和效劳。

其主要职责是:(一)贯彻实施国家和省有关建设工程招标投标的法律、法规和政策;(二)审查招标文件、招标条件和招标单位资格;(三)组织审定标底;(四)监视指导评标定标工作;(五)监视承发包合同的签订和履行;(六)调解招标投标活动中的纠纷;(七)查处违反招标投标规定的行为。

凡具备条件的建设单位和相应资质的施工企业均可参加施工招标投标。

第二章机构与职责第五条建设部负责全国工程建设施工招标投标的管理工作,其主要职责是:(一)贯彻执行国家有关工程建设招标投标的法律、法规和方针、政策,制定施工招标投标的规定和办法;ﻫ(二)指导、检查各地区、各部门招标投标工作;(三)总结、交流招标投标工作的经验,提供服务;(四)维护国家利益,监督重大工程的招标投标活动;(五)审批跨省的施工招标投标代理机构。

第六条省、自治区、直辖市人民政府建设行政主管部门,负责管理本行政区域内的施工招标投标工作,其主要职责是:(一)贯彻执行国家有关工程建设招标投标的法规和方针、政策,制定施工招标投标实施办法;ﻫ(二)监督、检查有关施工招标投标活动,总结、交流工作经验;ﻫ(三)审批咨询、监理等单位代理施工招标投标业务的资格;ﻫ(四)调解施工招标投标纠纷;(五)否决违反招标投标规定的定标结果.第七条省、自治区、直辖市建设行政主管部门可以根据需要,报请同级人民政府批准,确定各级施工招标投标办事机构的设置及其经费来源。

浅谈招标文件与投标文件的效力次序

浅谈招标文件与投标文件的效力次序一、问题提出(一)规范的内容与理由《建设工程工程量清单计价规范》(GB 50500-2013)(以下简称《规范》)第7.1.1条第二款(以下简称7.1.1条款)规定:合同约定不得违背招标投标文件中关于工期、造价、质量等方面的实质性内容。

招标文件与中标人投标文件不一致的地方,应以投标文件为准。

按照一般的招标程序,招投标工作结束后,也就是中标人确定后,双方要在规定的时间内签订书面合同。

如果在签订合同时,招标方突然发现中标文件在关于工期、造价、质量等实质性方面的条款与招标文件有所不同,在这样的情况下,应该以哪个条款作为签订合同的根据呢?此条规范对此予以明确,应该以中标文件而不是以招标文件所记载条款作为合同的内容。

有关专家对如此规定的原因作了如下解释:首先,由于评标时间过短,往往会出现投标文件与招标文件所列出的实质内容未完全响应,但未在评标中发现的情况,以此引发的一系列争议和纠纷屡见不鲜。

做出这样的规定的目的在于强化业主对于评标环节的管理。

《规范》编写者也认为,出现投标文件与招标文件不一致而又中标的现象,关键在于评标过程中对于没有实质响应招标文件的投标予以否决,或者对于一些需要投标人澄清的问题未采取措施请其澄清。

因此,带来的后果应该由招标人承担,这会督促招标人高度重视评标工作,以避免评标工作的失误给自身带来不利的法律责任或后果。

其次,《规范》编写者还认为,根据《合同法》的规定,招标公告为要约邀请,投标才是要约行为(第16条),中标通知书为承诺(第22条),且承诺的内容应当与要约的内容一致(第30条)。

所以,在签订合同时,当招标文件与中标人的投标文件不一致时,应以投标文件为准。

简言之,《规范》制定者认为,评标者因评标失误带来的不利的法律后果,应该由招标者承担。

这样规定的目的在于防止招标方滥用优势地位,以避免让中标方承担评标失误带来的不利的法律后果,而且,这样的规定于法有据。

有下列情形之一者,應認為投標無效。

但第六款、第一四款、第二0款至第二二款情形,經執行法官在該件拍賣標的當眾開示朗讀投標書前補正者,不在此限:
一、投標時間截止後之投標。

二、開標前業已公告停止拍賣程序或由主持開標之法官宣告停止拍賣程序。

三、投標書未投入法院指定之標匭。

四、除執行分割共有物變賣判決之拍賣外,投標人為該拍賣標的之所有人。

五、投標人為未繳足價金而再拍賣之前拍定人或承受人。

六、不動產拍賣公告載明投標人應提出地方法院民事執行處不動產投標參考要點
第二、三、四點所示證明(釋明)文件及委任狀,而投標人未提出。

七、投標人為未成年人,未由其法定代理人代理投標。

八、代理人無地方法院民事執行處不動產投標參考要點第四點所示之特別代理
權。

九、以新台幣以外之貨幣為單位記載願出之價額,或以實物代替願出之價額。

一0、對願出之價額未記明一定之金額,僅表明就他人願出之價額為增減之數額。

一一、投標書記載之字跡潦草或模糊,致無法辨識。

一二、投標書既未簽名亦未蓋章。

一三、投標人提出之保證金票據,其發票人為非經金融主管機關核准之金融業者。

一四、投標人提出之保證金票據已記載法院以外之受款人,該受款人未依票據法規定連續背書。

一五、投標人提出之保證金票據為禁止背書轉讓之票據,其受款人為法院以外之人。

一六、未將保證金封存袋附於投標書。

一七、分別標價合併拍賣時,投標書載明僅願買其中部分之不動產及價額。

一八、投標書載明得標之不動產指定登記予投標人以外之人。

一九、投標書附加投標之條件。

二0、拍賣標的為耕地時,私法人投標而未將主管機關許可之證明文件附於投標書。

二一、投標人為外國人,未將不動產所在地縣市政府核准得購買該不動產之證明文件附於投標書。

二二、拍賣標的為原住民保留地,投標人未將原住民之證明文件附於投標書。

二三、其他符合拍賣公告特別記載投標無效之情形。
