新婚姻制度的缺陷和完善

摘要

1950年婚姻法和1980年婚姻法的颁行，是新中国婚姻法学前进道路上的重要的里程碑。坚持理论与实践结合的原则，为进一步完善婚姻家庭法制而努力，是中国法学会婚姻法学研究会近年来进行的全部研究工作中的重中之重。这些研究既有宏观的，针对婚姻家庭法制建设全局的，也有微观的，针对婚姻家庭领域里的各种具体法律制度、具体法律问题的。新《婚姻法》的出台无疑又是立法学界的又一大突出贡献。应该说新《婚姻法》的修改和有关司法解释的出台适应了我国社会经济发展的需要，符合市场经济条件下的新的婚姻关系的要求；也是我国婚姻法制度建设不断完善的结果。不过，从立法学的角度和我国的立法实际来看，不少规定仍在一定程度上存有缺陷，尚不够科学。

前言

自1950年5月1日公布施行的《中华人民共和国婚姻法》是新中国颁布的第一部法律。全文共分为8章，包括原则、结婚、夫妻间的权利和义务、父母子女间的关系、离婚、离婚后子女的抚养和教育、离婚后的财产和生活及附则，共27条。内容以调整婚姻关系为主，同时涉及家庭关系方面的各种重要问题。1980年9月10日，第五届全

国人民代表大会第三次会议通过新的《中华人民共和国婚姻法》；自1981年1月1日起施行，原婚姻法自新法施行之日起废止。2011年8月12日，最高人民法院发布婚姻法最新的司法解释。

婚姻法需要完善与发展，这已是法学界多年的呼声，并且已经提出不少具体建议。探求这种呼声的起因，关键在于我国几十年来政治、经济、科学技术、伦理道德、妇女地位、生活方式以及家庭结构等各方面发生巨大变化所致。
