论我国强制医疗制度的完善

摘要

放眼全球，很多国家都建立了一套比较完备的强制医疗制度，但是我国的进程却很缓慢。近几年来，精神病患者犯罪案件不断增多，这也引起了对精神病患者强制医疗措施的探讨。

本文主要从以下三个方面我国的强制医疗制度完善作出了论述：

第一部分：对我国的强制医疗制度进行整体的概述。具体包括强制医疗制度的概念和特征，强制医疗制度的具体价值。

第二部分：对于我国现象法律对强制医疗制度作出的规定进行分析，同时阐述了我国的强制医疗制度存在哪些问题。

第三部分：针对第二部分提出的一些问题，从对象方面、程序的设计方面对我国强制医疗制度的完善提出自己的意见。

强制医疗程序是对精神病人自由的一种限制，因此在具体实践中，不免会造成对其合法权益的侵害。因此，强制医疗措施的实施有很大的难度。本文只是抛砖引玉，希望有更多的学者进行相关问题的研究，最终实现精神病人权益保护与社会秩序稳定的完美统一。

Abstract

Looking at the world, many countries have established a relatively

complete system of compulsory medical treatment in our country, but the process is very slow. In recent years, criminal cases of psychiatric

patients continue to increase, which also caused a discussion

on medical compulsory measures of psychiatric patients.

This paper mainly from the following three aspects of China's compulsory medical treatment system perfection is discussed:

The first part: the summary of the whole of China's compulsory medical treatment system. Concrete concepts and features include compulsory medical treatment system, the specific value of compulsory medical treatment system.

The second part: the legal provisions of our country to make the phenomenon of compulsory medical treatment system are analyzed, meanwhile elaborated our country's system of compulsory medical treatment exist what problem.

The third part: in view of some of the problems put forward in the second part, from the aspects of design object, procedures to perfect the system of compulsory medical treatment in our country put forward their own views. Forced medical procedures are a restriction on the freedom of mental patients, so in practice, will inevitably cause the violation of the legitimate rights and interests of. Therefore, the implementation of compulsory medical measures has great difficulty. This paper is just a beginning, hope to have the research on the related problems of more scholars, and eventually realize the perfect unity of spirit patient rights protection and a stable social order.
