昨日,记者从郑州市二七区法院获悉,因学校处理程序欠缺,该院一审判决被告郑州航院恢复原告晓章的学籍。

英语四级考试使用作弊工具被抓正着2011年6月18日,正值全国大学英语四级考试。

郑州航院2011届工商管理专业学生晓章为了考试过关,此前花钱购置了电子橡皮信息传输作弊工具。

考试中,当他打开橡皮状接收器欲查看答案信息时(有英文相关内容),被监考老师抓了个正着。

当天,郑州航院在校园内张贴通告,称要给予晓章开除学籍的处分。

6月20日,郑州航院向晓章送达了《郑州航空工业管理学院学生违规处理告知书》。

22日,学校作出《关于给予晓章开除学籍处分的决定》(校教[2011]64号),对晓章开除学籍。

6月24日,晓章向郑州航院学生申诉处理委员会提出申诉。

学生申诉处理委员会于9月19日向晓章送达2011(03)号《学生申诉处理结果送达书》,告知晓章,经学校学生申诉处理委员会调查(听证),并经校长办公会于9月15日研究决定,他们维持校教[2011]64号文件的决定。

9月27日,晓章向河南省教育厅提出申诉,请求依法撤销郑州航院对他作出的开除学籍的处分决定及郑州航院学生申诉处理委员会2011(03)号送达书中的决定。

10月27日,省教育厅作出《关于晓章对郑州航空工业管理学院向其作出开除学籍处分决定提出申诉的复查意见》,维持郑州航院给予晓章开除学籍处分的决定。

被开除申诉失败后与母校对簿公堂原告几番申诉失利,2011年11月,晓章依法向郑州市二七区法院提起了行政诉讼。

原告不服处分决定提出申诉,校方于7月10日召开了学生申诉处理委员会会议,15人参加投票表决,13人认为处分决定正确,作出维持决定。

原告又向黑龙江省教育厅提出申诉,省教育厅于2007年9月17日维持了处分决定。

原告不服,向本院提起诉讼。

被告的监考老师发现原告作弊后作出处理,但原告并殴打了监考教师,被告根据原告李某殴打监考教师的行为,根据《普通高等学校学生管理规定》规定学生违反治安管理规定受到处罚,性质恶劣的学校可以给予开除学籍的纪律处分,作出了开除学籍的处分。

毕竟学校是属于事业单位,学校是学术的圣地。

按照行政行为的定义是:行政行为是指依法享有行政职权的行政主体行使权力,对国家和社会公共事务进行管理和提供服务的一种法律行为。

我们认定学校开除学生的行为属于行政行为。

首先从行为主体上来分析,行政行为是组织的行为而不是个人行为,这符合任何国家权力都只能归属于组织而不能归属于个人的宪政要求。

高校课程考核是高校教育的重要组成部分,学校管理既要有科学理性的智慧与规范,又要有人文主义的柔性与民主。

围绕学生这一主体,设定更为科学、更为人性化的管理程序,科学地安排考试,充分发挥考试的积极作用,从而积极主动创造适合学生的教育,达到提高教学质量和提升学风、提高学生诚信的积极作用。

25日,记者从通化区检察院获悉,魏X等人通过网络渠道售,借让学生“四六级考试”的名义,兜售考试作弊器设备及考试答案,然后利用无线电信号向考生发射答案,X月XX日,魏X以非法获取国家秘密罪被绳之以法。

同为23岁魏X等人都是通化人。

20xx年初,他们以“奇点考务”的名义,通过印发名片,在网上建立QQ群等方式发布广告。

很快,通过网络,兜售考试作弊器设备及考试答案。

20xx年XX月,全国大学英语四级考试前夕,正当魏X“群发”答案时,作弊信号被无线电监测人员在考场附近截获,警方随即抓获魏某。

事后,经全国大学英语四、六级考试委员会办公室确认,魏某非法获取并发送的答案,与20xx年XX月全国大学英语四级考试试题内容具有高度一致性,为机密级国家秘密。

最后,法院以非法获取国家秘密罪一审判处魏某有期徒刑一年。

大学生英语四级考试作弊被开除状告母校一审胜诉法院一审判决郑州航空工业管理学院恢复原告学籍
因在全国大学英语四级考试中使用作弊工具,郑州航空工业管理学院(以下简称郑州航院)2011届工商管理专业学生晓章(化名)被学校开除学籍。

晓章认为学校的这种行政行为严重违反法定程序。

在向学校和省教育厅申诉均失败后,2011年11月,晓章对学校提起行政诉讼。

昨日,记者从郑州市二七区法院获悉,因学校处理程序欠缺,该院一审判决被告郑州航院恢复原告晓章的学籍。

英语四级考试使用作弊工具被抓正着
2011年6月18日,正值全国大学英语四级考试。

郑州航院2011届工商管理专业学生晓章为了考试过关,此前花钱购置了电子橡皮信息传输作弊工具。

考试中,当他打开橡皮状接收器欲查看答案信息时(有英文相关内容),被监考老师抓了个正着。

当天,郑州航院在校园内张贴通告,称要给予晓章开除学籍的处分。

6月20日,郑州航院向晓章送达了《郑州航空工业管理学院学生违规处理告知书》。

22日,学校作出《关于给予晓章开除学籍处分的决定》(校教[2011]64号),对晓章开除学籍。

6月24日,晓章向郑州航院学生申诉处理委员会提出申诉。

学生申诉处理委员会于9月19日向晓章送达2011(03)号《学生申诉处理结果送达书》,告知晓章,经学校学生申诉处理委员会调查(听证),并经校长办公会于9月15日研究决定,他们维持校教[2011]64号文件的决定。

9月27日,晓章向河南省教育厅提出申诉,请求依法撤销郑州航院对他作出的开除学籍的处分决定及郑州航院学生申诉处理委员会2011(03)号送达书中的决定。

10月27日,省教育厅作出《关于晓章对郑州航空工业管理学院向其作出开除学籍处分决定提出申诉的复查意见》,维持郑州航院给予晓章开除学籍处分的决定。

几番申诉失利,2011年11月,晓章依法向郑州市二七区法院提起了行政诉讼。

●处罚过重,有失公允
晓章认为,自己在考试中虽然持有作弊工具,但并未实际使用,属于作弊未遂。

并且自己系初犯,事后他及时承认了错误,有悔改表现。

学校应当综合自己的行为与过错考量,给予自己适当的处分。

学校对他作出最为严厉的开除处分,处罚过重,有失公允,且学校的这种行政行为严重违反法定程序。

●作弊“未遂”,事实依据不足
晓章还认为,学校认定自己违法事实所涉及的通信工具是电子橡皮,事实依据不足。

行政处罚不同于民事私权处分,不应根据原告个人的承认,将作弊工具认定为通信工具。

是否系通信工具,学校负有查明义务。

再者,自己的行为属于预备或未遂状态,学校不能比照既遂状态予以处罚。

被告处罚时未考虑情节的轻重,作出的处罚与自己的行为不能罚当其过。

●处罚先有结果后有程序
在程序方面,晓章认为,学校作出处罚决定所依据的处分规定不具有剥夺自己受教育权的效力,作出处分决定需报校长会研究决定。

涉案处罚决定是在2011年6月22日作出的,自己是在6月28日收到的,而作弊事发当天即6月18日,学校已公告开除自己,学校先有结果后有程序,违反相关规定。

诉讼中,原告晓章请求法院依法撤销被告郑州航院作出的校教[2011]64号《关于给予晓章开除学籍处分的决定》的处分;依法判令被告为原告恢复学籍。

●有监考老师为证,作弊事实清楚
郑州航院辩称,晓章考试中使用电子橡皮接收装置作弊,事实清楚。

该事实有两名监考老师填写的《郑州航院考试违纪情况说明》证实,且晓章在本人所作的说明也认可了该事实。

●处罚依据明确、有依据
郑州航院还称,在教育部及他们学校的规章制度中,均对学生在考试中使用电子接收装置作弊的行为作出了开除学籍的规定,处罚依据明确。

这一点,学校根据教育部《普通高等学校学生管理规定》以及倡导诚信的时代要求,已将学校的各项规章制度汇编成《学生手册》,人手一册向新生发放并组织学习,故学校的每个学生对考试作弊的处罚规定都是清楚的。

所以学校根据《郑州航空工业管理学院考务工作实施细则》以及《郑州航空工业管理学院学生违纪处分规定》作出开除其学籍的决定,也是有充分制度依据的。

●其本人已签收处罚决定,程序合法
郑州航院认为学校对晓章的处罚程序也合法。

校方表示,作弊事件发生后,他们很快就向晓章发出了学生违规处理告知书,晓章也进行了签收。

后学校教务处讨论并提出了《关于给予晓章开除学籍处分的决定》的处理意见,在报经部门领导审核、院领导会议研究批准之后,才正式印发了《关于给予晓章开除学籍处分的决定》并向晓章本人送达。

且郑州航院学生申诉处理委员会和河南省教育厅经过审查,均认为学院关于开除晓章学籍的处分决定程序正当、证据充分、依据明确、定性准确、处分正当。

●使用通信工具属严重作弊
郑州航院表示,晓章被发现作弊后虽然承认了错误,但并不能掩盖其作弊的事实。

在作弊性质上,晓章使用通信工具属严重作弊。

故认为原告晓章的起诉缺乏事实和法律
依据,依法应予驳回。

学校处理程序欠缺,法院判决恢复学籍
法院经审理认为,高等学校的学生应当遵守法律、法规,遵守学生行为规范和学校的各项管理制度。

而原告却在学校组织的考试中携带橡皮状接收器进入考场,违反考场纪律。

且在考试过程中,其橡皮状接收器显示了英文相关内容,故可以认定原告晓章考试作弊。

法院认为,依照相关规定,对有违法、违规、违纪的学生,学校应当给予批评教育或者纪律处分。

同时认为,学校给予学生的纪律处分,应当与学生违法、违规、违纪行为的性质和过错的严重程度相适应,以达教育的目的。

被告郑州航院对原告晓章作出开除学籍的处分,处罚偏重。

《普通高等学校学生管理规定》第五十六条规定,学校在对学生作出处分决定之前,应当听取学生或者其代理人的陈述和申辩;第五十七条规定,学校对学生作出开除学籍处分决定,应当由校长会议研究决定;第五十九条规定,学校对学生作出的处分决定书应当包括处分和处分事实、理由及依据,并告知学生可以提出申诉及申诉的期限。

根据上述规定,法院认为,被告在发现原告考试作弊的当日即在其校园张贴通告,给予原告开除学籍处分,虽然此后履行了听取学生陈述和申辩等程序,但被告的行为系先作出开除决定,后履行相关程序,属程序违法。

法院认为,根据最高法相关司法解释规定,在行政诉讼中,被告对其作出的具体行政行为承担举证责任。

本案审理过程中,被告未提交其作出的校教[2011]64号《关于给予晓章开除学籍处分的决定》之前经校长会议研究决定的相关证据。

故被告作出的校教[2011]64号《关于给予晓章开除学籍处分的决定》程序违法,依法应予撤销。

2011年12月26日,郑州市二七区法院对此案作出一审判决:撤销被告郑州航院作出的校教[2011]64号《关于给予晓章开除学籍处分的决定》;被告郑州航院于本判决生效之日起10日内恢复原告晓章的学籍。
