在美国,放高利贷者被称为“放贷鲨鱼”。
在美国加利福尼亚州,法律规定除非获得特殊许可,普通个人和组织不得为借出钱款收取超过每年10%的利息;即便借款人同意支付高于这一比例的利息,贷款方也不得收受。
此外,借款人为借款所支付除本金以外的任何钱款,无论名目,都被计入利息范畴。
如果贷款方索要超出法律规定的利息,借款方有权要求退还此前支付的利息,免除仍欠的利息,甚至要求对贷款方实施惩罚性措施。
而贷款方不得以对法律不知情为由为自己辩护。
此外,如果法院认为贷款方故意索要超过法律允许的利息,甚至可以判处贷款方5年以下监禁。

根据佛罗里达州法律,每年单利超过18%的贷款都算作高利贷,但贷款额度高于50万美元则可以附带不超过25%的利息。
一旦利息超过25%,放贷人可能面临60天以下的监禁及500美元罚款;如果利息超过45%,放贷人将被处以5年以下监禁及5000美元罚款。

持这种观点的人还认为,凡约定利息超过法定指导利率的,其超过部分无效,债权人对此部分无请求给付的权利第三种观点认为:高利贷就是一种超过正常利率的借贷。
至于利息超过多少才构成高利贷,由于在立法和司法中都没有统一的规定和解释,在实践中只能按照民法通则和有关法律规定的精神,本着保护合法借贷关系,有利于生产和稳定经济秩序的原则,对具体的借贷关系进行具体分析,然后再认定其是否构成高利贷。
