性别歧视现象

就业歧视——人们或许很难将这个负面的字眼与那些名声显赫的国际商业巨头联系起来。一份抽样调查报告便披露了这样一个事实:被调查的96家跨国公司在华机构中,40%的外企公司在入职招聘时涉嫌存在“隐性歧视”,其中不乏世界500强企业。谭小芳老师认为,隐形歧视——首推性别歧视。

与任何一种社会现象的产生一样,职场性别歧视形成的原因也是多方面的,谭小芳认为主要包括以下几点:

1、男性与女性的生理差异是造成职场性别歧视的生物学原因。

女性休假造成连锁反应,导致企业流程受阻

成为母亲后,不会像结婚前那样投入的工作,但是企业对员工的要求是百分百投入。

由于女性的生理特点,企业不能安排女性单独出差,加夜班等具有一定危险性的工作。

所以以上这些生理性差异带来的问题让用人单位觉得麻烦,成为一种生理性的就业障碍。

一位企业人力资源经理如是说:―从企业的角度讲来讲,雇佣女员工不只是简单的增加一个员工的开支问题,因为她休假而导致的问题是一连串的,会产生连锁反应,导致企业流程受阻。而且她做了母亲之后根本不可能像没有结婚以前那么投入的工作,企业对员工的要求就是百分之百地投入。‖此外,由于女性的生理特点,企业一般不能安排其单独出差,加夜班还要考虑安全问题,这种由于生理差异带来的问题让用人单位觉得―麻烦‖,成为一种生理性的就业障碍。

2、企业追求利益最大化与女性生育成本非社会化的矛盾是造成职场性别歧视的客观原因。

作为市场经济的主体,企业追求利益最大化是企业发展的需要,是增强竞争力、保持可持续发展的需要,是市场经济的规律使然,因此企业在合法的情况下追求利益最大化是无可厚非的。

3、社会文化传统的影响是职场性别歧视存在的客观基础。

尽管我们有一系列的立法规定男女平等,尽管建国几十年来中国女性的社会地位发生了巨大变化,但几千年男权社会所承袭下来的对女性歧视的思想仍带着巨大的惯性,影响着人们的观念、意识和行为,在就业中也同样体现。

4、就业中的买方市场促使职场性别歧视严重化。

目前我国整体就业形势严峻,就业压力大。从总量看,―十五‖期间,我国每年城乡新生劳动力升至峰值,加上现存的城镇下岗失业人员,每年需要安排就业的人数达到2200——2300万人。在现有的经济结构状况下,每年新增的就业岗位700——800万个,因此就业缺口在1400——1500万个左右,劳动力供大于求的矛盾十分尖锐,形成了严重的劳动力买方市场,而这种劳动力供求严重失衡的状况使用人单位的选择范围增大,在选择权增大和追求利益最大化的双重影响下,女性就业的难度似乎就成了必然的现实。

5、职场性别歧视的又一重要原因是法律政策的缺失及执法不力。我国相关法律法规在确定立法宗旨、明确调整目标方面较为完备,但缺乏可操作性和执行性。在就业过程中较为常见的公开歧视现象,如今正在转向―隐性化‖。举例说,―不招女生‖的字眼在招聘启事中越来越少见,但在实际录用时,却仍然存在男多女少的情况,这就属于隐性性别歧视。

经历过多次面试的人都知道,职场的“外貌歧视”和“性别歧视”相当普遍。社会心理学家的大量研究表明:男子高大帅气、女子漂亮身材好,绝对有助于升迁。当然不是说外貌决定升迁命运,但是,事实证明,在同等能力的情况下,BQ(美感)分数越高,越容易更顺畅地与人打交道,也更容易获得升迁机会。

尽管隐性就业歧视现象有所上升,但笔者认为这是一个好现象:―这说明相关法律法规已经对就业歧视问题发挥了震慑作用,从公开歧视到隐性歧视再到消除歧视,也是解决这一问题必须经历的一个过程。‖

出台的法律法规,实际上对于解决就业歧视问题有了非常严格的举措。例如隐性歧视现象往往在应聘者初入公司的试用期内发生,而修订后的《劳动合同法》中,对于用人单位在试用期内解除劳动合同,则提出了严格的限制和举证要求。

影响和应对

从长远来看,企业的性别歧视不利于企业发展。专家认为,女性蕴涵着极大的创

造力和相对于男性的独特的智慧与个性,是伟大的人力资源。而女性参与企业的发展,更能激发企业的可持续创新发展。因此女性在企业发展中起着重要作用,女性的经济参与发挥了女性的聪明才智,更能激发和谐社会建设中的社会活力。而且企业具有反对偏见的社会责任,企业如果能转变观念,平等用工,能促进社会男女平等的进一步实现。

由于一些传统文化观念的影响,和入职前辈们的“善意提醒”,很多女大学生往往不自信,认为女生比不过男生,女孩子千万不要轻易怀疑自己的能力,不要因为某些用人单位的潜规则而轻易放弃。女孩子除了讲究面试技巧,最重要的就是自信,“不要轻易给用人单位留下‘这个职业只是我回归家庭的过渡’的印象”。追求男女平等是一项很漫长、复杂和系统的工作,―希望有更多的年轻人参与其中,更深入的推动男女平等‖。[

“英语沙龙”活动策划书 英语在法学学习中具有十分重要的地位,为加强学生的英语学习,形成学习英语的良好氛围,提高我院学生英语综合水平,寓教于乐,激发学生的学习兴趣,丰富学生课余文化生活,创建良好的校园文化氛围。在我院05级学生的热情倡导下和团总支的大力支持下,决定在我院组织开展“英语沙龙”活动。现将具体活动内容策划如下:活动内容简介 一、成立“英语角” 1、活动内容:“英语角”的成立主要以锻炼英文口头表达能力,为同学们提供良好的英语沟通环境为目的,通过同学们的交流互动提高口语能力,由辅导老师对语法知识、阅读能力、解题技巧作专门讲解。集学习性、交流性于一体,与学院的外语协会组织的英语角有所区别。这个英语角的学习性质比例较重,为成员营造了浓厚的全英文交流气氛,促进同学们英语水平的提升。 2、活动时间:每周周五下午4:00 3、活动地点:法学院教学楼前的樱花树下 4、组织人员:杨友志乔瑜
