”从《唐律》中可以看到,在唐代,知脯肉有毒不速焚而构成的刑事犯罪分为两种情况,处罚各不相同:一是得知脯肉有毒时,食品的所有者应当立刻焚毁所剩有毒食品,以绝后患,否则杖九十;二是明知脯肉有毒而不立刻焚毁,致人中毒,则视情节及后果以科罚。
