论音乐作品著作权法律保护的立法完善

随着全球化经济的持续发展，我国经济获得较大发展，科学技术水平不断提高，加上互联网的广泛普及，使我们的工作和生活方式焕然一新。然而科学技术是一柄双刃剑。运用时的出发点直接决定着它给我们的生活方式所带来的究竟是利还是弊，尤其是在为我们提供了新的生活方式的过程中，高速的信息传递等为我们的生活带来的便利同时，也为现行的法律带来了挑战。挑战之一就是在现代化信息的快速传播过程中音乐作品的著作权保护问题。音乐作品不仅是我们的智力劳动的成果体现，也是促进我国社会精神文明健康发展的必要条件。无论是从世界还是我国发展中来看，音乐作品都有很重要的意义，占据着社会生活中重要地位，是人类生活中必不可少的一部分。但另一方面，由于音乐本身存在着容易被复制的特点，随着现代音频技术的不断完善和提高，网络的发达又进一步使侵犯著作权的这种现象更加严重。各种音乐作品著作权为逐步出现，也将我国的法律法规对音乐作品著作权的保护存在的缺陷凸显。本文的研究目标，就是探讨我国在当前复杂的国际和社会环境中，如何能保护好音乐作品的著作权，从而维护当事人利益，以此激发创作人的创作热情，推动我国音乐产业朝着更好的方向发展。

文章共分为四大部分，引言部分概述了研究背景意义等，奠定全文框架；理论部分对我国音乐作品著作权的法律内涵等进行分析，奠定全文理论基础；接着分析了我国音乐作品著作权保护的现状及相关案例；之后从大数据角度出发对音乐作品著作权侵权与保护进行了探究；最后通过对国外有关著作权保护的立法启示及实践进行的论述提出了相应的保护措施。通过探究，笔者认为在当前互联网环境中，音乐作品著作权的法律保护范围应当更广，将网络音乐作品侵权行为也纳于其内，这样方能使音乐作品著作权得到全方面保护。
