我国知识产权的现状与发展

摘要：知识产权是人们的智力劳动成果在一定时期内所享有的独占性所有权。我国先后制定了商标法、专利法、著作权法、反不正当竞争法等基础性的知识产权相关法律制度，以及集成电路布图设计保护条例等专门性的知识产权相关法律规范，并逐步建立起相对完善的知识产权法律体系。我国知识产权法在改革开放以来的立法实践中，坚持隶属于民事法律范畴的制度定位，遵循以科技进步和经济社会发展、公共政策调整为指引的发展规律，形成了知识产权法与基本人权保护、公共健康保护、遗传资源保护、传统知识保护等诸多利益冲突的协调机制。在未来我国知识产权法的发展过程中，将呈现出以知识产权法“入典”或“成典”的法典化趋势，以知识产权主体界定标准等诸多的现代化变革，以构建知识产权国际保护新秩序为核心目标的国际化走向。

ABSTRACT：Intellectual property is the exclusive ownership of people's intellectual labor achievements in a certain period of time. China has successively formulated basic intellectual property related legal systems such as trademark law, patent law, copyright law and anti unfair competition law, as well as specialized intellectual property related legal norms such as integrated circuit layout design protection regulations, and gradually established a relatively complete intellectual property legal system. At present, China's intellectual property law is improving day by day, which provides a strong legal guarantee and institutional support for the progress of science and technology and the development of economy and society.In the legislative practice of China's intellectual property law since the reform and opening up, we should adhere to the system orientation which belongs to the category of civil law and follow the principle of scientific and technological progress With the development law guided by the economic and social development and the adjustment of public policies, a coordination mechanism has been formed between the intellectual property law and the protection of basic human rights, public health, genetic resources, traditional knowledge and many other conflicts of interest. In the future development of intellectual property law in China, there will be a codification trend of "entering into the code" or "becoming the code" of intellectual property law, a lot of modern changes such as the definition standard of intellectual property subject, and an international trend with the core goal of building a new international order of intellectual property protection.
