什么是主权在民原则?对近代宪法有何影响?人民主权原则- 基本含义人民主权原则人民主权(popu]arsovcrcignty)是指国家或政府的最高权力来源于和最终属于人民,即国家或政府的最高权力的“民有”,并且这种来源是政府或国家权力的合法化依据或前提。
产生:人民主权原则是近代以来全球范围内民主化浪潮及其所建立的现代民主制度的理论基石,它已为一切民主或自诩为民主的国家所认同,但是,由于人民主权原则的思想发展极为复杂,各国对其基本内涵理解不一,故而相应的制度表现形式也相差甚远。
人民主权原则即便在其支持者那里也并不具有完全一致的内涵,而是存在著作为“抽象原则”的人民主权原则和作为“具体原则”的人民主权原则的思想分野。
对原则采取的不同的理论取向自然是特定历史“情境”下的必然,但是,进入“革命后社会”的国家却有必要对以往非常态下的制度选择重新加以思考。
意义:社会主义国家的宪法实际上也采用人民主权原则,坚持“人民是国家和社会的主人”,公开的声明自己的阶级立场,鲜明地解释“人民”这一概念的政治内容,明确地规定全体人民享有当家作主管理国家事物地各项民主权利。
国家还通过完善各种法律制度来保障宪法和法律的实施,使全体人民的各项民主权利都得以充分实现。
所有这些,都反映了社会主义制度下人民主权原则的充实内容。
什么是基本人权原则?对世界各国宪法有何影响?人权是公民作为一个人的权利,表现为内心和身体的无限的扩张权。
基本人权原则在宪法中的体现,是从1791年法国宪法开始的。
该宪法以1789年法国《人权与公民权宣言》作为序言。
1793年法国宪法采用同样的方式,但对人权宣言做了重大补充。
从此,绝大多数国家宪法都确认了基本人权原则。
基本人权原则在各国宪法中是以不同形式体现出来的:第一种是法国式,即以人权宣言为序言,同时又规定一定数量的公民基本权利。
第二种是在宪法序言中确认基本人权原则,然后在公民基本权利与义务中具体规定人权的范围与内容。
