Thank you for your offer of April 5 for captioned goods. We find your prices not in line with the prevailing market. If you can grant us a discount, say, 10%, we may place orders from you regularly at that price.

We are regretful to tell you that the article you ordered is not available, because the demand for it has fallen to such an extent that we have ceased to produce it. 第六单元
In case the seller breaches this contract, the buyer has the right to deduct the default fine, compensation for damage or any other expenses from the deposit. The seller shall not be held responsible for late delivery or non-delivery of the goods owing to generally recognized “Force Majeure”affairs. However, the seller shall inform the buyer immediately by Fax.
因卖方违反本合同的规定而产生的违约金、赔偿损失金和其他相关费用，买方可在保证金中抵扣。

由于一般公认的人力不可抗拒原因而不能交货或延迟装船，卖方不负责任，但是卖方必须立即以传真通知买方。

This contract is composed in both Chinese and English, each of which shall be deemed equally authentic. Conflicts between these two languages arising therefrom shall be subject to Chinese version.

第八单元
As our importers are rather exacting in the matter of quality, please do enhance quality control and reduce the defective percentage.

According to the terms in the contract signed by our importers and us, we have to bear all the possible losses caused by the delay in case of late delivery. Therefore, please do guarantee the
delivery time; otherwise you need to bear the whole responsibility.
按照我们和进口商签订的合同规定，如果不能及时交货，我们将承担由于延迟而产生的一切可能的损失。

因此，请务必保证交货时间，否则贵方需要承担全部责任。

第十单元
Our Customs requires that this category of goods have to be inspected prior to export; otherwise they can not be cleared at Customs.
我国海关要求这一类商品在出口前必须要经过检验，否则将不予通关。

We feel regretted to know that goods are damaged. In order to solve this matter, we would like to send our representatives to make an examination.
得知货物有破损，我方深表遗憾。

为了解决此事，我方愿意派代表进行检查。

第十一单元
If you want insurance to be covered for 130% of the invoice value, we can arrange this subject to an extra premium. Extra premium is for buyer's account, should additional risks be covered.
如果贵方想按发票金额的130%投保，我们可以办理，但要收额外的保险费。

如投保额外险，额外险费由买方负担。

Should any damage be incurred, you may, within 30 days after the arrival of the consignment at the port of destination, approach the insurance agents at your end and file your claim with them supported by a survey report issued by notary public.

第十三单元
We had the goods inspected immediately when they arrived, and a shortage of 500 kilos was found.

We had the goods re-inspected upon their arrival and found the sizes of the peanut kernels are smaller than those of the samples. Apparently these are only second grade kernels rather than first grade as stipulated in the contract.
