在本案中,企业改制由有限责任公司改制为股份有限公司,其股权结构发生了变化,在法律形式上企业已经发生了变更,其偿债能力发生了变化,因此要求保证人在改制之后继续承担保证责任无疑有悖于公平原则。

因此如果要求保证人继续承担保证责任,债权人应当取得保证人的书面同意,如果保证人不同意继续提供保证,应予免责。
