【摘要】家庭是社会的一个组成部分，但家庭暴力却影响了社会的稳定与发展。我国各界呼吁出台专门的法律来保护受害者的合法权益，希望创造一个没有暴力的世界。我国《宪法》规定了公民的基本权利。第33条规定“中华人民共和国公民在法律面前一律平等。国家尊重和保障人权。”第37条规定“中华人民共和国公民的人身自由不受侵犯。”第38条规定“中华人民共和国公民的人格尊严不受侵犯。禁止用任何方法对公民进行侮辱、诽谤和诬告陷害。”第48条规定“中华人民共和国妇女在政治的、经济的、文化的、社会的和家庭的生活等各方面享有同男子平等的权利。”《民法通则》在第98、101、103条规定了保护公民的生命健康权、名誉权、婚姻自由权等权利。这些法律明确规定的公民享有的合法权益，在家庭暴力面前并没有得到保障，而是受到了严重的侵害。家庭暴力先侵犯了受害者的人身权利，特别是身体权、健康权、生命权和自由权，家庭暴力还严重摧残了受害者的精神。遭受暴力的受害者，不仅在肉体上留下了伤痕，更在心灵上留下了不可磨灭的创伤，经常性的暴力可能摧毁他们人生的信念和生活的信心，破坏他们与人们正常交往的心理，扭曲他们的性格，不少受害者在压抑、焦虑，甚至痛苦中煎熬，精神恍惚，长此以往，导致精神失常甚至走上轻生的道路。
