——奥尔多.利奥波德《像山那样思考》(二)文章素材《被遗忘权》所谓“被遗忘权”,即数据主体有权要求数据控制者永久删除有关数据主体的个人数据,有权被互联网遗忘,除非数据的保留有合法的理由,在大数据时代,数字化、廉价的存储器、易于提取、全球性覆盖作为数字化记忆发展的四大驱动力,改变了记忆的经济学,使得海量的数字化记忆不仅唾手可得,甚至比选择性删除所耗费的成本更低,记忆和遗忘的平衡反转,往事正像刺青一样刻在我们的数字肌肤上;遗忘变得困难,而记忆却成了常态。

“被遗忘权”的出现,意在改变数据主体难以“被遗忘”的格局,赋予数据主体对信息进行自决控制的权利,并且有着更深的调节、修复大数据时代数字化记忆伦理的意义。

首先,“被遗忘权”不是消极地防御自己的隐私不受侵犯,而是主体能动地控制个人的信息,并界定个人隐私的边界,进一步说,是主体争取主动建构个人数字化记忆与遗忘的权利。

与纯粹的“隐私权”不同,“被遗忘权”更是一项主动性的权利,其权利主体可自主决定是否行使该项权利对网络上已经被公开的有关个人信息进行删除,是数据主体对自己的个人信息所享有的排除他人非法使用的权利。

其次,在数据快速流转且难以被遗忘的大数据时代,“被遗忘权”对调和人类记忆与遗忘的平衡具有重要的意义,如果在大数据时代不能“被遗忘”,那意味着人们容易被囚禁在数字化记忆的监狱之中。

不论是个人的遗忘还是社会的遗忘,在某种程度上都是一种个人及社会修复和更新的机制,让我们能够从过去经验中吸取教训,面对现实,想象未来,而不仅仅被过去的记忆所束缚。

最后,大数据技术加速了人的主体身份的“被数据化”,人成为数据的表征,个人生活的方方面面都在以数据的形式被记忆。

大数据所建构的主体身份会导致一种危险,即“我是”与“我喜欢”变成了“你是”与“你将会喜欢”;大数据的力量可以利用信息去推动、劝服、影响甚至限制我们的认同。

也就是说,不是主体想把自身塑造成什么样的人,而是客观的数据来显示主体是什么样的人,技术过程和结果反而成为支配人、压抑人的力量。

进一步说,数字化记忆与认同背后的核心问题在于权力不由数据主体掌控,而是数据控制者选择和建构关于我们的数字化记忆,并塑造我们的认同。

这种大数据的分类系统并不是客观中立的,而是指向特定的目的。

因此,适度的、合理的遗忘,是对这种数字化记忆霸权的抵抗。

你随便拉来一个互联网从业人员,问什么是「大数据」,他能滔滔不绝地扯出一大堆专业词汇:神经网络、深度学习、人工智能等。

反正你也听不懂,觉得很厉害就对了。

其实,我们每天的行程安排,都可以变为数据:每天坐地铁上班,属于出行数据;网上购物,属于消费数据;去一趟国外旅游,属于娱乐数据...当无数人的数据被集合归类,就统称为「大数据」。

这些数据有什么用?对于大部分人来说,是没有任何价值。

你每天光顾楼下的早餐店,只能看到自己的消费金额,而店铺老板可以统计客流量和销量,获悉顾客的喜好,进而调整食材量。

再延伸到其它行业,一些医疗机构可以通过大数据提升临床试验、新药的研发效率;政府通过大数据建立城市规划图,甚至控制疫情的扩散。

这样看来,大数据能解决很多实际问题,既方便了我们生活,企业也能更好地了解消费者需求。

国家同样希望互联网企业能引领技术的变革。

然而纵观国内企业,更愿意利用手中的数据来牟利,这样来钱快。

潘多拉魔盒就此被打开,当隐私从道德领域滑向市场领域后,便成为可供出售的商品,全凭商人的道德来自我约束。

它们喜欢收集用户信息,挖掘各种需求和隐私,完善用户画像,比你父母还要了解你,然后再卖假药、推荐莆田医院。

小公司没有精准的营销能力,它们只能粗暴地贩卖隐私来获利,形成一条完整的黑产链。

技术总是一把双刃剑,如今大数据在探索人类道德底线的路上,快速前进。

这是信仰的时代,这是怀疑的时代你觉得自己的隐私不值钱,没有利用价值,无论谁能不能看你的微信记录,都不在乎。

当每个人都抱着这种鸵鸟心态时,更多摇摆不定的公司就会选择作恶,因为被舆论谴责的代价太低了,或者说,国人的包容性太高了。

诚然,如今我们享受到便捷的生活,离不开大数据的建模和分析,但是也失去了保留隐私的权力!我上网买了一件商品,不代表你可以擅自在所有网页推荐我买过的商品;我在网上浏览,不需要你推荐附近的商家和莆田医院,更不想点击广告弹窗;没经过我同意,请不要擅自安装流氓全家桶,并绕过电脑权限,获取用户隐私;我使用输入法只是方便打字,拒绝加入用户体验计划,更不允许明文传输,将打字信息传到贵公司的服务器里;我下载手机软件,不需要你时刻定位我的GPS位置进行追踪,更不需要你推荐附近的商家;我填写的快递单据,你们内部人员凭什么卖给各种电信诈骗分子,甚至泄露地址信息,威胁到人身安全;我连接商场wifi,你们服务商为何偷偷地保留信息,并且访问手机软件,追踪我的活动轨迹;我知道自己的资料以十元的价格在网上被打包出售,而卖家却是金融和保险公司,你们成功完善了黑产的上下游交易环节。

当我的手机号码被泄露后,银行余额、通信记录、身份户籍、通信记录、航班记录、收货地址和出入境记录都能被查到,请问这些数据是怎么流出的?我一直想不明白,到底是谁给了你们肆无忌惮的权力?你们其实在纵容,你们所标榜鼓吹的算法推荐,你们所自诩的“大数据模型”,所谓的千人千面、深度学习,却让邪典动画片一直保留,直到被曝光才下架,何也?一个心智未成熟的孩子看完这些动画后,你们还能推荐更多的类似邪典动画,拎起这些孩子的头颅,一脚扔向了不归路。

我很好奇,为何那些邪典动画都能被算法推荐,你们是真的不知道这些视频的存在吗?平台的内容审核去哪了?仅仅一个下架、一个不痛不痒地道歉就解决了?互联网有原罪,我以为是早期的法律不规范所致,互联网企业为了生存才迫不得已。

现在看来,这都是狗屁,我只看到你们在故意作恶,为了流量和利益,秉着法不禁止既自由是吧?这一幕我似曾相识,我翻开互联网一查,这段历史没有年代,歪歪斜斜的每个网页都写着“大数据”三个字。

我横竖睡不着,仔细看了半夜,才从网页边缝里看出字来,全都写着两个字:“吃人!”人们面前应有尽有,人们面前一无所有大数据是如何一步步毁掉我们的思维?人们倾向于休闲娱乐,懒惰更是人之常情,恨不得伸手就能获取所需。

遗憾的是,大部分互联网公司都以流量作为导向,只要能增加流量、留住用户时间,就会无所不用至极。

各种娱乐八卦、低俗视频和擦边球内容会投其所好,促使用户在生理冲动下点击,并且大受欢迎。

这类流量被统统汇聚成“大数据”,让人继续琢磨,完善大众的偏好:微博用户喜欢看什么热搜,就刷什么内容,就连紫光阁地沟油都不放过;观众就喜欢流量明星电影,于是各种“大投资巨作”越来越多;大家就喜欢看各种小姨子、黄暴漫画和社会摇,那就批量生产出来;也有不少人喜欢看黑社会大佬惩恶扬善,以暴制暴,没问题,群演都找好了。
