,,三、阅读理解题(一)阅读下面短文,回答问题诠释方法在解释过程中,除了认知功能之外,尚有另外一项功能:两相符合及调整一致的功能,这是单纯的历史解释所不能达到的目的。
所谓两相符合指的是法规为主体,共同生活所发生的现实情况是客体,使主客两者调和一致之意。
解释法律的机关,不限于传达以过去的事实为对象的法律规范之原始意义,应更进一步在穷尽法律的原意之外,从该法律规范作为整体法制一环的关联性中,发挥其效力。
解释者把法律条文的原始意义加以重组并不足够,解释者必须使法律的含义与当前的生活现状相适应。
贝提反复强调法律规范的解释与纯认知的理解或判断不同,它不以发现真理为目的,法的解释在于作为社会共同生活之工具性的目的,这种功用在调和私法领域的各种利益冲突时,表现最为明显。
不同社会利益集团对法律规范的形成皆有其影响存在,这是每一个具有历史背景的社会本质。
法官基于对利益冲突应作出评价的职责,对这一社会本质不能忽视。
这又涉及历史解释方法的问题,所谓历史解释并非指从历史的原著者及语言学方法来获致单纯的知识。
因为法律解释不是在作纯理论的探讨,相反的,作为社会单位的不同利益主体,都把所理解的法律当作游戏规则并受其拘束,故历史解释无非是以历史方法确认法律含义的基础上,用目的论式表现其规范效力的解释任务,达成符合现实需要之解说及补充性的功能。
