PSC滞留缺陷以及举例
1995 年 11 月 23 日，IMO 通过了 A.787(19)决议：港口国检查程序（Procedure for Port State Control），为各港口国实施港口国检查提供了基本指南。A.787(19)附件 1，滞留船舶指南 (Guidelines for the Detention of Ships)，是港口国检查官滞留船舶的指南，各备忘录组织基本 是按照该指南的标准来执行。在 21 届 IMO 大会上通过了 A.882(21)决议，对 A.787（19） 进行了修正。我们对相关内容进行了整理，供我社各检验单位参考。
2． 在检查中，PSCO 应进一步评估船舶和/或船员及下一航次计划，以确认能够： During inspection the PSCO should further assess whether the ship and/or crew, throughout its forthcoming voyage, is able to: 1) 航行安全； Navigate safely; 2) 安全处理、承运和监控货物状况； Safely handle, carry and monitor the condition of the cargo; 3) 确保机舱安全； Operate the engine-room safely; 4) 正确维护推进机械和舵机； Maintain proper propulsion and steering; 5) 灭火设备在任何情况下随时可用； Fight fires effectively in any part of the ship if necessary; 6) 迅速弃船、安全和有效救助； Abandon ship speedily and safely and effect rescue if necessary; 7) 防止环境污染； Prevent pollution of the environment; 8) 保持足够的稳性； Maintain adequate stability; 9) 保持足够的水密完整性； Maintain adequate watertight integrity; 10) 遇难情况下的通讯联系； Communicate in distress situations if necessary; 11) 船上安全和健康的环境。 Provide safe and healthy conditions on board.
澳大利亚最新PSC检查滞留缺陷
澳大利亚最新PSC检查滞留缺陷发布时间:2012-11-27 浏览次数:11011～7月份，澳大利亚港口当局累计检查船舶2816艘次，滞留船舶172艘次，滞留率2.95%；船舶累计滞留缺陷320条，平均1.86条/艘次。
滞留10艘次以上的港口分别为：Newcastle，NSW，21艘次；Melbourne，VIC，18艘次；Kwinana, WA，17艘次；Dampier，WA，16艘次；Brisbane，QLD，10艘次；Gladstone, QLD，10艘次。
01. 证书和文件中012船员证书(Crew-Certificates)缺陷总数5条。
其中01209-船舶最低配员2条；01201-船员证书2条，01214-船旗国签注1条。
◎提示：船长应定期整理各类证书，关注证书的完整性和有效性，缺失的及时申请岸基支持，关注船员证书的船旗国签注及本人签字。
02. 结构状况(Structural Conditions)缺陷11条，其中船体及甲板裂纹缺陷5条，船体及舱壁锈蚀3条，舵机缺陷2条，水密门缺陷1条。
◎提示：船舶应按相关体系或管理规范要求加强船舶和设备的维护保养，船体破损时应及时申请进厂修复及船级社检验，并确保船舶适航性要求。
03. 水/水密情况(Water/Weathertight conditions)缺陷18条，其中03104-货舱及其他舱口缺陷3条，03105-舱盖(舱口及可移动舱盖及帆布)3条，03108-通风筒/风管和围板11条，03112-泄水口、排水孔及进水孔1条。
◎提示：大副应组织人员定期检查全船开口的风雨密状况，及时更换老化密封条，定期检查全船通风筒及围板是否有破损、铆钉脱落或锈蚀脏污等情况，发现异常及时纠正。
04. 应急系统(Emergency System)缺陷11条，其中04102-应急消防泵7条，04114-应急发电机4条。
◎提示：应急消防泵及应急发电机方面的严重缺陷时PSC检查滞留项目，船舶应加强应急系统的维护保养，定期测试，确保设备随时可用。
PSC检查行动代码类型使用
附件：PSC检查行动代码类型使用1、代码10:定义:缺陷已纠正。
适用：当一个指定的缺陷经PSCO检查已纠正后，使用此代码。
这个代码用以清除代码15，16，17，18，30，99，不能单独使用。
备注：在一个PSC后续检查中，必须注意当一个缺陷已经纠正后，先前的行动代码必须在PSC报告上划去而插入代码10。
同样地对于这个缺陷的后续检查在APCIS2000系统中也将用代码10；2、代码15：定义：当一个缺陷在检查港无法纠正，但需要在下一港纠正或作进一步检查时用此代码。
备注：当缺陷纠正后，代码15必须用代码10更新。
3、代码16：定义：在14天内纠正缺陷。
适用：尽管在原则上所有的缺陷都应在开航前纠正，但如果是一个较不严重的缺陷，经过PSCO的专业判断，认为不会对安全`健康`或环境造成危害，并不需要立即纠正时，可以使用代码16；代码16用于通常较代码17的缺陷不严重，但仍需纠正的缺陷。
备注：缺陷纠正后，代码16必须用代码10更新。
4、代码17：定义：开航前纠正缺陷。
适用：当缺陷必须在开航前纠正时，需使用代码17。
通常情况下需要后续检查。
备注：如在后续检查中，PSCO发现此缺陷已纠正，代码17必须用代码10更新。
根据缺陷的严重性或修理程度或其他条件，假如船舶在未能纠正缺陷情况下开航，缺陷代码可更改为15、16或99。
当许多缺陷（每个缺陷均为17代码）的合并使得船舶不适航时，PSCO必须滞留船舶来纠正缺陷。
当船舶被滞留时，至少一个缺陷的行动代码为30较好，这将避免因为仅仅使用17行动代码而滞留船舶所导致的法律争端。
5、代码18：定义：三个月内纠正缺陷。
适用：尽管在原则上所有的缺陷都应在开航前纠正，但如果是一个较不严重的缺陷，经过PSCO的专业判断，认为不会对安全`健康`或环境造成危害，并不需要立即纠正时，可以使用代码18。
对于较不严重的ISM不符合方面的缺陷（ISM缺陷类别2500系列），必须使用代码18。
备注：缺陷纠正后，代码18必须用代码10更新。

第一章引言随着国际海运的发展，运输市场竞争日趋激烈，一些航运公司为降低经营成本，使用老旧船舶营运，压缩维修费用，使得船舶状况严重下降，低于国际标准；同时，一些国家未能严格履行国际公约的义务而有效地管理其所属船舶及船员，使得国际海运市场上出现大量低标准船舶营运，对海上人命安全和海洋环境构成了严重威胁。
为此，国际海事组织通过了一系列决议，并在公约中明确了港口国应当按照国际公约的标准对进入其港口的外国籍船舶实施港口国监督（PSC）检查，要求其纠可可能存在的缺陷，消除低标准船舶营运。
港口国监督是英文PORT STA TE CONTROL（简称PSC）的中文译文。
目前，国际海事界赋予了这一名词专门的含义，就是指港口国政府海事当局针对船舶安全和防污染方面的监督检查，主要包括检查检查船舶、船员证书的合法性、有效性，检查船舶和船员的实际情况同证书所载是否一致，以督促船舶严格执行有关国际公约，满足有关安全和防污染的标准要求，消除低标准船舶营运。
港口国监督是由1978年“AMODO CADIZ”轮的触礁事故而产生，当时该事故引起了欧洲公众与政界的极大震动，普遍认为有些船旗国政府的主管机关，在确保他们所管辖的船舶符合国际公约规定的标准方面，未能尽到职责。
为此，1980年13个欧洲国家，加上欧共体、国际海事组织（IMO）、国际劳工组织（ILO）在巴黎开会，一致同意共采取措施，限制并继而消除不符合国际公约船舶的航行。
继1980年会议之后，于1982年1月召开了第二次会议，会上通过了著名的巴黎备忘录（Paris MOU）。
该备忘录于1982年7月1日开始生效。
当时签署此备忘录的有14个国家的海事当局，这些国家分别是：比利时、丹麦、芬兰、法国、德国、希腊、爱尔兰、意大利、挪威、葡萄牙、西班牙、瑞典、大不列颠和北爱尔兰联合王国。
由于巴黎备忘录（Paris MOU）组织显得非常有效，IMO在1991年召开的第17次大会上通过了一项决议A.682（17）“在船舶排放和控制方面加强地区合作”，该决议以实行PSC的巴黎备忘录（Paris MOU）为榜样，要求全球各地区建立类似的PSC 备忘录组织，各备忘录成员国及实施PSC检查的其他国家，就做出安排，相互合作，共同建立全球性的PSC网及各网之间的联系，以减少直至排除低标准船舶的航行。

PSC检查中如何正确记录ISM缺陷
港口国监督（PSC ）检查是以国际公约为依据，运用合理的专业判断来确定影响船舶安全、防污染及船上工作和生活条件的缺陷，提出整改要求，督促船舶管理公司（以下简称“公司”）和船舶及时纠正缺陷，以符合公约的要求。
国际安全管理规则（ISM规则）的符合性是PSC 检查的内容之一，检查中港口国监督检查官（PSCO ）如发现船舶和设备维护、操作和管理、应急反应等方面存在共性问题或重复发生的问题，将进一步核实船舶安全管理体系相关要求，以判断体系在船舶上运行是否符合ISM规则一个或几个要素的规定。
如存在不符合的情况，PSCO将在PSC报告中记录ISM缺陷，给予相应的行动代码：如18（指3个月内纠正缺陷）或30（指滞留）。
船舶在PSC检查中若被记录ISM缺陷，会对公司产生不利影响。
一方面将增加公司运营成本，公司需要对此类缺陷涉及的安全管理体系文件、相关操作、岸基支持等进行审查，查找问题的根源，提出纠正措施；如船舶因ISM缺陷导致被滞留，签发船舶安全管理证书的主管机关或船级社还要实施附加审核，并要在3个月内再次登轮验证体系运行的有效性，这些都将增加公司和船舶的营运成本。
另一方面可能影响公司绩效，公司绩效的计算方法为：管理公司船队中所有船舶的历史滞留次数和缺陷数量分别除以检查次数，得到公司的滞留指数和缺陷指数，然后与东京备忘录平均滞留指数和缺陷指数比较而得。
计算公司绩效时，东京备忘录新检查机制将PSC缺陷分为两大类：一类为ISM缺陷，每个ISM缺陷计为5分；另一类为与ISM规则无关的技术和/或操作缺陷，即非ISM缺陷，每个计为1分。
1个ISM缺陷计为5分，对公司绩效影响较大，严重时，1个ISM缺陷可能导致公司绩效变低或极低，从而使公司管理的所有船舶风险属性变高，接受船舶PSC检查的频率和应检负担也都将增加，可见ISM缺陷可能对船公司绩效产生严重影响。
然而，因背景、资历、经验以及对ISM规则理解不同，一些PSCO在记录ISM缺陷时，存在考虑欠周全、缺陷描述不清，甚至滥用规则、错用要素等情况，造成所记录的ISM 缺陷不能真实反映船舶存在的问题，让公司和船舶无所适从，甚至产生误解，对公司和船舶营运造成负面影响。

五、港口国检查报告及其处理意见（一）PSC检查报告分FORM A和FORM B，当PSCO确认无缺陷时仅填写FORM A，而当有缺陷存在时检查官填写FORM B。
该检查报告可复制给船长、主管当局、PSC检查官，当船舶被滞留时应填写滞留通知书及将上述检查报告一并复制给船旗国、IMO、船舶检验机构（必要时）。

港口国常见缺陷
PSC检查常见缺陷一、救生设备二、消防安全三、总体安全（稳性和结构及相关设备）四、航行安全五、载重线六、防止污染1、救生设备（1）艇机按照SOLAS 公约的要求，每周都需要对所有救生艇和救助艇的发动机进行正车和倒车运转，总时不少于3 min。
救生艇艇机应该是随时都处于可用状态。
而事实显示，救生艇缺陷却是船舶滞留的多发项目，救生艇艇机最常见缺陷有艇机不能起动，起动需要的时间过长，救生艇排烟管漏烟（指封闭式救生艇）。
艇机不能起动的原因，主要有：1) 环境温度过低，起动前未采取任何暖机措施；2) 原动力缺失（电瓶没电、油箱没油等）；3)油管路堵塞（多见于老龄船舶）；4)船员操作不熟练，或船员因紧张导致了错误的操作，等。
（2）救生艇降落装置船舶在澳大利亚和荷兰接受港口国检查时，港口国检查官比较关注对救生艇降落装置结构状况的检查，如救生艇艇架、滑车、眼板、艇钩、绞缆机底座等，往往也会因这方面的缺陷滞留船舶。
就其原因，是船员日常维护保养不到位，还有检验不到位的因素。
常见的缺陷有：1) 救生艇降落装置（艇架头部、艇架基座、滑车和眼板、艇钩、绞车底座等）严重锈蚀、减薄、损坏；2) 救生艇降落装置不完整（缺少限位开关、限位器卡死、缺少重力刹车等）。
（3）救生艇总体状况按照SOLAS 公约和公司安全管理体系的规定，均要求船员每周、每月对救生艇及救生设备进行检查和维护，确保救生艇处于随即可用的状态。
但因疏于保养，未能使救生艇总体状况处于满意状态，导致船舶在港口国检查中被滞留的事例也时有发生。
常见的缺陷有：1) 救生艇属具缺少或状况不好，如配备的淡水、食品过期，救生艇的浆叉和浆丢失，非机动艇缺少桅或帆等；2) 救生艇缺乏维护，整体状况较差，如救生艇内油污水严重，整体锈蚀严重；3) 救生艇内构件损坏，如淡水箱或艇机油箱穿孔，救生艇浮力箱开裂，救生艇艇体反光带破损，艇体上金属支撑锈蚀严重等。
（4）救助艇降落装置救助艇降落装置方面常见的缺陷有：1) 救助艇内某一位置操纵降落机械装置的布置丢失；2) 救助艇内未安装遥控释放装置；3) 救助艇降落装置的钢丝绳丢失（艇内遥控释放）。
