一、法的形式概述
法的形式
指法的具体的外部表现形式。主要指法由何种国 家机关制定或者认可，具有何种表现形式。 法的形式表明法所存在的方式，是一国法和法律 规范的既成产品，是以一定形式存在的已然之法。 法的内容和形式的关系: 一般情况下，内容决定 形式；然而有时相同的内容有不同的表现形式； 同一种法的形式可为不同本质的法所采用。

（三）动因性要素
~是根本的要素。同时制约着资源要素和进路性 要素。它决定不同资源性要素和进路性要素在法 的形成过程中居于何种地位和发挥怎样的作用， 并制约法的渊源的选择和提炼方式或机制。 法的主要动因是人们的实际社会生活的需要。 社会物质生活条件和占统治地位的生产关系类型 是根本性动因要素。
法、先前法、或源于政策、宗教、礼仪、道德等；
形式渊源：法来自制定法、习惯、判例法等；
历史渊源：引起法产生的历史事件等。例如美国1803

2、成文法与不成文法（按照法的创制和表达形式）
成文法是指由特定国家机关制定或认可的以规范化的成 文形式出现的规范性法律文件，又称制定法。 不成文法是指由国家认可的不具有文字表现形式或虽具 有文字形式但却不具有规范化成文形式的法。一般为习 惯法。 随着法的发展，成文法日益增多，已成为法的主要组成 部分，而不成文法则逐渐减少。 法学上的成文法与不成文法的区分，不应完全看法是否 有文字表现形式，而要看是否有规范化的成文形式。判 例法有文字形式（判决）而被列为不成文法范畴，原因 在于它没有一般制定法的规范化成文形式；英国宪法被 列为不成文宪法，原因也在于它不是以规范化的即集中 的成文宪法典的形式表现出来。

一、法律渊源语义多样性与置换尝试在法律科学中,恐怕再没有一个法律概念象法律渊源一样易生歧义和模糊的了。
因此,尽管法学界均无疑义地将法律渊源作为法学的一个基本范畴之一,但一些专门研究法学基本范畴的着作却将它排除在外,从体系化的角度讲,这多少是件遗憾的事情。
从语源上看,法律渊源(sourceoflaw)演化于罗马法的fontesjuris,原意是指“法的源泉”。
但是,什么是法的源泉呢?罗马法时代及后世的法学家又有不同的理解。
英美法系国家中,法律渊源的研究较大陆法系国家中的研究要多,因而关于法律渊源的语义的观点亦多种多样。
英国早期分析法学派代表人物之一的霍兰德(ThomasErskingHolland)认为法律渊源一词有四层涵义:(1)它是指我们获悉法律知识的来源;(2)它是指赋予法律强制力的最终权威,即国家;(3)它是指那些使已取得法律强制力的规则得以自发产生的原因,即习惯、宗教和科学论述;( 4)它是指一些国家机关,通过这些机构,国家可以认可以前无权威的规则具有法律效力,或者国家自身创制新的法律,即判例法、衡平法、制定法。
1随后,J·W萨尔蒙(JohnWilliamSalmon)发挥了霍兰德观点,他明确指出:法律渊源一词有几种不同的涵义。

所谓规范性法律文件的规范化，是 指各级立法主体在制定和修改规范 性法律文件时，应依据统一的规格 和标准，使一国规范性法律文件体 系成为名称确定、等级分明、结构 严谨、协调统一的整体。
在我国实行中央统一领导和一定程度分权的、 多级并存和多类结合的立法体制(也有叫做 “一元两级多层次的立法体制”)，因而制定 出来的规范性法律文件也具有多样性，如果没 有统一的规格和标准，就会造成很大混乱，并 由此影响法的体系的和谐一致和整个法制的统 一和尊严，不利于法律文件的遵守和适用，给 执法、守法造成困难。
可见，判例不仅仅是一种法官对个案的判决， 还是具有普遍意义的法律规范。在英美法系国 家，判例法是一种重要的法律渊源；在大陆法 系国家，理论上不承认判例法是法律渊源，但 实际上也存在着少量的判例法，而且判例对法 律适用有很大的影响。
在当代中国，判例不是法的渊源之一，但对于 司法和执法工作具有重要的参考价值，特别是 最高人民法院作出的一些判例，对于下级法院 有指导作用。
其次，有助于更好的认识法的效力的来源和依 据，明确各种不同法律规范之间的效力等级， 从而确定应该适用的法律。 最后，有助于人们认识不同来源和效力等级的 法律的具体表现形式，认识到习惯法、判例法 和制定法一样都可能成为一国的法律渊源，从 而避免只将国家机关制定的规范性文件视为法 这一错误认识。

法律渊源词义考彭中礼＊内容提要：“法律渊源”一词是从英文ｓｏｕｒｃｅ ｏｆ ｌａｗ翻译而来，其源头是罗马法上的ｆｏｎｓ ｊｕｒｉｓ。
古希腊时期没有法律渊源概念，只有法律起源的早期观念，其主要原因是法律生活没有职业化。
罗马法上的ｆｏｎｓ ｊｕｒｉｓ概念产生于司法实践，是法官选取和发现纠纷解决依据的场所。
中世纪的西欧人承续了罗马法中法律渊源理论的某些观念，并在法律生活中不断实践。
到近代，受理性主义思潮的兴起、民族国家的建立以及三权分立制度的形成等因素的影响，制定法变成了唯一的法律，法律渊源概念发生了变异。
近代法典化运动给法律渊源带来的仅仅只是法律渊源形式的变化，法律渊源的概念却没有变化。
界定法律渊源概念，必须站在司法立场，坚持规范多元态度，正确理解“法律”和“渊源”在“法律渊源”一词中的含义。
法律渊源实际上是多元规范的集合，法官从中发现裁决案件所需要的裁判规范。
关键词：法律渊源 ｆｏｎｓ ｊｕｒｉｓ 裁判规范一、问题的由来在法学领域中，法律渊源是一个极其重要的概念。
但在我国法学界，法律渊源概念的含义不仅极不统一，还存在彼此矛盾和对立的现象。
如将法律渊源等同于法律形式者有之，〔１〕将法律渊源等同于法律的效力来源者有之，〔２〕将法律渊源视为“终极来源、效力来源和形式来源”者有之，〔３〕将法律渊源的基本要素概括为“资源、进路和动因”者亦有之，〔４〕而新近又有学者提出法律渊源是“法官法源”。
〔５〕法律渊源的这种含义混乱现象在西方学界同样存在，如《牛津法律大辞典》认为“法律渊源”一词在几种不同的意义上使用：（１）法律的历史渊源；（２）影响法律、促进立法变化的理论原则和哲学原则；（３）形式渊源，因为他们公认的权威而授予来自于他＊〔１〕〔２〕〔３〕〔４〕〔５〕湖南行政学院副教授。
这种观点在当前的法理学教材中随处可见。
