2003年12月1日贵阳市南明河保护管理办法(2003年8月29日贵阳市第十一届人民代表大会常务委员会第六次会议通过2003年11月22日贵州省第十届人民代表大会常务委员会第五次会议批准)第一条为加强南明河水体、设施和景观保护,改善城市生态环境,根据有关法律法规,结合本市实际,制定本办法。

第二条南明河流域应当科学治理、加强保护、严格管理、合理开发、发挥综合效益。

第三条本办法适用于南明河花溪水库大坝至乌当大桥段和麻堤河、陈亮河、小车河、市西河、贯城河的水体、设施及两岸绿线范围内设施的保护和管理。

第四条市人民政府统一领导南明河的保护和治理,监督、协调有关区人民政府、市人民政府有关行政管理部门按照职责做好南明河的保护和管理工作;花溪、小河、南明、云岩、乌当区人民政府负责本辖区内南明河段的保护和治理,监督、协调区人民政府有关行政管理部门按照职责做好南明河的保护和管理工作。

(一)水行政管理部门负责河道、水资源开发利用、水土保持和水利设施的保护和管理;(二)城市管理行政管理部门负责市政设施、环境卫生的维护和管理,并按照职责分工负责河道的治理和保护;(三)环境保护行政管理部门负责水污染防治、水质监测的监督和管理;(四)林业绿化行政管理部门按照职责分工负责绿地的建设、保护和管理。

第二条本条例适用于本省行政区域内水利工程的管理、保护和利用。

本条例所称水利工程,是指水库、水电站、水闸、堤防、拦河坝、山塘、水池、水窖、泵站、机井、渠道等蓄水、引水、提水、供排水工程及其附属设施、设备。

城镇供排水、航运、污水处理、尾矿坝工程的管理,按照有关法律、法规规定执行。

第三条县级以上人民政府应当加强对水利工程管理和保护工作的领导,加大对水利工程管理和保护的投入,保障水利工程安全运行。

县级以上人民政府水行政主管部门主管本行政区域内水利工程的监督管理工作,具体工作由其所属的水利工程管理机构负责。

县级以上人民政府发展改革、财政、自然资源、住房和城乡建设、生态环境、农业农村、林业、公安等有关行政部门按照各自职责负责水利工程管理和保护相关工作。

乡镇人民政府、街道办事处按照职责负责本辖区内水利工程管理和保护相关工作。

水利工程所有者、管理者或者经营者负责水利工程的日常运行、维修养护和安全管理工作。

第四条鼓励农村集体经济组织、农民用水合作组织及其他组织或者个人投资兴建、持有或者经营管理小型水利工程,其合法权利受法律保护。

第二条本省行政区域内水路交通规划与建设,水路运输与水路运输服务,航道管理与维护,港口经营与管理,水上交通安全以及从事与水路交通有关的活动,适用本条例。

第三条县级以上人民政府应当加强水路交通管理,将水路交通事业纳入国民经济和社会发展规划,促进水路交通事业的发展。

县以上水路交通发展规划,由同级交通行政主管部门组织编制,征求有关部门意见,经上一级交通行政主管部门同意后,报同级人民政府审批。

第七条水路交通建设应当注重生态环境保护,符合水路交通发展规划、基本建设程序、通航技术标准和行洪安全要求。

需要使用土地的,应当依法办理有关手续。

第八条县级以上人民政府应当加大投入,加快水路交通基础设施建设和维护管理,保障水路交通安全畅通。

第二条赤水河流域规划建设、保护管理、开发利用及流域内的生产、生活等活动,应当遵守本条例。

本条例所称的赤水河流域,是指我省境内赤水河干流及其主要支流汇水面积内的水域和陆域,具体范围由省人民政府划定并向社会公布。

第三条赤水河流域保护遵循统一规划、综合管理,政府主导、社会参与,保护优先、科学开发、合理利用的原则。

第四条省人民政府与赤水河流域县级以上人民政府应当加强对赤水河流域保护工作的领导,将其纳入国民经济和社会发展规划;积极采取措施,加强生态建设和环境保护,保障流域经济社会发展与生态环境容量相适应,促进流域生态环境改善。

省人民政府有关部门与赤水河流域县级以上人民政府有关部门、乡镇人民政府,按照各自职责做好赤水河流域保护工作。

第五条赤水河流域保护实行流域管理与行政区域管理相结合的管理体制,行政区域管理应当服从流域管理。
