我国农村土地股份合作社的发展问题研究

内容摘要

土地是农业发展的基础，也是农民生活的基本保障。土地制度的完善关系到我国“三农”问题的解决。1978年以来，家庭联产承包责任制调动了农民的生产积极性，促进了我国农业生产力的提高，改善了农民的生活水平，需要继续保持。但是随着经济的发展和社会的进步，分散的小家庭生产又遇到了一些新的问题，需要加以完善。

土地股份合作社是在中国特有的经济制度下，农民自发形成的土地流转与使用形式，经过十多年的发展，它实现了在不改变家庭联产承包责任制、不改变土地所有权关系、不改变土地用途的情况下，改善农业发展状况、改善农民生活，符合“三个有利于”的是非判断标准，完善了家庭联产承包制，因而值得推广，对其发展中遇到的问题的研究也因此具有重要意义。本文从产权经济学、制度经济学的视角，采用规范分析、案例分析和系统分析的方法，对土地股份合作社在发展中遇到的问题进行了探讨。

本文第一章绪论部分主要对土地流转与土地股份合作的国内外研究情况进行了回顾；第二章介绍了土地股份合作的相关理论，包括产权理论、股份制与合作制理论、契约理论与制度变迁理论等；第三章介绍了我国农村土地股份合作社发展的成因及现状；第四章总结并提出了我国土地股份合作社发展的特点，分析了土地产权各方之间的经济关系、土地股份合作社发展的差异性与限制性；第五章分析了具有代表性的潘庄土地股份合作社的案例；第六章提出土地股份合作社中存在的产权、契约、治理方面的问题；第七章针对存在的问题从土地股份合作社自身、社会配套机制建设和国家三个角度提出对策建议。

OF CHINA’S LAND STOCKS-COOPERATIVES

IN RURAL AREAS

ABSTRACT

Farmland is the basis for the development of agriculture. It provides basically protection for farmer’s lives. The improvement of the land system is conducive to the settlement of the “Three Agriculture Problems(agriculture，countryside and farmers)”. Since 1978,the system of the unified and decentralized management on the basis of the Household Contract responsibility system have mobilized the peasants' enthusiasm for production, promoted the development of China’s agricultural productivity, and improved the living standards of farmers. It is worth to maintain. However, with the development of economics and the progress of society, the land operation of small-scale leads to some new issues. We should take some appropriate measures to perfect the Household Contract responsibility system.

Land Stock-cooperatives is chosen spontaneously by farmers, to use and circulate lands, in the specific economic and institutional condition. After the development of more than ten years, it improved agricultural production and the standers of farmers’ lives, without changing the household contract responsibility system, the relationship of land owners and the application of land. It meets the requirements of the “three benefits” and makes up the flaws of the household contract responsibility system. The search takes Property Right Economics and New System Economics as the basic theories, and adopts such methods as norm analysis, case analysis and system analysis, aims at exploring the development situation of land stock-cooperatives.

The introduction part of this article simply introduces the background and significance of this issue, the search at home and abroad, and the innovation of this paper. The second chapter introduces the theory of land stock-cooperation, including property rights theory, joint-stock cooperative theory, contract theory and institutional change theory.
