上海市房屋租赁合同

LEASE CONTRACT

出租方(甲方)【Lessor (Party A)】:_________________________________________________________ 承租方(乙方)【Lessee (Party B)】:_________________________________________________________

居间方:上海麦丰房地产经纪事务所【Mansion Real Estate Agency-Shanghai】

甲、乙双方经过友好协商一致订立本合同,以资共同遵守。

【Having reached unanimity through friendly consultation and negotiation. Party A and Party B, hereby agree to en ter into the follow ing Con tract to be abided by both parties.】

一、建筑地址【Address of Premised

甲方将其所有的位于上海市____________________________________________________________________ 的房屋在良好及可租用的状态下出租给乙方居住使用。

【Party A lets its lawfully owned premises to Party B in good and tenantable condition, located at , Shanghai for living purpose.】

二、租赁期限【Lease Term】

租赁期自________________________ 日起至________________________ 日止,甲方应于起租日之前将房屋交给乙方使用。

三、定金【Earnest Money】

1. 乙方应付的定金为人民币元整(大写:_________________ 元整),自签约日起三日内支付给甲方,

租期开始之后,上述定金转为下述第五条的保证金。

2. 在甲方收到定金(以乙方汇出日为准) 之后自租期开始之前如甲方违约,则上述定金由甲方双倍返还乙

方,如乙方违约则定金由甲方没收,且违约方须支付居间方等同于月租金数额的服务费。

【If Party A violates the Con tract after receivi ng the deposit (depe nding on the date of remitti ng from Party B) and before the lease term begins, Party A shall pay double the earnest money back to Party

B. If Party B violates the Con tract, the earn est money shall be con fiscated by Party A , and the Default

四、租金及支付方式【Rental and Method of Payment】

1. 数额【Amount】

双方议定租金为每月人民币¥(大写: ______________ 元整)。乙方以现金或银行汇款形

式支付给甲方,包含该—物业管理费/ —房屋租赁综合税。

由汇出方承担),甲方收到租金后应予以书面签收。

五、保证金【Deposit of Security]

1. 为确保房屋及其附属设施之安全与完好及租赁期内相关费用之如期结算,乙方同意支付给甲方保证金共计人民币_¥

(大写: ________________ 元整)。甲方在收到保证金后应予以书面签收。

【To en sure that the premises and its accessory facilities are safe and in good con diti on and that acco unts of releva nt fees are settled on schedule duri ng the term of lease, Party B agrees to pay to Party A ______________________________________________________________________________________ as

2. 除合同另有约定之外,甲方应于租赁关系消除且乙方保证原有房屋及设施完好,迁空,点清,并付清所有应付费用后当天将

保证金全额无息退还乙方。

【Uni ess otherwise agreed upon, the amount of deposit of security shall be refun ded by Party A without interest to Party B upon expiration of the lease, provided that Party B has vacated the premises, left everyth ing in the premises in tact and paid up all expe nses due, kept the premises and all facilities in good condition.]

3. 因乙方违反本合同的规定,而产生的违约金,损害赔偿金以及应付租金及相关费用,甲方可经乙方书面确认后在保证金中抵

扣,不足部分乙方必须在接到甲方付款通知后十天内补足。

【Any pen alty for breach of Con tract, compe nsati on for damage and ren tal and other releva nt fees payable aris ing from Party B ' s violati on ofvhepsoof the Con tract may be deducted by Party A from the deposit of security after receivi ng the writte n con firmatio n from Party B. Any shortage thereof must be made up for by Party B with in ten days of the receipt of the no tice of payme nt issued by Party A.]

4•在租赁期内,保证金不可以低用租金。

【The deposit will not be used as monthly rent during the term of lease.]

六、其他费用【Other Fees ]

乙方应承担租赁期内的水、电、煤、电信费用等一切因乙方实际使用而产生的费用,并按公共事业单位的单据如期交纳;

土地使用税,房屋维修费,物业管理费等原由甲方支付的费用,仍由甲方缴纳。

【Party B shall pay for the water, electricity and gas fees and telecommunication fees and all other fees in curred by Party B in actual use and paid bills from releva nt public service departme nt on schedule duri ng the terms of lease. The ground rent, house maintenance fee and comprehensive rental tax if necessary and management fee that were originally payable by Party A still shall be paid by Party A. ]

七、甲方的义务【Obligations of Party A ]
