华泰财产保险有限公司协会解约通知、保险自动终止及战争、核风险除外条款本条款为首要条款,本保险中任何与本条款不一致的约定,应以本条款为准。
1.解约被保险人或被保险人可提前7日通知解除承保战争等风险的保险(保险人发出或收到解除通知之日零时起7日后解除生效)。
但保险人同意当保险人与被保险人在解除通知到期之日前就新的保险费率与条款保证达成协议的,保险重新生效。
2.保险自动解除无论是否发出解约通知,当面临战争等风险时,本保险自动解除。
2.1当下列国家间爆发战争时(无论宣战与否):英国、美国、法国、俄罗斯、中国2.2本保险项下的任何船舶为所有权或使用权而被征用。
3.五大国战争与核风险除外责任本保险不承保下列风险:3.1下列事项导致的损失、损害、责任或费用:3.1.1战争爆发,无论是否宣战或在下列国家间爆发:英国、美国、法国、俄罗斯、中国3.1.2 无论为所有权或使用权的征用3.2 直接或间接由下列事项导致的损失、损害、责任或费用:3.2.1任何核燃料、核废料或核燃料燃烧所生的电离辐射或辐射污染3.2.2任何核设施、反应器或其他核子装置或其核组件的辐射、毒素、爆炸或其他危害或污染物质3.2.3任何使用原子或/和裂变、聚变或其他类似反应或辐射力或辐射物质之武器或设备。
INSTITUTE NOTICE OF CANCELLATION,AUTOMATIC TERMINATION OF COVER AND WAR AND NUCLEAR EXCLUSIONS CLAUSE –HULLSThis clause shall be paramount and shall override anything contained in this insurance inconsistent therewith1 CancellationCover hereunder in respect of the risks of war, etc. may be cancelled by either the Underwriters or the Assured giving 7 days notice (such cancellation becoming effective on the expiry of 7 days from midnight of the day on which notice of cancellation is issued by or to the Underwriters). 华泰财产保险有限公司家庭财产一切险条款总则第一条本保险合同由保险条款、投保单、保险单、保险凭证以及批单等组成。
凡涉及本保险合同的约定,均应采用书面形式。
保险标的第二条坐落或存放在本保险合同载明的地址内,属于被保险人所有的下列家庭财产均属保险标的:(一)房屋(包括固定装置于室内的附属设备,如固定装置的水暖、气暖、卫生、供水、管道煤气及供电设备、厨房配套的设备等);(二)室内装修;(三)室内财产:1、家用电器和文体娱乐用品;2、服装、床上用品;3、家具及其他生活用品;4、经保险人书面同意的其他财产。
第三条下列财产未经保险合同双方特别约定并在保险合同中载明保险价值的,不属于本保险合同的保险标的:(一)属于被保险人代他人保管或者与他人共有的第二条所列财产;(二)专业人员使用的专业用品;(三)便携式计算机设备、便携式摄像(影)器材、便携式通讯装置;(四)经保险人同意的其它财产。
第四条下列财产不属于本保险合同的保险标的范围:(一)用作商业活动的任何物品,但住所内使用的办公室设备除外;(二)各种自行车、机动车(及其附件)、摩托车、船、发动机或其他运输工具;(三)金钱或信用卡;(四)艺术品或贵重物品;(五)电子数据;(六)数码电子产品、音像制品、笔、打火机、眼镜、手包;(七)任何动物、植物;(八)土地或水;(九)政府有关部门征用、占用的房屋,违章建筑、危险建筑、非法占用的财产以及投保时正处于紧急危险状态下的财产。
保险责任第五条在保险期间内,由于自然灾害或意外事故造成保险标的直接物质损坏或灭失(以下简称“损失”),保险人按照本保险合同的约定负责赔偿。
前款原因造成的保险事故发生时,为抢救保险标的或防止灾害蔓延,采取必要的、合理的措施而造成保险标的的损失,保险人按照本保险合同的约定也负责赔偿。
第六条保险事故发生后,被保险人为防止或减少保险标的的损失所支付的必要的、合理的费用,保险人按照本保险合同的约定也负责赔偿。
责任免除第七条下列原因造成保险标的的损失和费用,保险人不负责赔偿:(一)投保人、被保险人及其家庭成员、服务人员、寄居人员的故意行为;(二)战争、敌对行为、军事行为、武装冲突、罢工、骚乱、暴动、恐怖活动;(三)核辐射、核爆炸、核污染及其他放射性污染;(四)地震、海啸;(五)行政行为或司法行为;(六)大气污染、土地污染、水污染及其他各种污染,但因本保险合同责任范围内的事故造成的污染不在此限;(七)家用电器因超负荷使用、超电压、短路、断路、漏电、自身发热、自燃等原因所造成的自身损毁;(八)用芦苇、稻草、油毛毡、麦杆、芦席、帆布等材料为外墙、屋顶、屋架的简陋屋棚以及堆放在露天及罩棚、简陋屋棚下的财产,由于暴风暴雨等恶劣天气所造成的损失;(九)保险标的的内在或潜在缺陷、自然磨损、自然损耗,大气(气候或气温)变化、正常水位变化或其他渐变原因,物质本身变化、霉烂、受潮、鼠咬、虫蛀、鸟啄、氧化、锈蚀、渗漏、烘焙;(十)坐落在蓄洪区、防洪区、或在江河岸边、低洼地区以及防洪堤以外当地常年警戒水位线以下的财产,由于洪水所造成的一切损失;(十一)保险标的因施工、安装、装修不善、建筑物沉降、正常维修、擅自改变房屋结构引起的任何损失或费用。

华泰财产保险有限公司国际航行条款1、航行限制除非保险人按下列第三条内容另行同意,否则船舶不可在任何时候(或在以下特别注明的日期内)驶入、航行于或停留在下述区域内:区域一:北极圈北纬70度以北巴仑支海区域二:北方海域若船舶不驶入、航行于或停留在北纬72度30分以北/东经35度以东,可以挂靠科拉湾摩尔曼斯克或挪威的任何港口或地点:白海楚可其海(西伯利亚东北部)区域三:波罗的海12月10日至5月25日之间,波的尼亚湾(芬兰和瑞典之间)北纬63度50分的Umea和北纬63度06分的Vasa一线以北;小于等于90000载重吨的船舶,12月15日至5月15日之间,芬兰湾东经28度45分以东;大于90000载重吨的船舶,任何时间均不得驶入、航运于或停留在芬兰湾东经28度45分以东;1月8日至5月5日之间,波的尼亚湾、芬兰湾及临近水域北纬59度24分以北,挂靠斯德哥尔莫(瑞典首都)、塔林(爱沙尼亚首都)或赫尔辛基(芬兰首都)除外;12月28日至5月5日里加湾及临近水域东经22度以东,北纬59度以南。
区域四:格陵兰岛格陵兰岛领海区域五:北美(东部)西经50度至100度之间,北纬52度10分以北;12月21日至4月30日之间,圣劳伦斯湾、圣劳伦斯河及其支流(Les Escoumins 以东),贝尔岛海峡(贝尔岛以西),卡伯特海峡(雷角及诺斯角一线以西)及Canso 海峡(Canso堤道以北);12月1日至4月30日之间,圣劳伦斯河及其支流(Les Escoumins以西);圣劳伦斯水道;大湖区。
区域六:北美(西部)西经100度至170度之间,北纬54度30分以北;夏洛特皇后群岛或阿留申群岛的任何港口或地区。
区域七:南部海域南纬50度以南,以下三点用罗盘确定的三角区域除外:南纬50度西经50度;南纬57度西经67度30分;南纬50度西经160度。

This insurance is subject to English law and practice1 NAVIGATION1.1 The Vessel is covered subject to the provisions of this insurance at all times and has leave to sail or navigate with or without pilots, to go on trial trips and to assist and tow vessels or craft in distress, but it is warranted that the Vessel shall not be towed, except as is customary or to the first safe port or place when in need of assistance, or undertake towage or salvage services under a contract previously arranged by the Assured and/or Owners and/or Managers and/or Charterers. This Clause 1.1, shall not exclude customary towage in connection with loading and discharging,1.2 In the event of the Vessel being employed in trading operations which entail cargo loading or discharging at sea from or into another vessel (not being a harbour or inshore craft) no claim shall be recoverable under this insurance for loss of or damage to the Vessel or liability to any other vessel arising from such loading or discharging operations, including whilst approaching, lying alongside and leaving, unless previous notice that the Vessel is to be employed in such operations has been given to the Underwriters and any amended terms of cover and any additional premium required by them have been agreed.1.3 In the event of the Vessel sailing (with or without cargo) with an intention of being (a) broken up, or (b) sold for breaking up, any claim for loss of or damage to the Vessel occurring subsequent to such sailing shall be limited to the market value of the Vessel as scrap at the time when the loss or damage is sustained, unless previous notice has been given to the Underwriters and any amendments to the terms of cover insured value and premium required by them have been agreed. Nothing in this Clause 1.3 shall affect claims under Clauses 8 and/or 11.2 CONTINUATIONShould the Vessel at the expiration of this insurance be at sea or in distress or at a port of refuge or of call, she shall, provided previous notice be given to the Underwriters, be held covered at a pro rata monthly premium to her port of destination.3 BREACH OF WARRANTYHeld covered in case of any breach of warranty as to cargo, trade, locality towage, salvage services or date of sailing, provided notice be given to the Underwriters immediately after receipt of advices and any amended terms of cover and any additional premium required by them be agreed.4 TERMINATIONThis Clause 4 shall prevail notwithstanding any provision whether written typed or printed in this insurance inconsistent therewith.Unless the Underwriters agree to the contrary in writing, this insurance shall terminate automatically at the time of4.1 change of the Classification Society of the Vessel, or change, suspension, discontinuance, withdrawal or expiry of her Class therein, provided that if the Vessel is at sea such automatic termination shall be deferred until arrival at her next port. However where such change, suspension, discontinuance or withdrawal of her Class has resulted from loss or damage covered by Clause 6 of this insurance or which would be covered by an insurance of the Vessel subject to current Institute War and Strikes Clauses Hulls-Time such automatic termination shall only operate should the Vessel sail from her next port without the prior approval of the Classification Society.4.2 any change, voluntary or otherwise, in the ownership or flag, transfer to new management, or charter on a bareboat basis, or requisition for title or use of the Vessel, provided that, if the Vessel has cargo on board and has already sailed from her loading port or is at sea in ballast, such automatic termination shall if required be deferred, whilst the Vessel continues her planned voyage, until arrival at final port of discharge if with cargo or at port of destination if in ballast. However in the event a requisition for title or use without the priorexecution of a written agreement by the Assured, such automatic termination shall occur fifteen days after such requisition whether the Vessel is at sea or in port. A pro rata daily net return of premium shall be made.5 ASSIGNMENTNo assignment of or interest in this insurance or in any moneys which may be or become payable thereunder is to be binding on or recognised by the Underwriters unless a dated notice of such assignment or interest signed by the Assured, and by the assignor in the case of subsequent assignment, is endorsed on the Policy and the policy with such endorsement is produced before payment of any claim or return of premium thereunder.6 PERILS6.1 This insurance covers loss of or damage to the subject-matter insured caused by6.1.1. perils of the seas rivers lakes or other navigable waters6.1.2 fire, explosion6.1.3 violent theft by persons from outside the Vessel6.1.4 jettison6.1.5 piracy6.1.6 breakdown of or accident to nuclear installations or reactors6.1.7 contact with aircraft or similar objects, or objects falling therefrom, land conveyance, dock or harbour equipment or installation6.1.8 earthquake volcanic eruption or lightning.6.2 This insurance covers loss of or damage to the subject-matter insured caused by6.2.1 accidents in loading discharging or shifting cargo or fuel6.2.2 bursting of boilers breakage of shafts or any latent defect in the machinery or hull6.2.3 negligence of Master Officers Crew or Pilots6.2.4 negligence of repairers or charterers provided such repairers or charterers are not an Assured hereunder6.2.5 barratry of Master Officers or Crewprovided such loss or damage has not resulted from want of due diligence by the Assured, Owners or Managers.6.3 Master Officers Crew or Pilots not to be considered Owners within the meaning of this Clause 6 should they hold shares in the Vessel7 POLLUTION HAZARDThis insurance covers loss of or damage to the Vessel caused by any governmental authority acting under the powers vested in it to prevent or mitigate a pollution hazard, or threat thereof, resulting directly from damage to the Vessel for which the Underwriters are liable under this insurance, provided such act of governmental authority has not resulted from want of due diligence by the Assured, the Owners, or Managers of the Vessel or any of them to prevent or mitigate such hazard or threat. Master, Officers, Crew or Pilots not to be considered Owners within the meaning of this Clause 7 should they hold shares in the Vessel.8 3/4THS COLLISION LIABILITY8.1 The Underwriters agree to Indemnify the Assured for three-fourths of any sum or sums paid by the Assured to any other person or persons by reason of the Assured becoming legally liable by way of damages for8.1.1. loss of or damage to any other vessel or property on any other vessel8.1.2 delay to or loss of use of any such other vessel or property thereon8.1.3 general average of, salvage of, or salvage under contract of, any such other vessel orproperty thereon, where such payment by the Assured is in consequence of the Vessel hereby insured coming into collision with any other vessel.8.2 The indemnity provided by this Clause 8 shall be in addition to the indemnity provided by the other terms and conditions of this insurance and shall be subject to the following provisions:8.2.1 Where the insured Vessel is in collision with another vessel and both vessels are to blame then, unless the liability of one or both vessels becomes limited by law, the indemnity under this Clause 8 shall be calculated on the principle of cross-liabilities as if the respective Owners had been compelled to pay to each other such proportion of each other's damages as may have been properly allowed in ascertaining the balance or sum payable by or to the Assured in consequence of the collision,8.2.2 In no case shall the Underwriters' total liability under Clauses 8.1 and 8.2 exceed their proportionate part of three-fourths of the insured value of the Vessel hereby insured in respect of any one collision.Exclusions8.4 Provided always that this Clause 8 shall in no case extend to any sum which the Assured shall pay for or in respect of8.4.1 removal or disposal of obstructions, wrecks, cargoes or any other thing whatsoever8.4.2 any real or personal property or thing whatsoever except other vessels or property on other vessels8.4.3 the cargo or other property on, or the engagements of, the insured Vessel8.4.4 loss of life, personal injury or illness8.4.5 pollution orcontamination of any real or personal property or thing whatsoever (except other vessels with which the insured Vessel is in collision or property on such other vessels).8.3 The Underwriters will also pay three-fourths of the legal costs incurred by the Assured or which the Assured may be compelled to pay in contesting liability or taking proceedings to limit liability with the prior written consent of the Underwriters.9 SISTERSHIPShould the Vessel hereby insured come into collision with or receive salvage services from another vessel belonging wholly or in part to the same Owners or under the same management, the Assured shall have the same rights under this insurance as they would have were the other vessel entirely the property of Owners not interested in the Vessel hereby insured; but in such cases the liability for the collision or the amount payable for the services rendered shall be referred to a sole arbitrator to be agreed upon between the Underwriters and the Assured.10 NOTICE OF CLAIM AND TENDERS10.1 In the event of accident whereby loss or damage may result in a claim under this insurance, notice shall be given to the Underwriters prior to survey and also, if the Vessel is abroad, to the nearest Lloyd's Agent so that a surveyor may be appointed to represent the Underwriters should they so desire.10.2 The Underwriters shall be entitled to decide the port to which the Vessel shall proceed for docking or repair (the actual additional expense of the voyage arising from compliance with the Underwriters. requirements being refunded to the Assured) and shall have a right of veto concerning a place of repair or a repairing firm.10.3 The Underwriters may also take tenders or may require further tenders to be taken for the repair of the Vessel. Where such a tender has been taken and a tender is accepted with the approval of the Underwriters, an allowance shall be made at the rate of 300fo per annum on the insured value for time lost between the despatch of the invitations to tender required by Underwriters and the acceptance of a tender to the extent that such time is lost solely as the result of tenders having been taken and provided that the tender is accepted without delay after receipt of the Underwriters' approval. Due credit shall be given against the allowance as above for any amounts recovered in respect of fuel and stores and wages and maintenance of the Master Officers and Crew or any member thereof, including amounts allowed in general average, and for any amounts recovered from third parties in respect of damages for detention and/or loss of profit and/or running expenses, for the period covered by the tender allowance or any part hereof, Where a part of the cost of the repair of damage other than a fixed deductible is not recoverable from the Underwriters, the allowance shall be reduced by a similar proportion.10.4 In the event of failure to comply with the conditions of this Clause 10 a deduction of 15% shall be made from the amount of the ascertained claim.11 GENERAL AVERAGE AND SALVAGE11.1 This insurance covers the Vessel's proportion of salvage, salvage charges and/or general average, reduced in respect of any under-insurance, but in case of general average sacrifice of the Vessel the Assured may recover in respect of the whole loss without first enforcing their right of contribution from other parties.11.2 Adjustment to be according to the law and practice obtaining at the place where the adventure ends, as if the contract of affreightment contained no special terms upon the subject: but where the contract of affreightment so provides the adjustment shall be according to theYork-Antwerp Rules.11.3 When the Vessel sails in ballast, not under charter the provisions of the York-Antwerp Rules, 1974 (excluding Rules XX and XXI) shall be applicable, and the voyage for this purpose shall be deemed to continue from the port or place of departure until the arrival of the Vessel at the first port or place thereafter other than a port or place of refuge or a port or place of call for bunkering only If at any such intermediate port or place there is an abandonment of the adventure originally contemplated the voyage shall thereupon be deemed to be terminated.11.4 No claim under this Clause 11 shall in any case be allowed where the loss was not incurred to avoid or in connection with the avoidance of a peril insured against.12 DEDUCTIBLE12.1 No claim arising from a peril insured against shall be payable under this insurance unless the aggregate of all such claims arising out of each separate accident or occurrence (including claims under Clauses 8,11 and 13) exceeds _________________ in which case this sum shall be deducted. Nevertheless the expense of sighting the bottom after stranding, if reasonably incurred specially for that purpose, shall be paid even if no damage be found, This Clause 12,1 shall not apply to a claim for total or constructive total loss of the Vessel or in the event of such a claim, to any associated claim under Clause 13 arising from the same accident or occurrence.12.2 Claims for damage by heavy weather occurring during a single sea passage between two successive ports shall be treated as being due to one accident. In the case of such heavy weather extending over a period not wholly covered by this insurance the deductible to be applied to the claim recoverable hereunder shall be the proportion of the above deductible that the number of days of such heavy weather falling within the period of this insurance bears to the number of days of heavy weather during the single sea passage, The expression "heavy weather" in this Clause 12.2 shall be deemed to include contact with floating ice.12.3 Excluding any interest comprised therein, recoveries against any claim which is subject to the above deductible shall be credited to the Underwriters in full to the extent of the sum by which the aggregate of the claim unreduced by any recoveries exceeds the above deductible.12.4 Interestcomprised in recoveries shall be apportioned between the Assured and the Underwriters, taking into account the sums paid by the Underwriters and the dates when such payments were made, notwithstanding that by the addition of interest the Underwriters may receive a larger sum than they have paid.13 DUTY OF ASSURED (SUE AND LABOUR)13.1 In case of any loss or misfortune it is the duty of the Assured and their servants and agents to take such measures as may be reasonable for the purpose of averting or minimising a loss which would be recoverable under this insurance.13.2 Subject to the provisions below and to Clause 12 the Underwriters will contribute to charges properly and reasonably incurred by the Assured their servants or agents for such measures. General average, salvage charges (except as provided for in Clause13,5) and collision defence or attack costs are not recoverable under this Clause 13.13.3 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.13.4 When expenses are incurred pursuant to this Clause 13 the liability under this insurance shall not exceed the proportion of such expenses that the amount insured hereunder bears to the value of the Vessel as stated herein, or to the sound value of the Vessel at the time of the occurrence giving rise to the expenditure if the sound value exceeds that value, Where the Underwriters have admitted a claim for total loss and property insured by this insurance is saved, the foregoing provisions shall not apply unless the expenses of suing and labouring exceed the value of such property saved and then shall apply only to the amount of the expenses which is in excess of such value.13.5 When a claim for total loss of the Vessel is admitted under this insurance and expenses have been reasonably incurred in saving or attempting to save the Vessel and other property and there are no proceeds, or the expenses exceed the proceeds, then this insurance shall bear its pro rata share of such proportion of the expenses, or of the expenses in excess of the proceeds, as the case may be, as may reasonably be regarded as having been incurred in respect of the Vessel; but if the Vessel be insured for less than its sound value at the time of the occurrence giving rise to the expenditure, the amount recoverable under this clause shall be reduced in proportion to the under-insurance.13.6 Thesum recoverable under this Clause 13 shall be In addition to the loss otherwise recoverable under this insurance but shall in no circumstances exceed the amount insured under this insurance in respect of the Vessel.14 NEW FOR OLDClaims payable without deduction new for old.15 BOTTOM TREATMENTIn no case shall a claim be allowed in respect of scraping gritblasting and/or other surface preparation or painting of the Vessel's bottom except that15.1 gritblasting and/or other surface preparation of new bottom plates ashore and supplying and applying any "shop" primer thereto,15.2 gritblasting and/or other surface preparation of: the butts or area of plating immediately adjacent to any renewed or refitted plating damaged during the course of welding and/or repairs, areas of plating damaged during the course of fairing, either in place or ashore, 15.3 supplying and applying the first coat of primer/anti-corrosive to those particular areasmentioned in 15.1 and 15.2 above, shall be allowed as part of the reasonable cost of repairs in respect of bottom plating damaged by an insured peril.16 WAGES AND MAINTAINANCENo claims shall be allowed, other than in general average, for wages and maintenance of the Master Officers and Crew, or any member thereof except when incurred solely for the necessary removal of the Vessel from one port to another for the repair of damage covered by the Underwriters, or for trial trips for such repairs, and then only for such wages and maintenance as are incurred whilst the Vessel is under way.17 AGENCY COMMISSIONIn no case shall any sum be allowed under this insurance either by way of remuneration of the Assured for time and trouble taken to obtain and supply information or documents or in respect of the commission or charges of any manager, agent. managing or agency company orthe like, appointed by or on behalf of the Assured to perform such services.18 UNREPAIRED DAMAGE18.1 Themeasure of indemnity In respect of claims for unrepaired damage shall be the reasonable depreciation in the market value of the Vessel at the time this insurance terminates arising from such unrepaired damage, but not exceeding the reasonable cost of repairs.18.2 In nocase shall the Underwriters be liable for unrepaired damage In the event of a subsequent total loss (whether or not covered under this insurance) sustained during the period covered by this insurance or any extension thereof.18.3 The Underwriters shall not be liable in respect of unrepaired damage for more than the insured value at the time this insurance terminates.19 CONSTRUCTIVE TOTAL LOSS19.1 In ascertaining whether the Vessel is a constructive total loss, the insured value shall be taken as the repaired value and nothing in respect of the damaged or break-up value of the Vessel or wreck shall be taken into account.19.2 No claim for constructive total loss based upon the cost of recovery and/or repair of the Vessel shall be recoverable hereunder unless such cost would exceed the insured value. In making this determination, only the cost relating to a single accident or sequence of damages arising from the same accident shall be taken into account.20 FREIGHT WAIVERIn the event of total or constructive total loss no claim to be made by the Underwriters for freight whether notice of abandonment has been given or not.21 DISBURSEMENT WARRANTY21.1 Additional insurances as follows are permitted:21.1.1. Disbursements, Managers’Commissions, Profits or Excess or increased Value of Hull and Machinery. A sum not exceeding 25% of the value stated herein.21.1.2 Freight, Chartered Freight or Anticipated Freight, insured for time. A sum not exceeding 25% of the value as stated herein less any sum insured, however described, under 21.1.1.21.1.3 Freight, or Hire, under contracts for voyage. A sum not exceeding the gross freight or hire for the current cargo passage and next succeeding cargo passage (such insurance to include, if required, a preliminary and an intermediate ballast passage) plus the charges of insurance. In the case of a voyage charter where payment is made on a time basis, the sum permitted for insurance shall be calculated on the estimated duration of the voyage, subject to the limitation of two cargo passages as laid down herein. Any sum insured under 21.1.2 to be taken into account and only the excess thereof may be insured, which excess shall be reduced as the freight or hire is advanced or earned by the gross amount so advanced or earned.21.1.4 Anticipated Freight if the Vessel sails in ballast and not under Charter. A sum not exceeding the anticipated gross freight on next cargo passage, such sum to be reasonably estimated on the basis of the current rate of freight at time of insurance plus the charges of insurance. Any sum insured under 21.1.2 to be taken into account and only the excess thereof may be insured21.1.5 Time Charter Hire or Charter Hire for Series of Voyages. A sum not exceeding 50% of the gross hire which is to be earned under the charter in a period not exceeding 18 months. Any sum insured under 21,1,2 to be taken into account and only the excess thereof may be insured, which excess shall be reduced as the hire isadvanced or earned under the charter by 50% of the gross amount so advanced or earned but the sum insured need not be reduced while the total of the sums insured under 21.1.2 and 21.1.5 does not exceed 50% of the gross hire still to be earned under the charter An insurance under this Section may begin on the signing of the charter.21.1.6 Premiums. A sum not exceeding the actual premiums of all interests insured for a period not exceeding 12 months (excluding premiums insured under the foregoing sections but including, if required, the premium or estimated calls on any Club or War etc. Risk insurance) reducing pro rata monthly.21.1.7 Returns of Premium. A sum not exceeding the actual returns which are allowable under any insurance but which would not be recoverable thereunder in the event of a total loss of the Vessel whether by insured perils or otherwise.21.1.8 Insurance irrespective of amount insured against:Any risks excluded by Clauses 23, 24, 25 and 26 below.21.2 Warranted that no insurance on any interests enumerated in the foregoing 21.1.1 to 21.1.7 in excess of the amounts permitted therein and no other insurance which includes total loss of the Vessel P P.I., F I.A., OI subject to any other like term, is or shall be effected to operate during the currency of this insurance by or for account of the Assured, Owners, Managers or Mortgagees, Provided always that a breach of this warranty shall not afford the Underwriters any defence to a claim by a Mortgagee who has accepted this insurance without knowledge of such breach.22 RETURNS FOR LAY-UP AND CANCELLATION22.1 To return as follows:22.1.1 Pro rata monthly net for each uncommenced month if this insurance be cancelled by agreement.22.1.2 For each period of 30 consecutive days the Vessel may be laid up in a port or in a lay-up area provided such port or lay-up area is approved by the Underwriters (with special liberties as hereinafter allowed)(a) per cent not under repair(b) per cent under repairIf the Vessel is under repair during part only of a period for which a return is claimable, the return shall be calculated pro rata to the number of days under (a) and (b) respectively.22.2 PROVIDED ALWAYS THAT22.2.1 a total loss of the Vessel, whether by insured perils or otherwise, has not occurred during the period covered by this insurance or any extension thereof.22.2.2 in no case shall a return be allowed when the Vessel is lying in exposed or unprotected waters, or in a port or lay-up area not approved by the Underwriters but, provided the Underwriters agree that such non-approved lay-up area is deemed to be within the vicinity of the approved port or lay-up area, days during which the Vessel is laid up in such non-approved lay-up area may be added to days in the approved port or lay-up area to calculate a period of 30 consecutive days and a return shall be allowed for the proportion of such period during which the Vessel is actually laid up in the approved port or lay-up area.22.2.3 loading or discharging operations or the presence of cargo on board shall not debar returns but no return shall be allowed for any period during which the Vessel is being used for the storage of cargo or for lightening purposes.22.2.4 in the event of any amendment of the annual rate, the above rates of return shall be adjusted accordingly.22.2.5 in the event of any return recoverable under this Clause 22 being based on 30 consecutive days which fall on successive insurances effected for the same Assured, this insurance shall only be liable for an amount calculated at pro rata of the period rates 22.1.2 (a) and/or (b) above for the number of days which come within the period of this insurance and to which a return is actually applicable. (2)清除渗漏污染物质的费用,其中包括防止该物质接近海岸的费用。

华泰财产保险有限公司华泰财产保险有限公司旅行取消保险条款旅行取消保险条款总则总则第一条本保险合同(以下简称本合同)由保险单及其他保险凭证、所附条款、投保单等与本合同有关的投保文件、合法有效的声明、批注、附贴批单、其他书面协议构成。
第二条被保险人为在预订本合同约定的旅行产品或相关旅行服务时,实际支付预付费用或提供信用卡担保的一方。
第三条投保人为被保险人本人。
保险责任保险责任第四条在本条款保险期间内,被保险人在预订行程后且旅客出发前,因发生下列事故之一导致旅客取消原定旅程,对被保险人已预先支付,但是其未能实际进行原定行程而无法退回之旅行交通、住宿、旅行社及其他本保险合同明确列明的旅行产品的费用,保险人按照本保险合同约定负责赔偿。
投保人可以选择投保以下第(一)或/和第(二)项保险责任,分别设定保险金额,具体以保险单载明为准。
(一)非自身原因损失。
1、旅客身故、遭遇意外伤害事故导致严重受伤或罹患突发性重病,当地医院医生诊断不能或不宜继续原定行程;2、旅客的直系亲属身故、遭遇意外伤害事故导致严重受伤或罹患突发性重病;3、旅客或其配偶在投保人投保前并不知悉,在投保后才被诊断出怀孕,且经当地医院医生诊断不能或不宜继续原定行程;4、旅客或其配偶因妊娠并发症,且经当地医院医生诊断不宜继续原定行程;5、旅客被劫持、绑架或被非法拘禁;6、在出发首日之前7天内,旅客预订乘坐的公共交通工具承运人雇员突发罢工,且因此导致无法继续原定行程;7、在出发首日之前7天内,旅客的旅行出发地或目的地突发暴动、民间骚乱、流行疫病或大规模流行疫病,不宜继续原定行程;8、在出发首日之前7天内,旅客的旅行出发地或目的地国家旅游局、外交部或其他国家权威机构已发布了针对旅行目的地的相关警告,不宜继续原定行程;9、在出发首日之前7天内,旅客的旅行出发地或目的地发生5级以上地震,无法继续原定行程;10、在出发首日之前7天内,旅客的旅行出发地或目的地气象部门发布自然灾害预警信号,不宜继续原定行程;11、在出发首日之前7天内,旅客因日常居住地的家庭财产遭受火灾、爆炸、自然灾害、室内管道破裂或被盗窃抢劫导致严重损失,不宜继续原定行程;12、目的地居住场所发生恐怖袭击活动且同时满足下列条件:(1)恐怖袭击活动发生地距离旅客目的地居住场所所在地方圆150公里以内;(2)恐怖袭击活动发生在旅客出发首日之日前30天内;(3)旅行出发地或目的地政府已经对此类恐怖袭击活动发布过警告的。

球场(俱乐部)应克尽职责防止出售或提供不洁或不符合卫生标准的食品或饮料。
、野生动物侵害责任22、野生动物侵害责任在保险单中列明的地点范围内,进入球场(俱乐部)的消费球员或来宾及服务过程中的球童遭受野生动物侵害造成的人身伤亡、或消费球员及来宾的财产损失时球场(俱乐部)依法应负的赔偿责任,保险人在保险单中列明的赔偿限额内进行赔偿。
球场(俱乐部)用克尽职责防止野生动物侵害事故的发生。
对于人身伤亡事故产生的球场(俱乐部)球童的医疗费用,本保险仅负责对超出当地社会保险应付部分在保险单中列明的赔偿限额内按条款赔偿。
、球车事故责任3、球车事故责任3在保险单中列明的地点范围内,由于球场(俱乐部)在经营过程中,发生球车翻倒或球车碰撞事故造成进入球场(俱乐部)的消费球员或来宾及服务过程中的球童遭受人身伤亡,或消费球员及来宾的财产损失时球场(俱乐部)依法应负的赔偿责任。
球场(俱乐部)须提供事故的现场照片。
对于人身伤亡事故产生的球场(俱乐部)球童的医疗费用,本保险仅负责对超出当地社会保险应付部分在保险单中列明的赔偿限额内按条款赔偿。
4、闪电雷击伤害责任、闪电雷击伤害责任4在保险单中列明的地点范围内,进入球场(俱乐部)的消费球员或来宾及服务过程中的球童由于闪电雷击造成的人身伤亡、或消费球员及来宾的财产损失时球场(俱乐部)依法应负的赔偿责任,保险人在保险单中列明的赔偿限额内进行赔偿。
对于人身伤亡事故产生的球场(俱乐部)球童的医疗费用,本保险仅负责对超出当地社会保险应付部分在保险单中列明的赔偿限额内按条款赔偿。
5、一杆进洞费用5、一杆进洞费用在保险单中列明的金额内,保险人对进场消费球员“一杆进洞”引起的费用进行补偿。

华泰财产保险股份有限公司华泰关爱家庭财产定额保险条款家庭财产保险条款总 则第一条 本保险合同由投保单、保险条款、保险单、保险凭证以及批单组成。
凡涉及本保险合同的约定,均应采用书面形式。
第一条组成保险合同的各文件之间相互解释、相互补充,如有冲突,除非另有约定,以前述排列在后的文件中的约定或解释为准。
保险标的第二条 本合同保险标的为坐落或存放在本保险合同上载明的地点内,属于被保险人所有的下列家庭财产:第二条(一)房屋(包括固定装置于室内的附属设备,如固定装置的水暖、气暖、卫生、供水、管道煤气及供电设备、厨房配套的设备等)、室内装修;(二)室内财产:1、家用电器和文体娱乐用品;2、服装、床上用品;3、家具及其他生活用品;第三条第三条 下列财产未经保险合同双方特别约定并在保险合同中载明保险价值的,不属于本保险合同的保险标的:(一)属于被保险人代他人保管或者与他人共有的第二条所列财产;(二)专业人员使用的专业用品;(三)便携式电脑、摄像(影)器材;(四)经保险人同意的其它财产;第四条 下列财产不属于本保险合同的保险标的范围:第四条(一)金银、珠宝、钻石及制品、玉器、首饰、邮票、古玩、古书、字画、工艺品、稀有金属及制品等贵重物品;(二)现钞、票据、有价证券、文件、档案、帐册、图表、书籍、技术资料、计算机软件及数据以及无法鉴定价值的财产;(三)无线通讯工具、数码电子产品、音像制品、笔、打火机、手表、眼镜、手包;(四)拖拉机、农用机械及用于工商业生产、经营活动的财产;(五)动物、植物;(六)日用消耗品、化妆护肤品、交通工具;(七)政府有关部门征用、占用的房屋,违章建筑、危险建筑、非法占用的财产以及投保时正处于紧急危险状态下的财产;(八)不属本保险条款第二条、第三条所列的家庭财产。
保险责任第五条 在保险期间内,由于下列原因造成保险标的的损失,保险人按照本保险合同的约定负责赔偿:第五条(一)火灾、爆炸;(二)暴雨、暴风、雷击、台风、龙卷风、洪水、雹灾、雪灾、地面突然塌陷、崖崩、冰凌、泥石流;(三)空中运行物体的坠落,以及保险合同列明地点外的建筑物或其它固定物体的倒塌;第六条 保险事故发生后,被保险人为防止或减少保险标的的损失所支付的必要的、合理的费用,保险人按照本保险合同的约定也负责赔第六条偿。

(3) 提供已收到的书面赔偿要求、法院传票及其它法律文书的复印 件;及
(4) 其他与确认赔偿请求的性质、原因、损失程度等有关的证明和 资料。
2. 被保险人如在保险期间内获悉任何可赔情形,应在可行的情况下立 即以书面形式通知保险人,其后与该可赔情形相关的赔偿请求应被 视为被保险人在保险期间内首次遭受的赔偿请求。所有可赔情形通 知必须包括: (1) 对可赔情形的具体描述,包括发生何种不当行为、发生不当行 为的日期及首次知悉可赔情形的日期; (2) 所有当事人的详细资料;及 (3) 被保险人认为可能遭受赔偿请求的理由。
第二十二条 索赔通知
1. 对于被保险人在保险期间内遭受的赔偿请求,投保人或被保险 人应在可行的情况下立即以书面形式通知保险人,如果本保险合同 已届满,则不得迟于届满后的 30 天内以书面形式通知保险人。所 有索赔通知必须包括:
(1) 对赔偿请求的具体描述,包括发生何种不当行为、发生不当行 为的日期及首次知悉赔偿请求的日期;

保险金额和保险费
第九条 保险金额是保险人承担给付保险金责任的最高限额。保险金额由投保人、保险人双方约定,并在保险单中载明。投保人应 该按照合同约定向保险人交纳保险费。保险人和投保人可以在本保险合同项下约定免赔额等限制条件,并于保险合同中载明。
保险费依据保险金额与保险费率计收,并于保险合同上载明。除合同另有约定外,投保人应于约定的缴费日期一次性缴清保险费。 投保人若未按约定足额交纳保险费,保险人对其实际足额支付之日前发生的保险事故,不承担相应的保险责任。
2、 翻译推荐服务 提供旅行目的地翻译服务的地址、电话、及开放时间等信息。 3、 行李遗失协寻 协助在境外旅行期间遗失行李的被保险人,联络相关负责单位帮助寻找。 4、 护照遗失协寻 协助在境外旅行期间遗失护照的被保险人,联络相关负责单位帮助寻找或补办。 5、 使领馆信息 提供距被保险人最近的适宜的大使馆或领事馆的地址、电话及开放时间等信息。 6、 紧急讯息传递服务 被保险人在境外旅行期间住院且提出要求时,协助被保险人将其紧急口讯转告家人、朋友或任职单位。

华泰财产保险有限公司协会船舶营运费用和增值定期保险条款一、航行1、保险船舶在任何时候按本保险的各项规定承保,允许在有或没有引航员的情况下开航或航行、试航、和协助、拖带遇难船舶,但保证保险船舶不得被他船拖带,除非是习惯性的或需要协助拖至第一安全港口或地点,也不得根据被保险人、船东、船舶管理人和/或租船人事先安排的合同从事拖带或救助服务,但本款不排除与装卸有关的习惯拖带。
2、保险船舶用于在海上将货物从本船装卸到另一条船或从另一条船装卸到本船的商业行为(不包括另一在港内的船或近岸的小船),由于此种装卸作业,包括两船驶近、并排停靠和驶离,造成保险船舶的损失或损害以及对他船的责任,本保险不负责赔偿,除非船舶在从事这种作业前,已事先通知了保险人,并且双方同意了修改的承保条件和增加保险费。
3、如果保险船舶的开航(不论有无载货)旨在(a)拆船或(b)为拆船而出售,那么对保险船舶在如此开航后发生的任何损失或损害,保险人不负责赔偿,除非已事先通知了保险人,并已同意了修改承保条件、保险价值和保险人要求的保险费。
二、延续本保险期满时,如果保险船舶尚在海上,或在避难中,或在避难港,或在中途港,那么只要事先通知保险人,并按月比例支付超期保险费后,本保险继续负责承保至抵达其目的港为止。
三、违反保证当任何有关货物、航线、船位、拖带、救助服务或开航日期的保证被违反时,若被保险人接到消息后迅速通知保险人,并同意修改承保条款和加付所需的保险费,则保险仍然有效。
四、终止本保险的任何条款,不论是手写的、打印的还是印刷的,若与本条相抵触时,均以本条为准。
除非保险人有书面同意相反的规定外,本保险在下列情况下自动终止:1、保险船舶的船级社变更,或者其船级变更、暂停、中止、撤回或期限届满时,但如果船舶尚在海上航行,该自动终止可延迟至船舶抵达下一个港口时。
然而,如果此种船级变更、暂停、中止或撤回是由本保险第6条承保的损失或损害造成的,或者是由根据现行协会船舶战争险和罢工险定期承保条款承保的损失或损害引起的,此种自动终止仅于船舶未经船级社事先同意在下一港口开航时才发生效力。
2、无论是否自愿,保险船舶变更船舶所有权或船旗、转让给新的管理人、光船出租或被征购、征用时,但如果船上载有货物并已从装货港开航,或在海上空载航行时,经要求,此种船舶自动终止应延迟,直至船舶继续其计划航行,载货船到达最后卸货港时为止,空载船舶到达目的港时为止。
但是,如果征购、征用没有事先与被保险人签订书面协议,那么不论船舶是在海上还是在港内,保险责任的终止将在船舶被征购或征用后15天开始生效。
保险费的净收入按日比例退回。
五、转让本保险下的利益的转让,或以金钱支付的利益的转让,保险人概不承认,也不受这种转让的约束。
但如果被保险人在发生任何索赔或退还保险费之前就在这种转让通告书上注明了日期并签署,以及以后转让人在保险单上背书这种转让,则保险人给予赔偿。
六、危险1、本保险承保由于下列原因所造成的保险标的的灭失或损坏:(1)海上、江河、湖泊或其他可航水域的灾害;(2)火灾、爆炸;(3)来自保险船舶外的人员暴力盗窃;(4)抛弃货物;(5)海盗;(6)核装置或核反应堆发生的故障或意外事故;(7)与航空器或类似装置及从其上坠落的物体,和与陆上传送设备、码头、港口设备或装置的触碰;(8)地震、火山爆发或闪电。
2、本保险承保由于下列原因所造成的保险标的的灭失或损坏:(1)装卸、移动货物或燃料过程中发生的意外事故;(2)锅炉破裂、尾轴断裂或机器、船体的任何潜在缺陷;(3)船长、高级船员、船员或引航员的疏忽;(4)被保险人以外的修船人员或承租人的疏忽行为;(5)船长、高级船员、船员的不法行为。
如果此种灭失或损坏并非由于被保险人、船东或管理人缺乏谨慎处理所致。
3、船长、高级船员、船员或引航员对保险船舶拥用股权的,不被视为本条(第6条)意义上的船东。
4、本保险承保:(1)共同海损、救助和救助费用之根据船壳和机器保险未能全部补偿的部分,其产生是由于保险船舶的保险价值(或在评定索赔过程中按承保船壳和机器保险的法律、惯例或条款要求予以扣减后减少了的价值)低于保险船舶的共同海损、救助或救助费用的分摊价值而存在差额,保险人按照本保险的保险金额与这个差额的比例,或在承保超额责任的保险金额的总和超过这个差额时,按照本保险的保险金额与保险金额的总和比例,支付上述未能补偿的部分。
(2)施救费用之根据船壳和机器保险未能全部补偿的部分,其产生是由于保险船舶的保险价值低于为确定根据船壳和机器保险的补偿额采用的保险船舶价值而存在差额,保险人按照本保险的保险金额与这个差额的比例,或在承保超额责任的保险金额的总和超过这个差额时,按照本保险的保险金额与保险金额的总和的比例,支付上述未能全部补偿的部分。
(3)碰撞责任(3/4)之根据船壳和机器保险中协会3/4碰撞责任和姐妹船条款未能全部补偿的部分,其产生是由于此种3/4碰撞责任超过了保险船舶的 3/4保险金额而存在差额,保险人按照本保险的保险金额与承保超额责任的保险金额的总和的比例,支付上述差额。
5、保险人分别根据第六条4款(1)、(2)和(3)项下的责任,在一次索赔中,不超过本保险的保险金额。
七、污染危险本保险承保由于任何政府当局以其权力为防止或减轻因保险船舶应由保险人负责的全损直接引起的污染危险或其威胁采取的行动造成的保险船舶全损(实际全损或推定全损),如果政府当局的这种行动不是由于保险船舶的被保险人、船东或管理人或其中任何人在防止或减少此种污染或威胁方面缺乏谨慎处理所致。
船长、高级船员、船员或引航员对保险船舶拥有股权的,不被视为在本条(第7条)意义上的船东。
八、索赔通知在发生意外事故所造成的灭失或损坏可能导致保险赔偿时,被保险人应在船舶检验之前通知保险人,如果船舶在国外,则应通知最近地区的劳合社代理人,以便保险人在认为需要时委派检验人代表保险人进行检验。
九、推定全损1、在确定保险船舶是否构成推定全损时,船壳和机器保险中的保险价值应作为船舶修理后的价值,不应考虑保险船舶的受损或解体价值或残骸。
2、基于保险船舶的恢复和/或修理费用的推定全损索赔不应得到赔偿,除非此笔费用会超过保险价值。
在作此项决定时,应仅考虑与单一次事故或由于同一事故引起后续损害赔偿有关的费用。
3、如果船壳和机器保险中包含现行协会船舶定期保险条款的推定全损条款或类似效果的条款,船壳和机器保险争议中协商确定的按推定全损处理应视为保险船舶推定全损的证据。
4、假若保险船舶构成推定全损,但其船壳和机器保险按部分损失处理,保险人根据本条不承担赔偿责任。
十、协议全损在船壳和机器保险中索赔全损或推定全损而达成按协议达成全损或推定全损的情况下,本保险按船壳和机器保险中相同的赔付比例,支付本保险的保险金额。
十一、停泊和解约时的退费1、按照下列规定退还保险费:(1)本保险经协议同意解除时,每一未开始的月份的净保险费按月比例退还。
(2)船舶在保险人同意的港口内或闲置水域连同下文规定的特别准许停泊时,若每次连续停泊30天,则按下列办法计算退回保险费:(a)未进行修理的,按 %计算;(b)进行修理的,按 %计算;如果保险船舶修理期间,仅部分时间属于可退费期,退费应分另按照以上(a)、(b)两项中的日数比例计算。
2、但尚需符合下列条件:(1)在本保险的保险期间内或其延续期间内未发生保险船舶的全损,不论是否是由承保危险造成的。
(2)若保险船舶停泊在暴露或无防护的水域,或停泊于未经保险人认可的港口或锚泊水域,则不予退费,但是如果保险人同意将此种未被认可的停泊港口或水域视为在认可的停泊港口或水域的范围内,则在此种未被认可的港口或水域内停泊期间的天数可以加上在认可的港口或水域内的天数以构成一次连续停泊30天,而退费仍限于在认可的港口或水域内停泊天数所占的比例部分。
(3)装卸作业或船上有货物不应影响退费,但保险船舶被用作储藏或驳运货物的任何期间,不允许退费。
(4)年保险费率修改时,上述保险费退回率也应作相应的调整。
(5)根据本条可得到的退费基于连续30天停泊期,包括在同一被保险人投保的数个连续保险时,本保险仅负责按照上述第1款第2项(a)小项或(b)小项规定的退费率对于本保险的保险期间内的实际停泊天数占总停泊天数比例计算出来的退费。
被保险人有权选择此种重叠期应自被保险人船舶闲置的第一天开始起算或自上述本条第1款第2项(a)小项或(b)小项或本条第2款第2项规定的连续30天停泊期间的第一天开始起算。
下列各条具有最高效力,本保险中任何与下列各条不一致的规定,均属无效。
十二、战争责任免除在任何情况下,本保险不承保由于下列原因引起的损失、损害、责任或费用:1、战争、内战、革命、造反、叛乱、或由此引起的内乱,或任何交战方之间的敌对行为;2、捕获、扣押、扣留、拘禁或羁押(船长或船员的恶意行为和海盗行为除外),以及这些行为所引起的后果或进行这些行为的企图;3、被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。
十三、罢工责任免除在任何情况下,本保险不承保由于下列原因引起的损失、损害、责任或费用:1、罢工者,被迫停工工人,或参加工潮、暴乱或民变的人员。
2、任何恐怖分子或出于政治动机的人员。
十四、恶意行为责任免除在任何情况下,本保险不承保恶意地或出于政治动机而行为的人员造成的由以下原因引起的损失、损害、责任或费用:1、炸药爆炸。
2、任何战争武器。
十五、核武器责任免除在任何情况下,本保险不承保由于应用原子或核裂变和/或聚变或其他类似反应或放射力量或物质所制造的战争武器所造成的灭失、损害、责任或费用。
Institute Time Clauses—Hulls Disbursements And Increased Value (Total loss only, including Excess Liabilities) 1 NA VIGATION1.1The subject-matter insured is covered subject to the provisions of this insurance at all times and the Vessel has leave to sail or navigate with or without pilots, to go on trial trips and to assist and tow vessels or craft in distress, but it is warranted that the Vessel shall not be towed or salvage services under a contract previously arranged by the Assured and/or Owners and/or Managers and/or Charterers. This Clause 1.1 shall not exclude customary towage in connection with loading and discharging.1.2In the event of the Vessel being employed in trading operations which entail cargo loading or discharging at sea from or into another vessel (not being a harbour or inshore craft)no claim shall be recoverable under this insurance in respect of loss of or damage to the subject-matter insured or for liability to any other vessel arising from such loading or discharging, including whilst approaching, lying alongside and leaving, unless previous notice that the Vessel is to be employed in such operations has been given to the Underwriters, and any amended terms of cover and any additional premium required by them have been agreed.1.3In the event of the Vessel sailing(with or without cargo)with an intention of being(a) broken up, or(b)sold for breaking up, no claim shall be recovered under this insurance in respect of loss or damage to the Vessel occurring subsequent to such sailing unless previous notice has been given to the Underwriters and any amendments to the terms of cover, amount insured and premium required by them have been agreed.2CONTINUATIONShould the Vessel at the expiration of this insurance be at sea or in distress or refuge or of call, the subject-matter insured shall, provided previous notice be given to the underwriters, be held covered at a pro rata monthly premium to her port of destination.3BREACH OF WARRANTYHeld covered in case of any breach of warranty as to cargo, locality, trade, towage, salvage services or date of sailing, provided notice be given to the Underwrites immediately after receipt of advices and any amended terms of cover and any additional premium required by them be agreed.4TERMINATIONThis Clause 4 shall prevail notwithstanding any provision whether written typed or printed in this insurance inconsistent therewith. Unless the Underwriters agree to the contrary in writing, this insurance shall terminate automatically at the time of4.1change of the Classification Society of the Vessel, or change, suspension, discontinuance, withdrawal or expiry of her Class therein, provided that if the Vessel is at sea such automatic termination shall be deferred until arrival at her next port. However where such change, suspension, discontinuance or withdrawal of her Class has resulted from loss or damage which would be covered by an insurance of the Vessel subject to current Institute Time Clauses Hulls or Institute War and Strikes Clauses Hulls-Time such automatic termination shall only operate should the Vessel sail from her next port without the prior approval of the Classification Society.4.2any change, voluntary or otherwise, in the ownership or flag, transfer to new management, or charter on a bareboat basis, or requisition for title or use of the Vessel, provided that, if theVessel has cargo on board and has already sailed from her loading port or is at sea in ballast, such automatic termination shall if required be deferred, whilst the Vessel continues her voyage, until arrival at final port of discharge if with cargo or at port of destination if in ballast. However, in event of requisition for title or use without the prior execution of a written a agreement by the Assured, such automatic termination shall occur fifteen days after such requisition whether the Vessel is at sea or in port.A pro rata daily net return of premium shall be made.5ASSIGNMENTNo assignment of or interest in this insurance or in any moneys which may be or become payable thereunder is to be binding on or recognized by the Underwriters unless a dated notice of such assignment or interest signed by the Assured, and by the assignor in the case of subsequent assignment, is endorsed on the Policy and the Policy with such endorsement is produced before payment of any claim or return of premium thereunder.6PERILS6.1This insurance coves total loss (actual or constructive) of the subject-matter insured caused by6.1.1perils of the seas rivers lakes or other navigable waters6.1.2fire, explosion6.1.3violent theft by person from outside the Vessel6.1.4jettison6.1.5piracy6.1.6breakdown of or accident to nuclear installations or reactors6.1.7contact with aircraft or similar object, or object falling therefrom land conveyance, dock or harbour equipment or installation6.1.8earthquake volcanic eruption or lightning6.2This insurance coves total loss (actual or constructive) of the subject-matter insured caused by6.2.1accidents in loading discharging or shifting cargo or fuel6.2.2bursting of boilers breakage of shafts or any latent defect in the machinery or hull 6.2.3negligence of Master Officers Crew or Pilots6.2.4negligence of repairs or charterers provided such repairs or charterers are not an Assured hereunder6.2.5barratry of Master Officers or Crew, provided such loss or damage has not resulted from want of due diligence by the Assured, Owners or Managers.6.3Master Officers Crew or Pilots not to be considered Owners within the meaning of this Clause 6 should they hold shares in the Vessel.6.4This insurance covers:6.4.1General Average, Salvage and Salvage Charges not recoverable in full under the insurance on hull and machinery by reason of the difference between the insured value of the vessel as stated therein(or any reduced value arising from the deduction therefrom in process of adjustment of any claim which law or practice or the terms of the insurances covering hull and machinery have required)and the value of the Vessel adopted for the purpose of contribution to general average, salvage or salvage charges, the liability under this insurance being for such proportion of the amount not recoverable as the amount insured hereunder bears to the said difference or to the total sum insured against excess liabilities if it exceed such difference.6.4.2Sue and Labour Charges not recoverable in full under the insurances on hull and machinery by reason of the difference between the insured value of the Vessel as stated therein and the value of the Vessel adopted for the purpose of ascertaining the amount recoverable under the insurance on hull and machinery, the liability under this insurance being for such proportion of the amount not recoverable as the amount insured hereunder bears to the said difference or to the total sum insured against excess liabilities if it exceed such difference.6.4.3Collision Liability (three-fourths) not recoverable in full under the 3/4ths Collision Liability and Sistership Clauses in the insurance on hull and machinery by reason of such three-fourths liability exceeding three-fourths of the insured value of the vessel as stated therein, in which case the amount recoverable under this insurance shall be such proportion of the difference so arising as the amount insured hereunder bears to the total sum insured against excess liabilities.6.5The Underwriters’ liability under 6.4.1,6.4.2and 6.4.3 separately, in respect of any one claim, shall not exceed the amount insured hereunder.7POLLUTION HAZARDThis insurance covers total loss(actual and constructive) of the Vessel caused by any governmental authority acting under the powers vested in it to prevent or mitigate a pollution hazard, or threat thereof, resulting directly from damage to the Vessel caused by a peril covered by this insurance, provided such act of governmental authority has not resulted from want of due diligence by the Assured, the Owners ,or Managers of the Vessel or any of them to prevent or mitigate such hazard or threat. Master, Officers, Crew or Pilots not to be considered Owners within the meaning of this Clause 7 should they hold shares in the Vessel.8NOTICE OF CLAIMIn the event of accident whereby loss or damage may result in a claim under this insurance, notice shall be given to the Underwriters prior to survey and also, if the V essel is abroad, to the nearest Lloyd’s Agent so that a surveyor may be appointed to represent the Underwriters should they so desire.9 CONSTRUCTIVE TOTAL LOSS9.1 In ascertaining whether the Vessel is a constructive total loss, the insured value in the insurance on hull and machinery shall be taken as the repaired value and nothing in respect of the damaged or break-up value of the Vessel or wreck shall be taken into account.9.2 No claim for constructive total loss based upon the cost of recovery and/or repair of the Vessel shall be recoverable hereunder unless such cost would exceed the insured value in the insurance on hull and machinery. In making this determination, only the cost relating to a single accident or sequence of damages arising from the same accident shall be taken into account.9.3 Provided that the Constructive Total Loss Clause in the current Institute Time Clauses Hulls or a clause having a similar effect is contained in the insurance on hull and machinery, the settlement of a claim for constructive total loss thereunder shall be accepted as proof of the constructive total loss of the Vessel.9.4 Should the V essel be a constructive total loss but the claim on the insurance on hull and machinery be settled as a claim for partial loss, no payment shall be due under this Clause 9.10COMPROMISED TOTAL LOSSIn the event of a claim for total loss or constructive total loss being settled on the insurances on hull and machinery as a compromised total loss the amount payable hereunder shall be the same percentage of the amount insured as is paid on the said insurances.11RETURN FOR LAY-UP AND CANCELLATIONTo return as follows:Pro rata monthly net for each uncommenced month if this insurance be cancelled by agreement.For each period of 30 consecutive days the Vessel may be laid up in a port or in a lay-up area provided such port or lay up area is approved by the Underwrites (with special liberties as hereinafter allowed.(a)………………….per cent net not under repair(b)………………….per cent net under repair11.2 PROVIDED ALWAYS THAT11.2.1 a total loss of the Vessel, whether by insured perils or otherwise, has not occurred duringthe period covered by this insurance or any extension thereof11.2.2 in no case shall a return be allowed when the Vessel is lying in expose or unprotected waters, or in a port or lay-up area not approved by the Underwriters but , provided the Underwriters agree that such non-approved lay-up area is deemed to be within the vicinity of the approved port or lay-up area, days during which the Vessel is laid up in such non-approved lay-up area may be added to days in the approved port or lay-up area to calculate a period of 30 consecutive days and a return shall be allowed for the proportion of such period during which the Vessel is actually laid up in the approved port or lay-up area11.2.3 loading or discharging operations or the presence of cargo on board shall not debar returns but no return shall be allowed for any period during which the Vessel is being used for the storage of cargo or for lightering purposes11.2.4 in the event of any amendment of the annual rate, the above rates of return shall be adjusted accordingly11.2.5 in the event of any return recoverable under this Clause 11 being based on 30 consecutive days which fall on successive insurances effected for the same Assured, this insurance shall only be liable for an amount calculated at pro rata of the period rates 11.1.2(a)and/or(b)above for the number of days which come within the period of this insurance and to which a return is actually applicable. Such overlapping period shall run, at the option of the Assured, either from the first day on which the Vessel is laid up or the first day of a period of 30 consecutive days as provided under 11.1.2(a)or (b),or 11.2.2above.The following clauses shall be paramount and shall override anything contained in this insurance inconsistent therewith.12WAR EXCLUSIONIn no case shall this insurance cover loss damage liability or expense caused by12.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power12.2 capture seizure arrest restraint or detainment (barratry and piracy excepted),and the consequences thereof or any attempt thereat12.3 derelict mines torpedoes bombs or other derelict weapons of war.13STRIKES EXCLUSIONIn no case shall this insurance cover loss damage liability or expense caused by13.1 strikes, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions13.2 any terrorist or any person acting from a political motive.14MALICIOUS ACTS EXCLUSIONIn no case shall this insurance cover loss damage liability or expense arising from14.1 the detonation of an explosive14.2any weapon of warand caused by any person acting maliciously or from a political motive.15 NUCLEAR EXCLUSIONIn no case shall this insurance cover loss damage liability or expense arising from any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.。
