1999年高等院校扩招以来，随着高校的招生规模不断扩大，高等教育开始从精英化向大众化转化，高等教育走上了跨越式发展的道路。随之而来的是高校在管理上的自主权不断加大，高校办学规模不断扩大，采购、建设、教学等投入的资金越来越多，参与的经济活动也越来越频繁，导致高校正受到社会不正之风和腐败现象的影响。高等学校作为培养国家栋梁之才的摇篮，是传播人类文明的知识殿堂。这个被视为“圣洁殿堂”的学府正遭受“腐败之痛”。在刚刚过去的2010年，南京市检察机关在南京高校中立案查处12人，也是2010年，武汉大学原副校长陈昭方、原党委副书记龙小乐被立案查处。高校职务犯罪的危害远远超过了普通的职务犯罪，不仅给高校的稳定带来了损害，而且严重损害高校的形象，导致社会对高校的信任危机，使公众丧失对教育的信仰，其恶果将影响到整个民族的发展。

本文目的是希望高等教育主管部门、高校及纪检部门加大对高校职务犯罪的预防工作，对高校职务犯罪的新发展要引起重视，防微杜渐，从体制上去消灭滋生职务犯罪的温床。

本文的创新之处在于根据最新司法解释对高校职务犯罪的内涵进行界定，将教师的教学活动排除在高校职务犯罪之外；分析当前高校职务犯罪频发与社会转型期高校的跨越式发展以及高校教师职业现状的关系；总结归纳了高校职务犯罪窝案串案增多、校级领导职务犯罪增多、犯罪涉及领域更加广泛等新特点，对高校职务犯罪在招生领域及学术领域的发展进行了阐述。本文综合运用文献研究法、比较研究法和抽样分析法等方法，分析了高校职务犯罪的内涵、涉案领域及特点；结合案例，将引发高校职务犯罪的因素分为时代客观因素和高校内部管理体制因素；归纳总结了高校职务犯罪的新特点，并对高校职务犯罪新类型进行了阐述；从高校内部和高校外部两个角度入手，对高校职务犯罪的预防和惩治提出了针对性的对策。

Development

Abstract

Since the colleges and universities expand their enrollment in 1999, the higher education, with the expanding enrollment amount in the colleges and universities, began to transform from elite education to popular education, achieving a great-leap-forward development. However, the colleges and universities are affected by the social unhealthy tendency and corruption due to increasing autonomous rights on management, expanding educational scale and increasing investment in purchase, construction, teaching, etc. and frequent participation in economic activities. The colleges and universities are cradles of educating the pillars of nation as well as the palaces of knowledge to spread human civilization. Although they are regarded as the “Holy and Pure Palaces”, they are suffering the “Evil Consequence of Corruption”. Just in 2010, Nanjing procuratorate put on record, investigated and punished 12 people in the colleges and universities of Nanjing. Also in 2010, the former vice-president of Wuhan University Chen Zhaofang and the former Party committee vice-secretary Long Xiaole were put on record, investigated and punished. The harm of duty crimes in colleges and universities far surpasses common duty crimes, seriously harming both stability and image of colleges and universities, resulting in the crisis of confidence of the society in the colleges and universities, losing public belief in education and adversely affecting the development of the entire nation. This thesis aims that the competent department of higher education, colleges and universities and disciplinary inspection department can strengthen the preventive works against duty crimes in colleges and universities and attach great importance to its new development, guarding against gradual creeping corruption and wiping out the hotbed breeding duty crimes on the basis of system.

It is innovated by this thesis that the connotation of duty crimes in colleges and universities is defined in accordance with the up-to-date judicial interpretation, excluding the teachers’teaching activities from the duty crimes in colleges and universities; it analyzes the relation between the current frequent occurrence of duty crimes in colleges and universities and the great-leap-forward development of colleges and universities during the social transitional period and the current situation of profession of teachers in colleges and universities; it summarizes and concludes the new characteristics of
