CHAPTER1GENERALPROVISIONS
Article1
ThisLawhasbeenformulatedinordertoimprovetheemploymentcontractsystem,tospecifytherightsand obligationsofthepartiestoemploymentcontracts,toprotectthelawfulrightsandinterestsofEmployeesandtobui ldanddevelopharmoniousandstableemploymentrelationships.

ThisLawgovernstheestablishmentofemploymentrelationshipsbetween,andtheconclusion,performan ce,amendment,terminationandendingofemploymentcontractsby,organizationssuchasenterprises,individu aleconomicorganizationsandprivatenon-enterpriseunitsinthePeople’sRepublicofChina(“Employers”)onthe onehandandEmployeesinthePeople’sRepublicofChinaontheotherhand.
Theconclusion,performance,amendment,terminationandendingofemploymentcontractsbystateauth orities,institutionsorsocialorganizationsontheonehandandEmployeeswithwhomtheyestablishemploymentr elationshipsontheotherhand,shallbehandledpursuanttothisLaw.

Theconclusionofemploymentcontractsshallcomplywiththeprinciplesoflawfulness,fairness,equality,fr
eewill,negotiatedconsensusandgoodfaith.
Alawfullyconcludedemploymentcontractisbinding,andboththeEmployerandtheEmployeeshallperfor
mtheirrespectiveobligationsstipulatedtherein.
Article4
Employersshallestablishandimproveinternalrulesandregulations,soastoensurethatEmployeesenjoy
theirlaborrightsandperformtheirlaborobligations.
WhenanEmployerformulates,revisesordecidesonrulesandregulations,ormaterialmatters,thathavea directbearingontheimmediateinterestsofitsEmployees,suchasthoseconcerningcompensation,workhours,r est,leave,worksafetyandhygiene,insurance,benefits,employeetraining,workdisciplineorworkquotamanage ment,thesameshallbediscussedbytheemployeerepresentativecongressoralltheemployees.Theemployeer epresentativecongressoralltheemployees,asthecasemaybe,shallputforwardaproposalandcomments,whe reuponthemattershallbedeterminedthroughconsultationswiththeTradeunionoremployeerepresentativesco
nductedonabasisofequality.
If,duringtheimplementationofanEmployer’sruleorregulationordecisiononacrucialmatter,theTradeuni onoranemployeeisoftheopinionthatthesameisinappropriate,itorheisentitledtocommunicatesuchopiniontot heEmployer,andtherule,regulationordecisionshallbeimprovedbymakingamendmentsafterconsultations.
Rulesandregulations,anddecisionsonmaterialmatters,thathaveadirectbearingontheimmediateintere stsofEmployeesshallbemadepublicorbecommunicatedtotheEmployeesbytheEmployer.

ThelaboradministrationauthoritiesofPeople’sGovernmentsatthecountylevelandabove,togetherwitht heTradeunionandenterpriserepresentatives,shallestablishacomprehensivetri-partitemechanismforthecoo rdinationofemploymentrelationships,inordertojointlystudyandresolvemajorissuesconcerningemploymentr
elationships.

ATradeunionshallassistandguideEmployeesintheconclusionofemploymentcontractswiththeirEmplo yerandtheperformancethereofinaccordancewiththelaw,andestablishacollectivebargainingmechanismwith theEmployerinordertosafeguardthelawfulrightsandinterestsofEmployees.
CHAPTER2CONCLUSIONOFEMPLOYMENTCONTRACTS

AnEmployer’semploymentrelationshipwithaEmployeeisestablishedonthedateitstartsusingtheEmplo yee.AnEmployershallkeeparegisterofemployees,forreferencepurposes.
Article8
WhenanEmployerhiresaEmployee,itshalltruthfullyinformhimastothecontentofthework,theworkingco nditions,theplaceofwork,occupationalhazards,productionsafetyconditions,laborcompensationandotherma tterswhichtheEmployeerequeststobeinformedabout.TheEmployerhastherighttolearnfromtheEmployeeba sicinformationwhichdirectlyrelatestotheemploymentcontract,andtheEmployeeshalltruthfullyprovidethesa
me.
Article9
WhenhiringaEmployee,anEmployermaynotretaintheEmployee’sresidentIDcardorotherpapers,norm ayitrequirehimtoprovidesecurityorcollectpropertyfromhimundersomeotherguise.
Article10
Toestablishanemploymentrelationship,awrittenemploymentcontractshallbeconcluded.
Intheeventthatnowrittenemploymentcontractwasconcludedatthetimeofestablishmentofanemployme ntrelationship,awrittenemploymentcontractshallbeconcludedwithinonemonthafterthedateonwhichtheEmpl
oyerstartsusingtheEmployee.
WhereanEmployerandaEmployeeconcludeanemploymentcontractbeforetheEmployerstartsusingth eEmployee,theemploymentrelationshipshallbeestablishedonthedateonwhichtheEmployerstartsusingtheE
mployee.

IntheeventthatanEmployerfailstoconcludeawrittenemploymentcontractwithaEmployeeatthetimeitsst artstousehim,anditisnotclearwhatlaborcompensationwasagreeduponwiththeEmployee,thelaborcompens
