Back in October 1998, with the NBA in a lockout, Michael Jordan—still a player and a member of the union—heard Washington owner Abe Pollin complain about losing money and responded, “If you can't make a profit, you should sell your team.”That taunt has been frequently cited lately, as Jordan—now on the other side of the table as owner of the Bobcats—has emerged as a villain of this lockout, one of the hardline owners who stand as the biggest obstacles to a deal that would end the labor stalemate. Jordan can’t make a profit in Charlotte, and now, union executive director Billy Hunter says, “I would give him the advice that he gave to Abe Pollin, OK? That is the advice I would give him. He should take his own advice.”Indeed, he should, because if one thing came out of the four-and-a-half hour meeting held by 43 members of the union—including 29 of the 30 team representatives—it is this: By going to a 50-50 split of league revenues, down from the 57-43 split the players used to enjoy, the union feels it has given up enough to allow cry-poor owners like Jordan to be profitable. Many players were calling for the 50-50 offer to be put to a vote, and the consensus seemed to be that it had a chance at passing. If the league is claiming drastic financial losses, the players have certainly done enough to address those concerns.What players were shown in the meeting was the extent to which the system would be altered—that teams going over the luxury tax threshold would be punished heavily financially, that they would not be able to conduct sign-and-trade deals, that they would have limited ability to use a midlevel exception. They emerged fully aware that they had already lost badly on the economics of this de al but determined to call the owners’ bluff on system issues. The NBA insists it needs system changes to ensure better competitive balance, but the union is asserting it has made enough concessions to improve that balance.Players want to have the choice to join teams that are willing to spend. Either way, the league will be getting more competitive balance, it’s just a matter of how much more. If this is to be a 50-50 deal, the intricacies of the system matter only in terms of how much freedom players have when they become free agents. Players are going to get the same aggregate salary no matter what.“Keep in mind, the percentages that we’re talking about here, the reduction in BRI for players, are unprecedented,” Fisher said. “We’ve, by far, made the move we needed to make on the economics to put our teams in much better places, to increase franchise values, to increase profitability for, if not everybody, darn close to everybody. We made compromises we needed to make on percentage points of BRI and economics. Now it is now time for the NBA to make compromises on the system within the percentage points.”NBA players should certainly be given a deal on which to vote before the league rolls back its offer to 47 percent, a threat that figures to put the rest of the season in jeopardy.
