Preamble
THE STATES PARTIES TO THE PRESENT CONVENTION,
CONSCIOUS of the fact that wrecks, if not removed, may pose a hazard to navigation or the marine environment,
10 “Affected State” means the State in whose Convention area the wreck is located.
11 “State of the ship’s registry” means, in relation to a registered ship, the State of registration of the ship and, in relation to an unregistered ship, the State whose flag the ship is entitled to fly.
2 “Ship” means a seagoing vessel of any type whatsoever and includes hydrofoil boats, air-cushion vehicles, submersibles, floating craft and floating platforms, except when such platforms are on location engaged in the exploration, exploitation or production of seabed mineral resources.

2. 目的和范围本协议的目的是规范船舶污染处置的程序和要求,确保船舶所有人、船员和相关机构遵守相关法规和标准,减少对海洋环境的污染。
本协议适用于所有进入本国港口的国内外船舶以及在本国领海、专属经济区和大陆架范围内从事海上作业的船舶。
3. 船舶污染处置的基本原则(1)预防原则: 在船舶出航前,船舶所有人必须确认所有污染源均已得到有效的管理和控制,并制定相应的预防措施。
(2)处置原则: 船舶在航行中产生的废水、废油和废气等污染物必须按照相关法规和标准进行妥善处理和处置。
(3)合作原则: 船舶所有人、船员和相关机构应积极配合当地港口管理部门,并与其他国家和地区的相关机构开展合作,共同推进船舶污染处置工作。
4. 船舶污染处置的具体要求(1)废水处理:船舶应该安装和使用符合国际和国内标准的污水处理设备,对船舶的污水进行处理后排放。
在接受污水处理的港口应加强监管,确保船舶污水排放的合规性。
(2)废油处理:船舶产生的废油应分别按照废油和洗涤液进行处置。
船舶应建立完善的废油、废液管理系统,确保废油不被随意排放。
同时,港口管理部门应加强监管,定期检查船舶的废油管理记录。
(3)废气处理:船舶发动机和锅炉产生的废气应符合国际和国内的大气排放标准,船舶应安装和使用相应的废气处理设备。
同时,应确保在靠泊期间船舶的主机和锅炉停机,以减少无效废气的排放。
(4)污染源监测:船舶应安装合适的污染源监测设备,监测船舶排放的废水、废油和废气等污染物的浓度和排放量。
并应及时向港口管理部门提交相关的监测数据和报告。
5. 处罚和奖励措施(1)处罚措施: 对违反相关规定的船舶,将依法给予相应的处罚,包括罚款、吊销船舶证书等。

Party A must accredit Party B to receive and dispose the oil sludge and wastes from all vessels of Party B calling at SHANGHAI ports. Party A can’t accredit others to receive and dispose the above-mentioned.2、甲方船舶需要排放污油水,应提前二天将船名、到港时间、排放量通知乙方,以便乙方完成必要之前置作业。

2. 海面油污:清除该船舶周围海面的油污,包括使用吸油材料、喷洒消油剂等方法。
3. 岸线油污:清除该船舶靠泊的岸线的油污,包括使用高压水枪、清洁剂等方法。
二、油污清除服务时间乙方应在接到甲方通知后的______小时内到达现场,并开始进行油污清除服务。
乙方应在______天内完成油污清除服务,并将清除后的油污妥善处理。
三、油污清除服务费用1. 油污清除服务费用为人民币______元(大写______元整)。
2. 甲方应在乙方完成油污清除服务后的______天内支付油污清除服务费用。
四、双方的权利和义务1. 甲方的权利和义务(1)甲方有权要求乙方按照本协议的约定提供油污清除服务。
(2)甲方应向乙方提供该船舶的相关资料和信息,包括但不限于船舶证书、船员名单、油舱布置图等。
(3)甲方应协助乙方进行油污清除服务,包括但不限于提供必要的设备和工具、安排船员配合等。
(4)甲方应按照本协议的约定支付油污清除服务费用。

1.租期上述出租人同意出租,上述承租人同意租用上述船舶,从交船时起算,租期为,并在下述航行区域内使用船舶。

在交船时,船舶应作好接受货物的准备,货舱须打扫干净,船体紧密,坚实,牢固,并在各个方面适合于普通货物的运输。
船舶应装备有压载水舱,同时具有启动所有装货设备的足够的动力。
出租人应在 ---- 天之前向承租人递交预计交付船舶的日期的通知。
3.交船/还船检验除另有约定外,在交船和还船前,双方当事人应自负费用指定各自的验船师,分别在船舶到达第一个装货港/ 最后一个卸货港之前进行交船/还船联合检验,以确定船上所存的燃油量和船舶状态。

4.2 服务费用的支付方式、时间和条件由双方另行商定。
第五条甲方的权利和义务5.1 甲方有权要求乙方按照约定提供服务,并有权监督服务的实施情况。
5.2 甲方应按照约定支付服务费用,并提供必要的协助和信息。
第六条乙方的权利和义务6.1 乙方有权按照约定收取服务费用,并要求甲方提供必要的协助。
6.2 乙方应保证服务的质量和效率,及时响应甲方的需求。
第七条违约责任7.1 如一方违反本协议约定,应承担违约责任,并赔偿对方因此遭受的损失。
7.2 违约责任的具体内容由双方根据违约情况另行协商确定。
第八条争议解决8.1 双方因履行本协议所发生的争议,应首先通过协商解决。

The Agreement adopts fourteen numbers as its serial number (such as 01-1001-2011-0001), amongst which the first two numbers represent the code of a MSA directly under the P.R China MSA; the third number represents the qualification level of the ship pollution response organization, 1, 2, 3 and 4 respectively represents level-1, level-2, level-3 and level-4; the fourth to sixth number represents the code of the ship pollution response organization and shall be determined by the MSA directly under the P.R China MSA; the seventh to tenth represents the year in which the Agreement is concluded; the eleventh to the fourteenth represents the sequence number of the Agreement and shall be determined by the ship pollution response organization. In accordance with relevant provisions of the Contract Law of the People’s Republic of China, the Marine Environment Protection Law of the People’s Republic of China, the Regulations of the People’s Republic of China on Administration of the Prevention and Control of Marine Environment Pollution from Ships(hereinafter referred to as “the Regulations”), the Regulations of the People’s Republic of China on Emergency Preparedness and Response on Marine Environment Pollution from Ships (hereinafter referred to as “the Rules”) and the Detailed Rules of Maritime Safety Administration of the People’s Republic of China on the Implementation of the Administration Regime of Agreement for Ship Pollution Response (hereinafter referred to as “the Detailed Rules”) and other laws and regulations, Party A and Party B agree to reach the following agreement after equal consultation and on the basis of truthfully and/or completely expressing respective intentions, and the said agreement shall be abided by both Party A and Party B.
