摘要

正当防卫是国家通过刑法赋予公民的一项重要权利，是一种作为公力救济重要补充形式的私力救济权。文章从正当防卫的源起与发展出发，借鉴国外正当防卫制度，对我国正当防卫进行更加深入的思考和探究以达到正确理解正当防卫本质、探讨了正当防卫与人权的紧密联系、并对正当防卫的体系问题作出思考，以促进我国正当防卫制度的不断完善。文章具体分为三个部分：

第一部分：正当防卫制度的沿革

该部分阐述了正当防卫的历史渊源。并得出结论：正当防卫制度的发展进程与人类社会从人治到法治社会的历史进程基本是同步演进。然而，它又是不断随着社会的变化而不断变化的，并一步步走向完善。

第二部分：正当防卫的概念和意义

该部分对正当防卫的概念做出了解释，即正当防卫是为了使公共利益、本人或者他人的人身和其他权利免受正在进行的不法侵害，而采取的正当防卫行为，不负刑事责任。

第三部分：正当防卫制度的拓展性思考

该部分从正当防卫的本质：权利与权力的统一、正当防卫与人权保障、正当防卫的体系性思考三个部分对正当防卫制度进行了思考，并形成了一定分析。

Abstract

Justifiable defense is an important right granted by the state through criminal law, and it is a kind of private relief right, which is an important supplement form of public power relief. From the origin and development of the justifiable defense and referring to foreign justifiable defense system and the self-defense of China for more in-depth thinking and inquiry in order to achieve the correct understanding of the essence of justifiable defense, discusses the legal defence and human rights closely linked, and to the justifiable defense system thinking, in order to promote the continuous improvement of the justifiable defense system in China. This article is divided into three parts:

The first part: the evolution of the justifiable defense system

This part expounds the historical origin of justifiable defense. And draws the conclusion: justifiable defense system of the development process of human society from the rule of man to the historical process of the society ruled by law is the basic synchronous evolution. However, it is constantly changing with the change of society, and a step by step to improve.

The second part: the concept and significance of justifiable defense

Explain the concept of the part of justifiable defense, namely justifiable defense is to make the public interests, or his own or other people and other rights from being infringed upon, and take the behavior of self-defense, not bear criminal responsibility.

The third part: the expansion of the justifiable defense system

This part from the essence of justifiable defense: the unity of right and power, justifiable defense and protection of human rights, the justifiable defense system on three parts to the justifiable defense system thinking, and the formation of a certain analysis.
