The right to die

Introduction:

The Court first addressed the issue of the right to die is in the 1990 case of Cruzan v. Director, Missouri Department of Health. Although eight of nine justices disagreed,but it indeedly concluded that the right to die was a liberty protected by the Due Process Clause, the majority of the Court upheld the state's insistence upon clear and specific evidence that the patient would wish to have intravenous feeding discontinued. Later, additional evidence of Nancy's wishes was discovered and feeding was discontinued, leading to her death.

A debate exists within bioethics over whether the right to die is universal, or only applies under certain circumstances—such as terminal illness.

Definition

The right to die is the ethical or institutional entitlement of the individual to commit a suicide or to accept euthanasia. This right often means a person with a uncurable illness should be allowed to commit suicide or to reduce his or her medical treatment, where a disease would otherwise prolong his or her suffering to an identical result.

It seems that if every human being born into this world has a "right to live," then it logically follows that every human being has a right to end their life (or a "right to die").It’s deep in many people’s memory that our modern culture comes from human nature liberalization,so,it’s not hard to accept the concept of right to die which allow us to decide on our own death.[1]

But,there’s no denying the fact that the topic how we should treat this phenomenon has been hotly debated for many decdes.

It’s said that the American Court first have to face the right to die issues again in two cases involving challenges to laws criminalizing physician-assisted suicide in1997.Although the Court interpreted the doctor who had successfully helped his hopeless patient commit a suicide as recognizing a right to refuse medical treatment, the Court found no constitutional basis for a right to assisted suicide.

In 2006, in Gonzales v Oregon, the Court decided another right-to-die case, although this one is on administrative law grounds at first, not constitutional grounds. But as a vote of 6 to 3,the Court announced that Attorney General Ashcroft

exceeded his powers to act as a doctor when he threatened prosecution against Oregon doctors prescribing deathful drugs under that state's Death with Dignity Act.

The USA Supreme Court made a statement in the landmark 1990 case Cruzan v. Director, Missouri Dept. of Health that severely injured patients have a legal right to refuse medical treatment and choose to die. But the court also ruled that states can require "clear and convincing" evidence of a patient's intent to abandon medical treatment, a rather high standard to meet.And it’s easy to understand for that if we don’t ask for a strict evidence,there would be easy for criminals to carry out a murder,and escape from the gap of our exsiting constitution.

Should a part of people impose their set of values on all individuals?

The question of who, if anyone, should be empowered to make these decisions is also a central to debate.It’s seems that the reason for the euthanasia to be reasonable lies in its respect to human nature liberalization to choose their own lives and even death.Then,should it be equally reasonable for some of us to decide the other’s lives?And actually who have the power to decide if a person is uncurable or sentenced to die?What’s more,even under the circumstances which is right for a euthanasia,we should respect the patient’s willing if he/she want to live.

Should we lay the religious feelings aside?

Another consideration is theological: does suffering ennoble? Is suffering, and relating to Jesus Christ's suffering on the cross, a part of preparation for meeting God? Of course,there are millions of atheists and agnostics, as well as people of various religions and spiritual believes, and they all have rights choose to abortion from medical treat and euthanasia. But,many Christians who believe in euthanasia justify it by reasoning that the God whom they worship is loving and tolerant and would not wish to see them in agony.[2]They do not see their God as being so vengeful as refusing them the Kingdom of Heaven if they accelerated the end of their life to avoid durable, unbearable suffering.

Conclusion:Though it’s not clear to conclude if it’s the right time and a right choice to make euthanasia legal,what we can hoping for future is a evolving process of human recognisation.Maybe in some day,our beautiful willings can actually help us creat a beautiful life.
