论我国产品质量监督检查制度

摘要

产品质量监督检查法律制度是质量监督的重要法律制度之一。它对加强产品质量监督，保护消费者的合法权益，发挥着积极的作用。随着社会的进步和经济的不断发展，人们对产品质量的要求也越来越高。目前，产品质量监督检查法律制度在理论和实践上仍存在问题。近些年来，产品质量问题更是层出不穷，严重侵害了消费者的合法权益。国外许多学者对产品质量监督检查问题进行了多方面的研究。一些发达国家和地区已经形成了相对比较完善的产品质量监督检查法律制度，他们的实践经验对于我国有着重要的借鉴意义。这些理论充分的揭示了产品质量监督检查的必要性和可行性。完善的产品质量监督检查法律制度对于国家和社会具有重大的价值和意义。

本文介绍了产品质量监督检查的概念和特征、性质和目的以及权限、方式和程序。研究了日本、欧盟、美国等产品质量监督检查法律制度。探讨了我国产品质量监督检查法律立法现状、实施成效存在的问题和造成问题的原因。最后提出了完善我国产品质量监督检查法律制度的构想。

On China's product quality supervision and

inspection system

Abstract

The product quality supervision and inspection law system is one of the most important legal systems in quality supervision. It is playing the positive role in strengthening the supervision of the product quality, protecting the legitimate rights of the consumer. With the social progress and economic development, the requests about product quality have been demanding increasingly. At present, the product quality supervision and inspection law system still has problems in the theory and the practice. In recent years, product quality problems have been emerging, which violate the legitimate rights and interests of consumers seriously. Many foreign scholars have done many-sided researches on the problems in product quality supervision. Some developed countries and areas have already formed comparatively perfect legal system of product quality supervision. There must be an important reference for our country. These theories sufficiently reveal the necessity and feasibility of product quality supervision and inspection. Perfect legal system of product quality supervision has great value and significance for national and society.

The article describes the concept and characteristics, the nature and purpose, authority, methods and procedures of the product quality supervision and inspection. Studies the product quality supervision and inspection law system of the Japan,The European Union,USA and so on. Discussed the present situation, the implementation result, the existed problems and its reasons of the product quality supervision and inspection law legislation system in our country.

Concludes with the conception for perfecting the product quality supervision and inspection law system in our country.
