第2条共同海损条款(General Average Clause)2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and /or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clause4,5,6 and 7 or elsewhere in this insurance. 本保险承保根据货运合同及/或管辖的法律和惯例理算或确定的,为避免或与避免任何原因造成的有关引起共同海损和救助费用的损失,但第4,5,6和7条或本保险其他条文的除外条款除外。
第3条“互有责任碰撞”条款(Both to Blame Collision Clause)This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. 英国伦敦保险业协会货物保险条款
英国伦敦保险业协会货物保险条款在国际保险市场上,各国保险组织都制定有自己的保险条款。
但最为普遍采用的是英国伦敦保险业协会所制订的《协会货物条款》(Institute Cargo Clause;简称I.C.C.)、我国企业按CIF或CIP条件出口时,一般按《中国保险条款》投保,但如果国外客户要求按《协会货物条款》投保,一般可予接受。
《协会货物条款》的现行规定于1982年1月1日修订公布,共有6种险别,它们是:(1)协会货物条款(A)[简称ICC(A)];(2)协会货物条款(B)[简称ICC(B)];(3)协会货物条款(C)[简称ICC(C)];(4)协会战争险条款(货物)(IWCC);(5)协会罢工险条款(货物)(ISCC);(6)恶意损害险(Malicious Damage Clause)。
以上六种险别中,(A)险相当于中国保险条款中的一切险,其责任范围更为广泛,故采用承保"除外责任"之外的一切风险的方式表明其承保范围。
(B)险大体上相当于水渍险。
(C)险相当于平安险,但承保范围较小些。
(B)险和(C)险都采用列明风险的方式表示其承保范围。
六种险别中,只有恶意损害险,属于附加险别,不能单独投保,其他五种险别的结构相同,体系完整。
因此,除(A)、(B)、(C)三种险别可以单独投保外,必要时,战争险和罢工险在征得保险公司同意后,也可作为独立的险别进行投保。
协会货物(A)、(B)、(C)三种险别的承保风险,主要规定在各该险第一部分承保范围中所列的风险条款(Risks Clause)、共同海损条款(General Average Clause)和船舶互有过失碰撞责任条款(Both to Blame Collision Clause)之中。
三种险别的区别,主要反映在风险条款中。
险条款ICC(A)险的承保责任范围较广,不便把全部承保的风险一一列出,因此对承保风险的规定采用"一切风险减除外责任"的方式,即除了在除外责任项下所列风险所致损失不予负责外,其他风险所致损失均予负责。
伦敦货运条款ABC
伦敦协会货运险(A)条款1/1/82(仅供新的海上保险单格式使用)协会货物条款(A)承保范围:1.本保险承保以下列出4、5、6、7各条规定除外责任以外的一切风险所造成的损失。
2.本保险承保共同海损和救助费用。
其理算或确定应根据运输契约和(或)有关法律和惯例办理。
该项共同海损和救助费用的产生,应为避免任何原因所造成的或与之有关的损失所引起的,但下列4,5,6,7各条或本保险其他条款规定的不保责任除外。
3.本保险负责赔偿被保险人根据运输契约定有“船舶互撞责任”条款规定,由被保险人应负责的比例责任,视作本保险单项下应予补偿的损失。
如果船东根据上述条款提出任何索赔要求,被保险人同意通知保险人,保险人有权自负费用为被保险人就此项索赔进行辨护。
除外责任4.本保险在任何情况下不负赔偿责任:4.1被保险人故意行为所造成的损失和费用。
4.2保险标的的自然渗漏,重量或容量的自然损耗,或自然磨损。
4.3由于保险标的的包装不固或包装不当或配装不当造成的损失或费用。
(本条所称的“包装”,包括用集装箱或大型海运箱装载的,但该项装载以本保险开始生效前完成或由被保险人或其受雇人完成为限)。
4.4由于保险标的本质缺陷或特性造成的损失和费用。
4.5直接由延迟引起的损失和费用,即使延迟是由于承保风险所引起(上述第2条可以赔付的费用除外)。
4.6由于船舶所有人、经理人、租船人或经营人破产或不履行债务造成的损失或费用。
4.7由于使用任何原或核子裂变和(或)聚变或其他类似反应或放射性作用或放射性物质的战争武器造成的损失或费用。
5.本保险在任何情况下不负下列原因引起的损失和费用。
5.1船舶或驳船不适航被保险人或其雇员在货物装船时已知情况的船舶的不适航及船舶、驳船、运输工具、集装箱大型海运箱不适于安全运输保险标的所引起的损失费用。
5.2保险人放弃船舶必须适航和适宜将保险标的运往目的地默示担保,除被保险人或其受雇人知道这种不适航或不适宜的情况。

"packing" shall be deemed to includestowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a riskinsured against (except expenses payable under Clause 2 above)4.6 loss damage or expense arising from insolvency or financial default of the owners managerscharterers or operators of the vessel4.7 loss damage or cover loss damage or expense arising fromunseaworthiness of vessel or craft,unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured,where the Assured or their servants are privy to such unseaworthiness or unfitness, at the timethe subject-matter insured is loaded therein.5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitnessof the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.6.In no case shall this insurance cover loss damage or expense caused by6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act byor against a belligerent power6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or anyattempt thereat6.3 derelict mines torpedoes bombs or other derelict weapons of war.7.In no case shall this insurance cover loss damage or expense7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civilcommotions7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions7.3 caused by any terrorist or any person acting from a political motive.DURATION8.8.1This insurance attaches from the time the goods leave the warehouse or place of storage at theplace named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either8.1.1on delivery to the Consignees' or other final warehouse or place of storage at the destinationnamed herein,8.1.2on delivery to any other warehouse or place of storage, whether prior to or at the destinationnamed herein, which the Assured elect to use either8.1.2.1for storage other than in the ordinary course of transit or8.1.2.2for allocation or distribution,or第2页共 5 页8.1.3on the expiry of 60 days after completion of discharge overside of the goods hereby insuredfrom the oversea vessel at the final port of discharge,whichever shall first occur.8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior totermination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided forabove, shall not extend beyond the commencement of transit to such other destination.8.3 This insurance shall remain in force (subject to termination as provided for above and to theprovisions of Clause 9 below) during delay beyond the control of the Assured, any deviation,forced discharge, reshipment or transshipment and during any variation of the adventurearising from the exercise of a liberty granted to shipowners or charterers under the contract ofaffreightment.9.If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated ata port or place other than the destination named therein or the transit is otherwise terminated beforedelivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insuranceshall remain in force, subject to an additional premium if required by the Underwriters, either9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed,until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichevershall first occur,or9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to thedestination named herein or to any other destination, until terminated in accordance with theprovisions of Clause 8 above.10. Where, after attachment of this insurance, the destination is changed by the Assured,held covered at apremium and on conditions to be arranged subject to prompt notice being given to theUnderwritersCLAIMS第3页共 5 页11.11.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring duringthe period covered by this insurance,notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and theUnderwriters were not.12.Where, as a result of the operation of a risk covered by this insurance the insured transit is terminated at aport or place other than that to which the subject-matter is covered under this insurance, theUnderwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.This Clause 12, which does not apply to general average or salvage charges, shall be subject to theexclusions contained in Clauses 4, 5, 6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.13.No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured isreasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival.14. 14.1If any Increased Value insurance is effected by the Assured on the cargo insured herein theagreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of theamounts insured under all other insurances.14.2Where this insurance is on Increased Value the following clause shall apply:The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the第4页共 5 页cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of theamounts insured under all other insurances.BENEFIT OF INSURANCE15.This insurance shall not inure to the benefit of the carrier or other bailee.MINIMISING LOSSES16.It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder16.1to take such measures as may be reasonable for the purpose of averting or minimizing such loss,and16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved andexercisedand the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.17.Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering thesubject-matter insured shall not be considered as a waiver or acceptance of abandonment orotherwise prejudice the rights of either party.AVOIDANCE OF DELAY18.It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstanceswithin their control.LAW AND PRACTICE19.This insurance is subject to English law and practice.第5页共 5 页。

伦敦保险协会运输货物保险(B)条款(备案编号:国寿产险(备案)[2008]40号)承保风险(风险条款)1.本保险承保,除下列第4、5、6和7条规定者外的:1.1 保险标的的损失或损害,若可合理归因于:1.1.1 火灾或爆炸;1.1.2 船舶或驳船搁浅、擦浅、沉没或倾覆;1.1.3 陆上运输工具翻倒或出轨;1.1.4 船舶、驳船或运输工具与水以外的任何外部物体碰撞或接触;1.1.5 在避难港卸货;1.1.6 地震、火山爆发或闪电。
1.2 由于下列原因引起的保险标的损失或损害:1.2.1 共同海损牺牲;1.2.2 抛弃或浪击落水;1.2.3 海水、湖水或河水进入船舶、驳船、船舱、运输工具、集装箱、托盘或储存处所。
1.3 装上或卸离船舶或驳船过程中掉落或从船上落入水中或坠落而发生的整件货物的全损。

1982年1月1日协会货物罢工险保险条款承保风险第1条风险条款(Risks Clause)1 本保险承保下列原因造成的保险标的的损失或损害,第3和第4条规定者除外:1.1 罢工者、闭厂工人或参加劳资纠纷、暴乱或民事骚乱的人员1.2 任何恐怖分子或出于政治动机而行为的人员。
第2条共同海损条款(General Average Clause)2 本保险承保根据货物合同及/或管辖的法律和惯例理算或确定的,为避免根据这些条款承保的风险造成的损失或与避免该损失有关的共同海损和救助费用。
除外责任第3条一般除外条款(General Exclusions Clause)3 本保险不承保:3.1 可归因于被保险人的故意渎职行为造成的灭失、损害或费用3。
2 保险标的的通常渗漏、通常重量或体积损失、或通常磨损3.3 保险标的的包装、或准备不足或不当造成的灭失、损害或费用(在本款意义上,“包装”应视为包括集装箱或托盘内的积载,但仅限于此种积载是在本保险责任开始之前进行或是由被保险人或其雇员进行之场合)。
3.4 保险标的的固有缺陷或性质造成的灭失、损害或费用3。
5 延迟直接造成的灭失、损害或费用,即便该延迟是由某种承保危险造成的(但根据上述第2条支付的费用除外)3。
6因船舶所有人、管理人、承租人或经营人的无偿付能力或财务困境引起的灭失、损害或费用3.7 由于无论何种类型的罢工、闭厂、劳资纠纷、暴乱或民事骚乱所致的劳工缺乏、短缺或抵制引起的灭失、损害或费用3。
8 基于航程或冒险的损失或落空的任何索赔3。
9 使用原子或核裂变和/或聚变或其他类似反应或放射性力量或物质制造的任何战争武器产生的灭失、损害或费用。
3.10 战争、内战、革命、叛乱、暴动,或由此引起的内乱,或交战团体之间的任何敌对行为造成的灭失、损害或费用。
第4条不适航和不适运条款(Unseaworthiness and Unfitness Exclusion Clause)4.1 本保险在任何情况下,均不承保因下述原因所致的灭失、损害或费用:船舶或驳船不适航船舶、驳船、运输工具、集装箱和托盘对安全运输保险标的不适合在保险标的被装上船舶当时,被保险人或其雇员对此种不适航或不适合有私谋.4.2 保险人放弃运载保险标的至目的港的船舶不得违反船舶适航和适运的任何默示保证,除非被保险人或其雇员对此种不适航或不适运有私谋。
11.3-5伦敦保险协会海洋运输货物保险条款
11.3 伦敦保险协会海洋运输货物保险条款在国际保险市场上,英国伦敦保险业协会所制定的《协会货物条款》(Institute Cargo Clauses,简称L.C.C.)对世界各国有广泛的影响。
目前,仍有许多国家和地区的保险公司在国际货物运输保险业务中直接采用经英国国会确认的L.C.C.条款,或者在制定本国保险条款时参考采用了L.C.C.条款。
I.C.C条款( 01/01/2009 ):L.C.C.(A)险的承保责任范围较广,不便把全部承保的风险一一列出,因此对承保风险的规定采用“一切风险减除外责任”的方式,即除了在除外责任项下所列风险所致损失不予负责外,其他风险所致损失均予负责I.C.C.(B) 险对承保风险的规定是采用“列明风险”的方式,即把所承保的风险一列举,凡属承保责任范围内的损失,无论分损失,保险人按损失程度均负责赔偿。
C险除外责任与B险完全相同L.C.C.(C) 险的风险责任规定,也采用“列明风险”的方式,可是仅对“重大意外事故”所致损失负责,对非重大意外事故和自然灾害所致损失均不负责。
L.C.C.(A)险条款:相当于C.I.C中的I.C.C.(A)险条款一切险罢工除外责任I.C.C.(A) 险承保范围战争除外责任不适航、不适运除外责任一般除外责任I.C.C.(B)险的除外责任:相当于C.I.C.中的水渍险(1L.C.C.(A)的除外责任L.C.C.(A)承保的海盗行为险恶意损害险I.C.C.(C):相当于C.I.C.中的平安险陆上运输工具倾覆或出轨火灾、爆炸抛货避难港卸货船舶或驳船触礁、搁浅、沉没或倾覆运输工具与水以外的任何外界物体碰撞[L.C.C.(C)险承保范围]共同海损牺牲11.4 我国陆、空、邮货物运输保险一、陆运货物保险基本险别:陆运险(类似于海运水渍险)和陆运一切险;保险责任起讫:采用“仓至仓”条款。

(FOR USE ONLY WITH THE NEW MARINE POLICY FORM)INSTITUTE CARGO CLAUSES(C)RISKS COVERED(Risks Clause)1 This insurance covers, except as provided in Clauses 4,5,6 and 7 below,1.1 loss of or damage to the subject-matter insured reasonable attributable to1.1.1 fire or explosion1.1.2 vessel or craft being stranded grounded sunk or capsized1.1.3 overturning or derailment of land conveyance1.1.4 collision or contact of vessel craft or conveyance with any external object other than water1.1.5 discharge of cargo at a port of distress,1.2 loss of or damage to the subject-matter insured caused by1.2.1 general average sacrifice1.2.2 jettison.(General Average Clause)2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4,5,6 and 7 or elsewhere in this insurance.("Both to Blame Collision" Clause)3 This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said clause the Assured agree to notify the underwriters who shall have the right, at their own cost and expense, to defend the Assured against suchclaim.EXCLUSIONS(General Exclusions Clause)4 In no case shall this insurance cover4.1 loss damage or expense attributable to wilful misconduct of the Assured4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured4.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this clause 4.3 "packing"shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel4.7 deliberate damage to or deliberate destruction of the subject-matter insured or any part thereof by the wrongful act of any person or persons4.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.(Unseaworthiness and Unfitness Exclusion Clause)55.1 In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft.unfitness of vessel craft conveyance container or liftvan for the safe carriage of the subject-matter insured where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness. (War Exclusion Clause)6 In no case shall this insurance cover loss damage or expense caused by6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power6.2 capture seizure arrest restraint or detainment, and the consquences thereof or any attempt thereat6.3 derelict mines torpedoes bombs or other derelict weapons of war.(Strikes Exclusion Clause)7 In no case shall this insurance cover loss damage or expense7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions7.3 caused by any terrorist or any person acting from a political motive.DURATION(Transit Clause)88.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either8.1.1 on delivery to the Consignees' or other final warehouse or place of storage at the destination named herein8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either8.1.2.1 for storage other than in the ordinary course of tranist or8.1.2.2 for allocation or distribution.or8.1.3 on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge. whichever shall first occur.8.2 If, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destinaiton.8.3 This insurance shall remain in force(subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.(termination of Contract of Carriage clause)9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either9.1 until the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur,or9.2 if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.(Change of Voyage Clause)10 Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being to the Underwriters.CLAIMS(Insurable Interest clause)1111.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.11.2 Subject to 11.1 above the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.(Forwarding Charges Clause)12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 4,5,6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.(Constructive Total Loss Clause)13 No claim for Constructive Total Loss shall be recoverable hereunder thesubject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to be destination to which it is insured would exceed its value on arrival.(Increased Value Clause)1414.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurances covering theloss and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.14.2 Where this insurance is on Increased Value the following clause shall apply:The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurances.BENEFIT OF INSURANCE(Not to Inure Clause)15 This insurance shall not inure to the benefit of the carrier or otherbailee.MINIMISING LOSSES(Duty of Assured Clause)16 It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,and16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised and the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properly and reasonably incurred in pursuance of these duties.(Waiver Clause)17 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party AVOIDANCE OF DELAY(Reasonable Despatch Clause)18 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their W AND PRACTICE (English law and practice Clause)19 This insurance is subject to English law and practice.NOTE:-- It is necessary for the Assured when they become 如果货物在最后卸货港卸离海轮以后,但在本保险终止以前,需运往非本保险单所载的目的地,本保险的终止时期仍以前款规定为准,但以不超过开始运往该目的地时为限。
如遇被保险人无法控制的延迟,任何绕道,被迫卸货,重新装载或转载以及船舶所有人或租船人运用运输合同所赋予的权限所作出的任何航海上的变更,本保险仍继续有效(但以上述第1条款的责任终止规定及下列第2条款的各项规定为准)。
本保险对于直接由于延迟或货物本质上的缺点或特性所引起的损失或费用都不负责。
2.运输终止条款如果由于被保险人无法控制的情况,运输合同未在本保险单所载目的地而在其他港口或地方终止,或由于其他原因货物在未交至上述第1条款规定的地点以前航程即告终止,在被保险人立即通知保险人并在需要时加缴保险费的情况下,本保险继续有效,直至:(1)货物在该港口或地方出售及送交时为止,或除特别另有约定外,至所保货物在该港口或地方卸离海轮以后满六十天为止,上述二项以其中首先发生的一项为准。
或者,(2)如在上述六十天期限以内(或在约定的任何扩展期限内)货物运往本保险单所载目的地或其他目的地,则至上述第1条款所规定的期限为止。

ICC(B)比ICC(A)的责任范围要小,故采用承保“除外责任 ”之外列明风险的办法,即将其承保的风险一一列举出来。 这种规定办法,既便于投保人选择投保适当的险别,又便于 保险人处理赔偿。 ICC(B)的除外责任与ICC(A)的规定不同之处在于: (1)在ICC(A)中,仅规定保险人对归因于被保险人故 意的不法行为造成的损失或费用,不负赔偿责任;而在 ICC(B)中,则规定保险人对被保险人以外的其他人的故意非 法行为所致的风险不负责任。可见,在ICC(A)中,恶意损害 的风险被列为承保风险,而在ICC(B)中,保险人对此项风险 不负赔偿责任。被保险人如想获得此种风险的保险保障,就 需加保“恶意损害险”。 (2)在ICC(A)中,标明“海盗行为”不属除外责任; 而在ICC(B)中,保险人对此项风险不负保险责任。
