关于中欧法学院学生向中国政法大学所付学费的陈述

Statement on Tuition Fees Paid by CESL Students to CUPL

根据中国政法大学授权，我谨此就中欧法学院学生学费问题，向我们的合伙人汉堡大学做一陈述。

As authorized by CUPL,I hereby make this statement to our partner the University of Hamburg concerning CUPL’s position on the question of tuition fees paid by CESL students to CUPL.

2010年12月，中国政法大学将总额5,441,250元人民币的资金拨付到中欧法学院的“中欧中”账户，作为中欧法学院发展基金，拨款数额等于中欧法学院学生2008、2009、2010学年实际缴纳的学费。

In December2010,the China University of Political Science and Law(CUPL) allocated a lump sum of5,441,250yuan,to an internal CESL account under the name “Zhong-Ou Zhong,”as development funding for CESL.The payment was equal to the amount of tuition fees actually paid by CESL students during the2008,2009and 2010academic years.

有关该项资金的性质及其与中欧法学院学费收入的关系，中国政法大学的立场如下：

As regards the nature of the funding and its relation to CESL’s income from tuition fees,CUPL’s position is as follows:

1．中国教育制度和法律规则决定中欧法学院学费的性质，主权原则排除任何外国或者国际组织的规则适用于此。在中国，大学所属的、不具有法人资格的学院不能以自己的名义收取学费。中欧法学院学生是向中国政法大学交纳学费，学费是中国政法大学应当交纳财政部的收入。在交纳收入之后，中国政法大学

通过教育部获得来自财政部的教育经费拨款，而中国政法大学资助的中欧法学院发展基金正是来自教育经费拨款。

1.China’s education system and corresponding laws and regulations determine the nature of CESL’s tuition fees.The principle of sovereignty excludes the application of any foreign or international rules.In China,schools or departments under universities that do not have legal person status,such as CESL,cannot receive tuition fees directly from students.CESL students pay tuition to CUPL.CUPL,as required by law, transfers all money from tuition fees to the Ministry of Finance(MOF).The MOF allocates CUPL an annual budget through the Ministry of Education(MOE).The source of CESL development funding is therefore CUPL’s annual budget.

每一笔学费收入，教育部直属大学都需要向学生出具财政部核定的、事先填写了收费金额的专用收据，需按照专用发票记载的累计金额，每年向财政部上缴学费收入。次年，财政部通过教育部向大学拨付教育经费。在核定教育经费的时候，大学上交学费的数额是一个考量因素，但这并不意味着财政部有任何义务向大学返还它早先交纳的学费收入——这就是中国政府反复强调的“收支两条线”（附件1）。

Every time a student pays tuition fees,universities under the MOE must provide the students with an MOF verified receipt showing the amount of tuition fees due.All tuition fees are then annually submitted to the MOF in accordance with the total amount of receipts for tuition fees.The following year,each university is allocated budgetary funding by the MOF through the MOE.When appraising the amount of funding to award each university,the MOF takes into consideration the amount a university received in tuition fees,but this does not mean that the MOF has to return any of the money from tuition fees that the university previously transferred to the MOF.This policy of a“separation of revenue and expenditure”,which covers all state organs and public institutions,has been repeatedly emphasized by the Chinese government(see annex I for the relevant Chinese regulations and an English translation).
