摘要：网络言论自由的限制与保护是近年来一个刚刚兴起的热门课题，虽然网络向所有的公民免费开放，但是在上面公民所发表的言论很可能会对国家和社会造成很大的影响，所以对公民的发言进行限制与保护是国家必须要采取的政策和手段，当前我国言论自由的限制与保护工作，开展的并不完善，第一我国缺少相关网络言论自由的限制与保护方面的法律法规政策，如果公安机关有确实的证据能够查出公民在网络上运用这个平台进行违法犯罪事实，但是却没有法律可以依照，没有明确的量刑标准，第二我国对于网络言论自由的监察力度不是很大，相关司法部门对于网络言论自由也没有形成很好的监察机制，所以导致现在我国保留的功能平板上出现很多危机和国家社会的言论，第三，行政管理者对于网络自由的限制与保护没有落实相关的法律法规政策，在日常的进行监管过程中也没有很好的给予打击，使得网络言论粉碎最终形成一股潮流。，针对这3个方面，应该从司法执法和立法3个方面给予网络言论犯罪的打击，相关法律部门的负责人也应该高度重视网络言论对于国家和社会真的影响。
