在社会主义市场经济体制中，建筑活动主要是通过建筑市场实现的，其中建筑工程合同是维系市场运转的载体。建设工程合同是承发包双方为实现建设工程目标，明确相互责任、权利、义务关系的协议，是承包人进行工程建设并获取合理利润的源泉，

同样也是发包人支付价款，控制工程项目质量、进度、投资，进而保证工程建设活动顺利进行的重要法律文件。加强合同管理是保证承发包人全面履行合同约定的义务，是确保实现建设目标（质量、投资、工期）的重要手段。

本论文对建设工程合同管理等概念进行了解释，并通过对建筑工程合同的发展与现状的论述，对建设工程合同管理的目的、任务等进行了详细分析，阐明了建设工程合同管理规范化的内涵，对建设工程合同管理进行了简要介绍。然后在上述理论的基础上，就目前我国建设工程合同管理存在的主要问题，经过综合对比分析，归纳出的产生问题的主要原因，并对问题存在的深层次原因进行了分析，提出了相应解决措施，解决了索赔难问题。最后对国内国际建设工程合同管理进行了比较借鉴，从宏观调整

与控制、微观操作等方面提出了相应的建设工程合同管理规范化建议。

Abstract

In the socialist market econo mic system, the con structi on activity is main ly achieved through the con struct ion market, in cludi ng con structi on con tract is to mai ntai n the operati on of markets carrier. Con structi on Procureme nt con tract con struct ion projects for the realization of both goals, a clear mutual responsibilities, rights and obligations of the agreeme nt, is the con tractor for con struct ion and the source of a reas on able profit, is also con tracted to pay the price, con trol the project quality, progress , in vestme nt, thus en suri ng the smooth progress of con structi on activities, an importa nt legal docume nt. Stren gthe ning Procureme nt Con tract Man ageme nt is to en sure people fully fulfill their con tractual obligati on s, is to secure a build ing objectives (quality, inv estme nt, con structi on period) is an importa nt means.

This thesis on con structi on con tract man ageme nt, expla ined the con cept and developme nt through the con struct ion con tract and the status of discourse on the con struct ion project con tract man ageme nt purposes, tasks are an alyzed in detail, expla ined the con struct ion con tract man ageme nt sta ndardizati on of content of con structi on con tract man ageme ntare briefly in troduced. The n the theory based on the con structi on con tract on the man ageme nt of our coun try's major problems exist, through comprehe nsive an alysis, we summarize the mai n producti on problems, and problems of deep-seated reas ons were analyzed, the corresponding solutions proposed to solve the difficult problem claims.Fi nally, domestic and intern ati onal con struct ion project con tract man ageme nt compared draw, from the macro adjustment and control, micro-operation, set the appropriate con struct ion con tract man ageme nt sta ndardizati on proposal.
