2.5.1 Home Country Legal Environment

It is the laws of the international marketing in the home country of the marketing companies. The national laws by the home countries are related to the qualities of the products, the standard law, the trademark law, packing law, direct sale law, the anti-unfair competition law, advertising law, Industrial property rights protection law, and the provisions of green marketing, etc.

To protect the home marketing, increasing the opportunities of working and become compatible with internationally accepted practices better, many countries had made clear laws. They include export control, import control and exchange control, etc.

2.5.2 The Legal Environment of the Host Country

The most frequent and the most direct factories on influencing international marketing are the legal norms of the foreign companies in home countries.

1.Two Big Systems in Law

Now, the legal systems in most countries of the world are individual led into two systems: the Continental Law System and

Anglo-American Law System. It includes France, German, and other European countries as well as the countries in South-America, Japan, Turkey, China, etc. Most of the countries in the world belonged to continental law system. The most important trait of continental law system countries is that they loyal to the code. In those countries the clean law provision is very important. The judiciaries in those countries are not following the arbitrament experience in the past. The same clause even makes different results. It makes the international sales staffs suffer a unstable law environment. The most important trait of the Anglo-American Law System is that it is lead by traditional. They value the habits and cases. The past cases will be look as the model. It can be conclude as doctrine of binding precedent. In recent years, the countries as Britain, America made a large amount of continental laws to supply the common law, but the contract law and the law of torts are still belonging to the Anglo-America law.

The different legal systems can be explained in different reasons to one thing. Therefore, the international sales staffs should analysis the law environment of the foreign market carefully when they are working.
