Case: 铁路垄断与《反托拉斯法出台》
19世纪70-80年代，美国铁路发展迅速，垄断也随之形成。一方面，为抓住大的客户，铁路部门开始用“回扣”的办 法来吸引和稳住谷物商、屠宰业主、煤炭商等大客户。对铁路来说这一做法稳定并提高了货运量，对运输大户来说 大大降低其商品的运输费用，减少了成本，以赢得更大的市场份额和更高的利润。另一方面，铁路又通过抬高小城 市运费、支线铁路运费和零散商品运费的方法来弥补其支付“回扣”的损失。实际上，就是通过欺小扶大、拉强压 小的办法达到收支平衡，甚至谋取暴利。因此，铁路成为商业运营的“调节阀”：对大户，它意味着快捷、方便、 低廉的服务，对小户，它代表着傲慢、限制、昂贵的代价。对于这种歧视，没有人加以质疑，因为根据当时法律， 铁路大亨们拥有凭借自己的财产去做他们乐意做的一切事的权力。1895年的一篇法律论文指出：“任何国家都不存 在如此不受限制的公司权力。”“这是公司的时代。”
