Employment & Termination1).The TEFL Academy hereby employs Employee for a definite period commencing from _________________ and expiring on ______________________. EvaluationAccording to the evaluation of the school and students, the director will fix upon the amount of bonus the employee will get. The bonus = RMB600×evaluation score%. For example, if the employee gets an evaluation score of 80 for this month( students’ feedback will be carried out at the end of each month.), the bonus he/she will get is 600×80%. So the final bonus for this month is 480. However, if the one who has got the evaluation score below 60, he/ she will get no bonus. The evaluation details include school evaluation and students evaluation two parts.6. Complaints and punishment1) The first time students complain, school will give an oral warning.2) The second time students complain, school will give a written warning.3) The third time students complain, school will consider terminating the contract. If the school decides to terminate the contract, a written notice will be given 3 days (for probation) /a week in advance. In this case, the TEFL Academy will take no penalty for terminating the contract.All complains should be admitted by the school.7．Sick Leave and private affairs leave1)The Employee shall notify, and seek approval for sick leave from the Director of Studies orhis/her deputy immediately in the event of sickness. All sick leaves must be supported by a doctor’s certificate unless pri or approval from the Center Manager is obtained. The Employer can provide reasonable assistance to obtain the doctor’s certificate upon request. Upon return to work a sick leave form must be completed and approved by both the Director of Studies and Center Manager.2)Any unauthorized sick leave shall be counted as unpaid leave deducted from salary and will be penalized by disciplinary measures.3)If the sick leaves amount to less than 30 days within one contract term(one year ), the employees should be paid with 100% of the salary. In case the leaves exceed 30 days, the employer has the right to terminate the contract, or, if the contract is not terminated, the 30% of the salary will be paid until the normal work is resumed.4) Private affairs leaves of the employees shall be approved by the employer. The employer will deduct the salary by day. In the contract term, the private affairs leaves should not exceed 10 days. The continuous private affairs leaves should be no more than 3 days, and two days’ salary will be deducted for each day thereafter.8. Contract
(Party A)________ employs _________ (Party B) as the foreign staff with the spirit of friendly cooperation, singing this contract.
Article 1 Employment period is two semesters from 18 February 2011 to 10 FEB 2012. Article 2 Party B’s working task is as follows,
Party B should complete the work with the high quality on time. Party A will provide the necessary working and living conditions as well as the medical and accident insurance. 2. Party A should do the work direction, supervision and evaluation.
3. Party A should provide the necessary working and living conditions to Party B.
4. Party B should be equipped with co-workers.
5. Party A should pay the salary to Party B on time.
Article 6 Party A’s responsibly is as follows,
1. Party B should abide by Chinese laws and regulations, and can not interfere in the China's internal affairs.
2. Party B should abide by working system and regulations concerning administration of foreign experts; should accept the work arrangement, direction, supervision and evaluation. Without Party A’s permission, Party B could not do the other work which is not arranged by the Party A.
3. Party B should complete the working task with the high quality on time.
4. Party B should respect China's religious policies and can not engaged in activities incompatible with the status of an expert.
5. Party B should respect China's moral standards and customs.
Article 7 The modification, rescission or termination of the contract
1. Both parties could not modify or terminate the contract without the agreement of any
party.
2. If both parties agree after the negotiation, the contract should be modifies or terminated. If not getting the agreement, both parties should fulfill the contract strictly.
3. Party A has the right to inform Party B terminate the contract in the following conditions,
(1) Party B fails to fulfill the contract and not perform the agreed condition. If the Party
A point out, Party
B still does not correct.
(2) According to the doctor's diagnosis, Party B could not resume normal work in continuously 30 days.
4. Party B has the right to inform Party A terminate the contract in the following conditions,
(1) Party A does not provide the necessary working and living conditions.
(2) Party A fails to pay the Party B salary.
Article 8 the contract will be effect from the commencement date. If any party wants to extend the contract, he should bring up before the 3 months of the expiration of contract. After the negotiation, both parties could resign the contract. The new contract is the integral part of this contract. All the articles will continue to be valid in extending period. If any party does not want to extend the contract, the contract will be invalid to the expiration of contract.
Article 9 The disputes should be negotiated by both parties.
