2.2 订舱信息相关注意事项 1)所有自拼箱货物的订舱, 请使用我司事先发放的提单号做为主订舱号与订舱及提取 空箱。其余拼箱货物请以在主订舱号后加 A,B,C,D„的方式报关、进港。 2)所有订舱必须注明合约号及签约客户的全称 3)出口至美国的货物， 必须注明目的地所属州名。如在目的地需要门到门服务，必须 在订舱时予以注明。出口至美国内陆点的货物，须在订舱时注明我司的基本卸货港， 或标明所需运输方式是 MLB(小陆桥)还是 ALL WATER（全水）。 4)客户如对运输路径有特殊要求， 如指定中转港、指定内陆运输方式等，必须在每一 票订舱单上明确标明。若订舱时未注明特殊要求，将按我司常规路径进行安排。 备注：如客户与我司在合约中已经签订了某个特殊路径，客户仍应在每一票订舱单上 注明对特殊路径的使用要求，以保证货物的正确运输，如无特殊说明将默认为使用我 司常规路径。 5)发送电子订舱时，如卸货港或目的地无法正常显示，请务必在订舱备注栏内详细说 明，并在收到订舱确认时仔细检查核对，确保订舱信息无误。 6)如定我司与其他船公司共舱的航线，请按照共舱船东的船名/航次安排报关，进港。
3.6 场站收据 船开后一个工作日，可至我司前台领取未上船货物相关的场站收据。需携带写有场站 收据号码的工作联系单方可领取。 备注: 洋山港出运货物的场站收据，客人将自行去洋山港收取。
3.7 舱单配送 送至前台的出口舱单，前台会根据客户提供的工作联系单安排快递送往船代，每日两 次，分别为十点三十分和十五点三十分。 备注：周五十五点三十分以后送至我司的舱单,在当日十七点会送往船代。
MAERSK订舱须知
MAERSK订舱须知尊敬的订舱客户，您好，为了我司能给您更好更快捷的服务，请您配合按照以下的流程操作：一：订舱1.请在提供我司的托书上提供收，发货人的详细信息，包括电话，传真，地址，收货人信息，邮政编码。
2.请在托书上注明合约号，如无MAERSK合约号的一律以公开价计算。
有合约号的客户，还需要在货物描述栏中填写合约号的公司名以及相应的合约号3.请在托书上注明付款方式-----预付或到付或第三地付费。
如是第三地付费，必须提供第三地付款人名，地址，联系人电话和联系人。
4.危险品订舱注意事项1．提供DG FORM 及 DG DECLARATION各一份，并需加盖SHPR 及包装公司的章及英文签名（附件为DG FORM的样本）2．提供对应的危险货物包装检验结果单3．如有内外包装应注明，并注明每个外包装中装了多少个内包装4．如超过两个集装箱（包括两个）应注明每个的件毛体5．如有海洋污染应注明轻度还是重度6．客户在提箱后应尽快提供带箱封号的DG FORM7．24HR紧急联系人应有电话及人名8. 请至少提前十个工作日订舱5.若是冷冻货物，挂衣箱或特种箱，请提供完整准确的信息，尽早订舱，以便安排设备。
6.如是拼箱在关单号后加A，B，C……，此种关单号只用于订舱，若出提单时需要分单，请在EDI备注栏中注明SPLIT BILL字样及分单的总件数，MAERSK将随机产生新的提单号7.出口美国货物的运输必须在订舱单上注明运输路径是“MLB”还是“ALL W ATER”，只有在次信息被去人后，相关的订舱才能被接受。
8.当MAERSK确认舱位后，会以E-MAIL形式发送BOOKINGCOMFIRMATION。
我司会及时发送您，您可以凭此领取设备交接单；设备交接单的截止时间为截港前提前四小时；箱子进港时的中转港代码请根据设备交接单右下交的三位代码填写。
9.如有退关请尽早以书面形式通知我司客服，以便我司发送退关清单给MAERSK。

由于理论界对滞箱费相关法律问题存在分歧，导致司法实践中对滞箱费纠纷的裁判结果不一，在一定程度上不利于航运市场健康发展。
本文从集装箱使用合同的性质入手，以海事审判实践为依托，对滞箱费的索赔主体和责任主体进行论述，以期为明确滞箱费相关法律问题提供参考。
1 滞箱费概述1.1 滞箱费的概念及类型滞箱费也称集装箱超期使用费，指供箱人在用箱人超出免费用箱期仍然占用集装箱的情况下向用箱人收取的费用。
设立滞箱费的目的是加速集装箱流转。
滞箱费分为滞期费和延迟费：滞期费指进口集装箱的用箱人超出免费用箱期返还空箱而产生的集装箱超期使用费；延迟费指出口集装箱的用箱人超出免费用箱期交付重箱而产生的集装箱超期使用费。
本文主要探讨滞箱费中的滞期费。
1.2 滞箱费的特点（1）费率制定的单方性。
航运实践中，滞箱费费率通常由承运人规定在运价本中，通过其官方网站向社会公布，并强行引入运输合同或相关单证中。
由此可见，滞箱费费率由承运人单方制定，在形式上属于格式合同。
（2）产生时间的特定性。
滞箱费从免费用箱期结束后开始计算。
根据交货方式的不同，免费用箱期自货物到达目的港堆场、收货人工厂或仓库、货运站或内陆交货地的次日开始计算，通常为7～。
（3）费率标准的地域性。
通常情况下，承运人在制定滞箱费费率标准时会综合考虑用箱成本、箱量情况、市场走势以及港口免费堆存期等诸多因素，导致同一承运人的同种集装箱在不同港口的滞箱费费率标准不尽相同。
1.3 滞箱费的性质关于滞箱费的性质，目前理论界有租金论、违约金论、附加运费论、特殊报酬论、约定损害赔偿论等学说，其中比较有代表性的是租金论和违约金论。
租金论认为，托运人与承运人签订的运输合同中的相关条款及集装箱使用合同应当被视为集装箱租赁合同，集装箱承租人即托运人租赁集装箱应当支付租金，当其超过规定期限还箱时，集装箱出租人即承运人有权依据集装箱租赁合同的约定向集装箱承租人请求支付租金即滞箱费。

中海集运国内滞箱费标准及实施细则第一部分、滞箱费及FREE TIME的定义一、滞箱费的定义船东参考当地的航运习惯规定用箱人在提箱及还箱操作之间一个合理免费用箱期限（FREE TIME），如客户超期使用集装箱，将根据船东制订的标准向客户收取费用，以弥补船东由于客户超期使用而造成集装箱租金损失、周转效率等相关费用的损失。
二、FREE TIME相关说明1、FREE TIME中免费使用天的计算A．CLAENDAR DAY(日历天)：日历天就是按照日历上所载的日期来算（法定节假日及其他无法工作的时间都包括在内），一天的计算以子夜24：00为基准，不满一天按一个日历天计算。
B. WORKING DAY（工作天）：除星期六、日及当地法定节假日以外的所有日历天，其他时间一概不能排除在外，不足一天按一天算。
2、超过FREE TIME一律按照日历天来计费如用箱人超过了集装箱的免费使用期（FREE TIME），对于超期后的天数应按照船东制订的标准支付滞箱费，无论该超期时间是否是在其可工作的时间，这就是一旦滞期永远滞期的原则。
3、申请延长FREE TIME滞箱费的计算方法首先按照原来的滞箱费标准计收费用，再减去延长的FREE TIME产生的费用，而不是按现行标准时间段顺延计收。
举例如下：外贸进口一个20GP，我们给与客户14天免费期，客户最后25天后才还箱的滞箱费计收方法：第二部分滞箱费计算标准一、国内滞箱费收取标准1、进口:从卸船开始计算到用箱人还箱时止。
2、出口：从用箱人提箱开始计算到集装箱装上船止。
以上操作如有超期按照中海集运制订的滞箱费标准计收，如非用箱人原因造成滞期，可提出滞箱费减免申请。
二、套柜操作中滞箱费标准的适用套柜操作中滞箱费计算时间从卸船起到装船时止，按照进口集装箱滞箱费标准向套柜操作人计算收取全程滞箱费。
FREE TIME大连片区12天，其他片区10天。
三、提箱后退关的滞箱费计算标准提箱后没有装货或已经装货进码头但由于客户原因造成无法装船的退关箱，按照从客户提箱时起到还箱时止的全程计算滞箱费, 不再另行给与出口FREE TIME。

作为一种区别于传统运输的革命性运输方式，集装箱运输极大的降低了货物运输的成本，并且以速度和规模改变了物流的流转方式。
其在整个国际贸易中占有重要的地位，极大地提升了世界经济的运行效率，仅仅半个世纪集装箱运输就占有了国际贸易90%以上的件杂货运量，取代了班轮运输原有的件杂货运输方式。
伴随着集装箱运输的发展，大量相关的法律纠纷也不断出现。
其中对于滞箱费的收取所引起的法律问题，我国对此明显缺乏相应的理论研究。
我国虽然在1992年出台过《国际集装箱超期使用费计收办法》，来对滞箱费进行统一的管理和规定。
但是首先该《办法》只是由交通部和国家物价局颁布的一个部门规章，在效力上有所欠缺;其次，该《办法》已于2003年正式失效，因此现在各权威部门对集装箱滞箱费的概念、法律性质以及收取滞箱费的标准等问题再也没有形成统一的意见。
一旦发生争议，对滞箱费纠纷相关当事方是相当不利的。
时至今日，我国集装箱运输船队规模已位于世界前列，多个集装箱港吞吐量排进世界前十。
但是立法上对该问题也没有专门规定，给司法实践造成诸多难题。
一、集装箱市场和集装箱管理集装箱运输以其"快速、安全、优质、廉价"的优势在交通运输中引发了一场重大变革。
