浅论施工索赔

摘要

随着改革开放的进一步深入，市场经济体制逐步建立和完善，建筑业规范化、法制化进度大大加快，工程项目也逐渐按国际惯例进行管理。在选择合理低价中标的经营策略下，增强索赔意识、重视索赔问题是承包商提高工程经济效益的一个途径。

索赔是指在工程施工合同的实施过程中，合同一方因对方不履行或未能全面适当履行合同所规定的义务而受到损失，向对方提出赔偿要求。在工程承包过程中，对承包商而言，只要不是自身的责任，而是由于外界干扰造成的工期延误和成本增加。都有理由也应当提出索赔。

在实际工作中，“索赔”是双向的，建设单位和施工单位都可能提出索赔要求，但建设单位索赔数量较小，而且处理方便。可以通过冲帐、扣拨工程款、扣保证金等实现对施工单位的索赔，而施工单位对建设单位的索赔则比较困难一些。

在实际工作中，有些施工企业没有对索赔引起足够的重视而且在实施索赔中对需要索赔的根据、内容、程度等不太了解，造成经济签证等资料不完整或不合理，致使企业受到经济损失时得不到合理补偿。因此，在市场经济中，施工企业从事经营工作的专业人员要以高度负责的敬业精神为企业经济效益，必须要重视索赔，积

极、主动的寻找索赔事件。但同时施工企业必须认识到索赔的提前是公正合理的原则。要有充分的证据和理由，不能泛用索赔。
