我国女性就业法律保护完善的建议

摘要:女性就业一直是全世界很关心的话题。随着市场经济的发展,越来越多的女性参与到就业中来。但由于男女生理方面天生存在着差距,女性在在求职和职业中的弱势地位也越来越明显的表现出来。就业中对于女性劳动者的歧视也屡禁不止,在录用过程中及录用后、职业层次及待遇、特殊生理期以及职业退出方面均存在歧视现象。女大学生在求职过程中遭受性别歧视就是这个问题的一面镜子。我国在保护女性就业与职业权益方面的法律法规也是不少的,但由于法律自身问题和实施过程中存在的问题,使法律并未真正起到很好的保护作用。对此我国应尽快转变立法思路,完善法律法规以实现女性的平等就业权益。

本文通过对女性就业不平等的现状以及女性就业的困境和相关法律存在的缺陷说明我国女性就业法律保护完善的必要性。分析了现阶段我国关于女性平等就业保护的立法现状及存在的问题等。创新之处在于,提出要建立一套能有效运作的女性就业法律保护方案,就要将女性的社会责任和负担由全社会来统筹分配,同时加快反就业歧视立法,政策性扶持女性就业培训机构,提高女性的就业能力。还要积极发展职业介绍咨询事业,使女性群体能获得方便有效的公共就业服务等,即通过国家立法和各方面配套制度的共同作用,最终使我国女性平等就业问题得以妥善解决。

Abstract: Female employment has been a worldwide topic.With the development of Chi na’s market economy,more and more women have participated in the labor force market.

H owever, because of the physical gap between men and women bear with them, the weak p osition of women in employment and occupation has been becoming increasingly clear. The discrimination in employment for female workers also,in the process of hiring and employment, vocational level, and treatment, special physiological period and vocational exits in all discrimination phenomenon.It is a mirror of this issue that female college students facing discrimination in the course of employment based on gender.China has established a lot of laws and regulations on the protection of rithts and interest of female employment and occupation.However,because of legal issue and their problems in the implementation process;The law in practice did not really play a very good protection role. So our country should change as soon as possible in l

egislative idea, perfect the laws and regulations in order to realize the equal employment rights and interests of women.

The article through to show the female employment inequality of the status quo and predicament of the women employment and the flaws of the law the necessity of perfecting the protection of female employment law. Analyzed about women's equal employment p rotection legislation in our country at present stage, current situation and existing problems. Innovation is put forward to establish a set of effective functioning of the female employment law protection, social responsibility and burden of women must be assigned by the whole society to plan as a whole, at the same time to speed up the employment discrimination legislation, policy support of female employment training mechanism, increase the ability of women employment. Also actively developing outp lacement consulting career, women can get convenient and effective public employment services and so on, namely through national legislation and all aspects of supporting system of interaction, eventually to properly solve women's equal employment problems in our country.

引言:“从法律和事实上以全面的、持久不懈的行动谋求男女平等的实现,是当代世界不可抗拒的历史潮流。”平等是人类历史的最终目标,男女平等源于平等的公理。而男女平等的基石男女经济地位的平等,妇女同男性享有平等的就业权是实现男女真正平等的重要途径。纵观各国发展,女性就业始终是政府关注的重要方面。新中国成立后,我国政府通过政策和法律来确立男女地位平等,保障妇女就业权利。到了市场经济时代,随着“大锅饭”到自由择业、双向选择就业机制转变,社会对女性就业平等有了新的认识,立法也做出了相应调整。随着社会的进步,我国越来越多的女性参与到就业中来,就业领域不断扩大,然而现实中女性在就业与职业中的权益受到不同程度的侵害。招聘会场上,单位的用人需求版上赫然写着“限男性”;职业中,女职工产假后就被调换工作,并会被私下告知,如愿主动离开就会给予优厚的补偿;诸如此类的现象还很多,女性在职场上似乎总被视为不受欢迎的人。

与之形成鲜明对比的是,虽然我国法律、行政法规和部门规章等都对保护女性就业与职业权益做出了规定。但仍存在着法律界定过于模糊、保护范围过于狭窄、立法层次低、立法分散
