英文书写海上声明、海事报告、业务函电一、海事声明:船舶在锚泊,系泊,装货,航行,卸货等某一运输环节中,遭到了自然灾害袭击,船员虽然竭尽全力保护船舶和货物安全,但仍然担心或认为船体,设备和货物有某种程度的损失或损坏,则应在到达受灾袭击后的第一个停泊港口时尽快向有关方面提出海事声明,取得签证后,抄送货方及其他有关方,这种声明是日后宣布损失,索赔或申报免责的初步证明文件,其正文一般包括下列内容:1本船船名,船籍港,吨位,货种,货物数量,出发港,目的港及挂靠港等。
2遭遇自然灾害的时间,地点或海域。
3自然灾害的性质,程度。
4声明对可能发生的损失或损坏不负责任。
5保留适当时间和地点延伸该声明的权利。
海事声明要有2到3名经历灾难的人员作证并签字,常应附有记录当时海况,天气及争取的措施等航海日志摘要。
二、海事报告:船舶在航行或是停泊中发生事故,对船舶,货物,水域环境造成了损害,为了说明事故发生的过程和责任情况,船长应向有关方面提交海事报告,这是船长在履行的一项法律义务,其格式与内容要严格按照当地主管机关饿规定,应以陈述事实为主,切记推断,更不必检讨个人过失,船长应召集全体驾驶员和值班水手认真回忆事故经过,并画出示意图,依照事实剔除记忆误差,最后谨慎的将有关情况填在正式报告中,其内容一定要与航海日志,车钟记录簿和海图作业相符,附送的材料要尽可能详尽齐全,其格式一般有以下几部分构成:1、海事报告封面包括标题,接受海事报告的机关,事故发生的时间和水域,附送材料的份数,以及船长签字船章和递交报告的日期。
2、本船概况,该部分应按照当事船舶所持有的国籍证书中的有关资料填写,国籍证书中涉及的项目按船舶的其他资料填写。
3、船舶航行及避让情况,当船舶发生碰撞事故时才填写本部分。
4、发生事故的详细经过。
5、事故示意图要求标明船名,时间,船位,航迹或队形。
6、损失情况,包括本船损失情况和他船损坏情况,重点为本船损失情况。
7、附件:根据事故性质和具体情况,通常在海事报告后附有下列材料:航海日志,机舱轮机日志摘要,海图,原航线和船位的记录,船舶受损部位简图以及海事经过简图,船舶检验或坚定报告,船员证明材料等等。

五、海事声明与海事报告有哪些区别?海事声明(NOTE OF PROTEST)和海事报告(ACCIDNT REPORT)是船舶发生遭遇海损事故时必须备的文件,严格地来讲海事报告与海事声明是两种不同性质的文件,其主要区别如下:在国内一般情况下,海事报告可以代替海事声明。
通俗来讲海事声明是船舶发生海损事故后船方向保险人(公司)发通告、打招呼、挂号,就是通知其所投保的船舶发生了事故了,要保险人作好赔偿的准备。
海事声明只将船舶发生海损事故时间、地点和可能的损失简要陈述及船方不负责任并保留在适当时间和地点延伸声明的权力。

海事声明与海事报告一、海事声明(SEA PROTEST OR NOTE OF SEA PROTEST)是船舶在航行中或停泊时遭遇恶劣天气或其它意外事故而估计可能造成船舶和(或)货物损失或损坏时,由船长签署的一项声明。
该声明申述本船对不可抗力所造成的任何损失或损坏不负任何责任,同时保留向有关方面索赔,并保留在适当时间和地点延伸或补充声明的权利。
海事声明经第一抵达港的航政机关或公证机构或船籍国驻当地领事馆或大使馆签证后,就成为保险人所必须取得的文件。
船舶在递交海事声明之后,认为原海事声明写的不详细或不清楚而必须作必要的补充时,应递交补充海事声明。
(SUPPLEMENTARY SEA PROTEST)延伸海事声明(EXTENDED SEA PROTEST)是对原海事声明的具体补充报告。
船舶在递交海事声明时,往往还不能确定船、货是否损失或损坏,或者对船、货损失或损坏的程度和原因不明确,因而在海事声明中写明“保留在适当的时间和地点提出延伸海事声明的权利”,后经开舱卸货或者检验发现确有与原声明的海事有关的损失或损坏,船舶必须提交更为详细和具体的补充;并重申对损失或损坏不负任何责任或保留向有关方面索赔的权利。
二、海事报告(MASTER’S REPORT OR MARINE ACCIDENT REPORT)是船舶在航行中或停泊中发生碰撞、失火、触礁、搁浅等海损事故后,船方向有关当局提交的书面报告。
其中内容包括事故的时间、地点、详细经过、原因和损害以及船方所采取的措施。
在递交海事报告时并应附上:1、有关船舶技术状态的记载。
2、航海日志和轮机日志的摘要(发生事故前12小时起),必要时应附航海日志和轮机日志。
3、有关海图和原航线、船位等记录(标明发生事故前后的船舶动态)。
4、受损部位的简图。
5、与海损事故有关的其它文件。
目前各国对海事报告的要求和作法不一。
有的要求把事实经过记入海事声明之中;有的要求在航海日志和轮机日志中写明;有的只要求提供海事声明,不要求另行提供海事报告。

1.船舶,设施发生海上交通事故,必须用VHF或其他有效手段向就近港口的港务监督报告。
报告的内容包括:船舶或设施的名称,呼号,国籍,起讫港,所有人或经营人名称,事故发生的时间,地点,海况以及损害情况,救助要求等;
2.船舶,设施发生海上交通事故,除应立即提出初步的扼要报告外,还必须按下列规定向港务监督提交“海上交通事故报告书”和必要的文书资料:1)船舶,设施在港区水域内发生海上交通事故,必须在事故发生后24小时内向当地港务监督提交;PAGE 58
2)船舶,设施在港区水域外发生海上交通事故,船舶必须在到达我国的第一个港口后48小时内向港务监督提交;
3)引航员在引航船舶的过程中发生海上交通事故,应该在返港后24小时内向当地港务监督提交;
4)中国籍船舶在我国沿海水域以外发生的海上交通事故,其所有人或经营人应当向船籍港港务监督报告,并于事故发生之日起60日内提交“海上交通事故报告书”;
5)派往外国籍船舶任职的持有中华人民共和国船员职务证书的中国籍船员对海上交通事故的发生负有责任的,其派出单位应当在事故发生之日起60日内向签发该职务证书的港务监督提交“海上交通事故报告书”
3.“海上交通事故报告书”应当如实写明下列情况:
1)船舶,设施概况和主要性能数据;
2)船舶,设施所有人或经营人的名称,地址;
3)事故发生的时间,地点;
4)事故发生时的气象和海况;
5)事故发生的详细经过(碰撞事故应附相对运动示意图);
6)损害情况(附船舶,设施受损部位简图);
7)若船舶,设施发生沉没,指明沉没概位;
8)与事故有关的其他情况。

I hereby declare that the cargo had been discharged from my ship M.V.:
“C H S MAGNIFICENCE” is 153,000MT till 0700hrs/19th and Balance is 8,022MT,
but the shore figure is 151,100MT been discharged, and Balance is 9,922MT, So
there are 1900 MT shortage in discharging, and the ship can’t accept the shortage at
present and/or final , so if any problem about the matter, the ship, owner is not
responsibility for any claim raised.
Please note that we are monitoring discharge record per shore scale with ship’s
draft survey every day.
