民间文学艺术作品的知识产权的保护

摘要

中华文化，源远流长，博大精深，民间文学艺术作为中华文化瑰宝中的重要组成部分，以其丰富性、时代性、特色性根植于中华民族和中国人民的生活之中，具有强大的生命力。同时，伴随着文化产业的崛起，民间文学艺术作品以其特有的优势创造了巨大的经济和社会价值。然而，21世纪以来，关于民间文学艺术作品的法律纠纷案件不断涌现，在全球强势文化的压制和摧残下，民间文学艺术作品被全球化、公占化、商品化，严重的影响了民间文学艺术作品的多样性和丰富性，民间文学艺术作品的保护迫在眉睫。从我国对于民间文学艺术作品的法律保护现状来看，我国著作权法、商标法以及知识产权保护的其他相关法律法规有对其进行规范和制约，当从其立法尝试和实施现状来看，我国民间文学艺术作品的知识产权保护还存在一定的问题，为此，本文以知识产权保护为视角，从民间文学艺术作品的知识产权保护背景和意义入手，综合研究和对比了国内外有关民间文学艺术作品的知识产权保护经验和方式，结合民间文学艺术作品的概念界定和基本特征，分析了我国民间文学艺术作品知识产权保护的立法尝试和保护现状以及存在的问题，从而提出了我国民间文学艺术作品知识产权保护的构建与完善策略，从现行法律完善和特别法构建两个方面，综合分析了民间文学艺术作品知识产权保护的宗旨和原则、范围和内容、归属和继承、设计与维护，希望对我国民间文学艺术作品的知识产权维护具有一定的借鉴性意义，从而更好的推动中国文化产业的发展与昌盛。

Abstract

Chinese culture, has a long history, profound, folk literature and art as an important part of the Chinese cultural treasures, with its richness, times, characteristic roots with Chinese and the Chinese people's life, has a strong vitality. At the same time, along with the rise of cultural industries, folk literature and art by its unique advantage has created a huge economic and social value. Since the 21st century, however, the legal disputes about folk literature art works, under the suppression and destruction of strong global culture, folk literature art works by globalization, and accounted for, the commercialization, seriously affected the diversity and richness of folk literature and art, the protection of folk literature and art is imminent. Legal protection for folk literature and art works in China from the current situation, our country's copyright law, trademark law and the protection of intellectual property rights of other relevant laws and regulations to standardize and restrict, when from the current situation of legislation to try and implement, the folk literature art works of intellectual property protection in China still has certain problem, therefore, in this paper, in the perspective of the protection of intellectual property rights, the protection of intellectual property from the folk literature art works the background and significance of comprehensive study and contrast the intellectual property rights (ipr) protection of folk literature and art works at home and abroad experience and mode, according to the definition of the folk literature art works and the basic characteristics, analyzed the folk literature art works of intellectual property protection in China's legislation to try and protect the status quo and existing problems, and thus put forward the our country folk literature art works of establishment and improvement of the protection of intellectual property rights strategy, from the current law and special law to build two aspects, the comprehensive analysis of the folk literature art works the purposes and principles of the protection of intellectual property rights, ownership and inheritance, scope and content, design and maintenance, to the works of folk literature and art in China intellectual property maintenance vb.it has certain reference significance, so as to better promote the development of China's cultural industry and
