根据<中华人民共和国合同法>< 中华人民共和国消费者权益保护法>< 中华人民共和国价格法><上海市合同格式条款监督条例>,<上海市建筑市场管理条例>,以及其他有关法律法规规定的原则，结合本工程的具体情况，甲、乙双方在平等、自愿、协商一致的基础上达成如下协议，共同遵守

“ PRC Price Law ” , “ Shan ghai Supervisi on of Con tract Terms ” , “ Shan ghai

Construction Market Management Regulations ” , as well as other laws and

regulati ons releva nt to the specific circumsta nces of this project, parties A and B have hereby equally and volun tarily en tered into the follow ing agreeme nt executed on the basis of mutual respect.

三、关于材料供应的约定

AGREEMENT ON THE SUPPL Y OF MATERIALS

1. 乙方提供的材料：乙方供应的材料、设备，如不符合设计、施工要求，应禁止使用。

如已使用，对工程造成的损失由乙方负责。如甲方要另增加材料由甲方供应，并应符合下列规定：

Material provided by Party B: Any materials or equipment supplied by Party B

which do not meet the desig n and con structi on requireme nts are prohibited. Any

extra materials requested by Party A which were not in the orig inal desig n must be

paid for by Party A.

2. 甲方提供的材料：另拟补充附件＜甲方提供材料、设备表＞甲方负责采购供应的材

料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方

提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用

的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙

方负责保管

Material provided by Party A: (see the ann ex: “ Table of Materials to

prov ided by the Owner ” )f Party A acquires materials for the project, it should first

check with Party B that the materials match to the desig n requireme nts, and once

the materials are in the care of Party B, the n

Party B is resp on sible for the materials. If Party A requires some materials which do not fit to the design then it shall be the responsibility of Party A to pay any additi onal costs in curred by Party B.

四、关于工程质量及验收的约定

FULFILMENT OF THIS AGREEMENT

1. 本工程应符合＜建筑装饰工程技术规程＞和市建设行政主管部门制定的其它地方标准质量评定验收标准

and Engineering Rules ” of the city administrative dpartments

resp on sible for the developme nt of build ings and local sta ndards and quality

evaluation acceptance criteria.

2. 本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认

Party B must provide a duplicate copy of the con structi on desig ns and draw in gs,

and both copies should be sig ned by both parties.
